Department: Public Works Item No: C6
Prepared by: Joshua Sino Cruz, Management Analyst Meeting Date: January 11, 2022 Approved by:

Kuna Muthusamy, Director
Patrick Johnson, City Manager Agenda Location: Consent Calendar SUBJECT: SECOND AMENDMENT TO CONTRACT WITH GQ BUILDERS, INC.

RECOMMENDATION: Adopt City Council Resolution No. 2022- , approving the second amendment to the contract with GQ Builders, Inc. for the Moonlight Restrooms Renovation Project.

COUNCIL GOALS: Routine operational item not directly corresponding to a specific City Council goal.

PRIOR ACTION: On February 9, 2021, adopted City Council Resolution No. 2021-17, approving a contract with SD Remodeling, Inc. for Moonlight Restrooms Renovation Project (Vote: 5-0).

On November 12, 2019, adopted City Council Resolution No. 2019-149, amending Operating Budget for Fiscal Years 2019/20 and 2020/21 (Vote: 5-0).

STATEMENT ON THE SUBJECT: On November 12, 2019, the City Council approved and allocated $180,000 in year-end fund balance to upgrade the north-end restrooms at the Moonlight Amphitheatre (Moonlight). These restrooms serve as the primary restrooms onsite holding the largest capacity. At the present, the restrooms do not reflect the quality of the venue, the productions, or experiences for which the Moonlight is known. The 23 years of wear and tear on the restrooms have made it difficult to maintain and keep clean, resulting in complaints from our patrons.

In February 2021, the City entered into a construction contract with SD Remodeling, Inc. to complete the project in the amount of $133,700. To date there has been one contract amendment, which updated their business entity name to GQ Builders, Inc. (GQ) (Exhibit 4), and four change orders totaling $24,227.19, for a current contract total of $157,927.19. The change orders were primarily needed due to unforeseen circumstances, which included removal of rotted and damaged subfloors, plumbing repairs, and drywall replacement. Additional details concerning the change orders are included as Exhibit 5. The change orders were approved by the City Manager and are within the authorized contract contingency amount.

During construction, GQ and staff have identified various unanticipated work items that are necessary for the completion of the project. The items include repairs to drywall and increased cost of materials and supplies such as toilet partitions and lighting fixtures. The cost of the additional work items is $3,680.

This added cost is outside the City Manager’s authorization and requires City Council approval.

Additionally, staff is requesting the contract ceiling to be increased to $180,000 ($18,392.81 more than the current change orders) to cover any unanticipated costs. Sufficient funding was allocated has been allocated to the project.
