Department: City Attorney Item No: PH1
Prepared by: Darold Pieper, City Attorney Meeting Date: February 8, 2022 Approved by: Patrick Johnson, City Manager Agenda Location: Public Hearing SUBJECT: PUBLIC HEARING TO CONSIDER CITY COUNCIL REDISTRICTING RECOMMENDATION: Open, conduct, and close a public hearing to receive a report from staff on the redistricting process and the permissible criteria to be considered to redraw district boundaries, and to receive public input on district boundaries.
CORRELATION TO CITY COUNCIL GOALS: Routine operational item not directly corresponding to a specific City Council goal.
PRIOR ACTION: On January 15, 2022, a community meeting was held to provide information to the public on the redistricting process and how to submit draft maps for consideration, as well as to receive input and comments from the public.
On December 14, 2021, the City Council conducted the first required public hearing to receive a report from staff on the redistricting process and the permissible criteria to be considered to redraw district boundaries, and to receive public input on district boundaries (No Vote).
On June 13, 2017, adopted City Council Ordinance No. 2017-8, amending Chapter 2.16 of the Vista Municipal Code, and establishing and implementing by-district elections for City Councilmembers (Vote: 5-0).
STATEMENT ON THE SUBJECT: Every ten years, California cities with by-district election systems must use new census data to review and, if needed, redraw district lines to reflect how local populations have changed. This process, called redistricting, ensures all districts have nearly equal populations.
The City adopted its current district boundaries on June 13, 2017, based on 2010 census data as required by law. The four districts must now be redrawn using the 2020 census data and in compliance with the FAIR MAPS Act (Act), which was adopted by the California legislature as Assembly Bill 849 and took effect January 1, 2020. Per Election Code, the redistricting process for the City must be completed by April 17, 2022.
Under the Act, the City Council shall draw and adopt boundaries using the following criteria in the listed order of priority:
1.Comply with the federal requirements of equal population and the Voting Rights Act AGENDA
REPORT
CITY COUNCIL
COMMUNITY DEVELOPMENT COMMISSION
SUCCESSOR AGENCY
BUENA SANITATION DISTRICT
JOINT POWERS FINANCING AUTHORITY

Opened, conducted, and closed a public hearing and received a report from staff on the redistricting process and the permissible criteria to be considered to redraw district boundaries, and to receive public input on district boundaries. Vote: 5-0
MEETING DATE: FEBRUARY 8, 2022 PAGE 2
SUBJECT: PUBLIC HEARING TO CONSIDER CITY COUNCIL REDISTRICTING 00105101 5
2. Geographically contiguous
3. Undivided neighborhoods and “communities of interest” (socio-economic geographic areas that should be kept together)
4. Easily identifiable boundaries
5. Compact (do not bypass one group of people to get to a more distant group of people)
6. Shall not favor or discriminate against a political party
The current demographics of the City’s four voting districts is attached as Exhibit 1.
By law, the City must hold at least four public hearings or three public hearings and one weekend workshop that enable community members to provide input on the drawing of district maps. Based on the direction of the City Council at the first public hearing held at the City Council meeting on December 14, 2021, the following tentative meeting and hearing dates were established:
• First public hearing on December 14, 2021
• First weekend community meeting on January 15, 2022
• Second public hearing on February 8, 2022
• Second evening community meeting on February 23, 2022 • Third public hearing on March 8, 2022
Information about redistricting has been available on the City’s website, in English and in Spanish, and was in the Our Vista New Magazine in early December. In addition, individual meetings have been, and will continue to be, promoted through social media, the Vista News Center, Vista Monday morning news, media releases (to English and Spanish language outlets), the City’s website, and various email distribution lists.
The public submitted comments at the January 15 community meeting, and those are recorded in the Minutes from that meeting attached as Exhibit 2.
As in the previous public hearing and community meeting, the City Council and the public will receive a presentation by Kay Vinson from the City’s demographers, National Demographics Corporation (NDC).
Ms. Vinson will discuss the draft maps that have been reviewed and approved by NDC as of February 1, 2022. As of that date two qualified draft maps were published by NDC and have been made available to the public. Copies of those maps are attached (Exhibits 3–4). Maps reviewed and approved after that date and before February 18, 2022, if any, will be available at the February 23 community meeting.
The public is requested to continue providing input regarding communities of interest and other local factors that should be considered while drafting district maps. A community of interest under the relevant Elections Code for the City is “a population that shares common social or economic interests that should be included within a single district for purposes of its effective and fair representation.”
Possible features defining communities of interest might include, but are not limited to:
• School attendance areas;
• Natural dividing lines such as major roads, hills, or highways; • Areas around parks and other neighborhood landmarks;
• Common issues, neighborhood activities, or legislative/election concerns; and • Shared demographic characteristics, such as:
o Similar levels of income, education, or linguistic insolation; o Languages spoken at home; and
o Single-family and multi-family housing unit areas.

SUBJECT: PUBLIC HEARING TO CONSIDER CITY COUNCIL REDISTRICTING 00105101 5
FUTURE STEPS: In order to complete the redistricting process before the April 17, 2022, statutory deadline, the following actions are proposed but are subject to change as necessary:
1. Prior to second community meeting, any additional draft district maps will also be posted to the City website and available at the Civic Center.
2. Prior to the third public hearing, any additional draft district maps received will also be posted to the City website and available at the Civic Center.
3. The Third public hearing will be held at the regular City Council meeting on March 8, 2022; at which time the City Council may adopt the final map.
FISCAL IMPACT: Implementation of the program as described is estimated to cost between $35,000 and $50,000, depending on the number of draft maps required, additional meetings, outreach expenses, and translation services. Sufficient funding is available in the Service Contract account (No. 0010140.521040.YEFB).

Community Meeting / Workshop on Redistricting
Vista Academy of Visual and Performing Arts - 600 N Santa Fe Ave Staff Present: Kathy Valdez, City Clerk
Consultant: Kay Vinson, National Demographic Corporation Attendees: A total of 19 individuals attended, including three City Council members Simultaneous interpretation was provided.
The meeting started shortly after 2:00 pm.
City Clerk Kathy Valdez welcomed everyone to the meeting and introduced Kay Vinson, National Demographic Corporation, who provided a PowerPoint presentation on redistricting, identifying communities of interest, and submission of maps.
Several participants stated that they felt the meeting was not promoted well enough and made the following suggestions of how to promote the process and upcoming meetings:
•Outreach through schools
•Banner across Vista Village Drive
•Paid social media boosting
•Promote through the Vista Chamber of Commerce
•Promote meetings earlier
•Ensure all postings are in English in Spanish
City Clerk Valdez stated she will look into these suggestions and shared that the meeting was promoted through social media (Facebook, Instagram, Twitter), Nextdoor, the City’s e-newsletter and website, and sent to both English and Spanish news outlets; information on redistricting was also included in the City’s Out Vista magazine that was mailed to every household in Vista. 02/08/2022 PH1 Page 5 of 10EXHIBIT 2
Ms. Vinson and City Clerk Valdez provided the following responses to questions:
•The City Council will decide on the final map at a Public Hearing •The Redistricting Public Hearings are time certain; they start at 6:00 pm •An entirely different process would be required to add additional City Council districts •Public input is welcome from anyone; there is not a process to verify that the input is from a Vista resident
When asked about communities of interest and neighborhoods, participants provided the following information for consideration:
•During the original districting process, some residents had suggested that Breeze Hill be included in District 4 because they have more in common with the other neighborhoods in that district, and this is likely still true
•There are several schools close together (Bobier, VAVPA, Vista High School) that make up a community of interest and should be in the same district •The Vista Transit Center is a central location to the community surrounding it, although there are also some natural barriers
•There are retail areas in District 4 that should be kept in one district •State Route 78 is a natural barrier, need to consider if it is more beneficial to have districts that cross that barrier or to use it as a dividing line between districts City Clerk Valdez provided a brief demonstration of the mapping tool using Excel and informed the group that she and staff will be available to assist people on the computer (or with paper maps) when City Hall is open to the public and at the next community meeting (on February 23). As suggested, she will look into creating a short demonstration video on how to use the tool for the City’s website.
City Clerk Valdez announced that the interactive map will be uploaded on the website; it is to view and compare maps, not to create them. Initially the interactive map will just have the current districts, but as maps are submitted and formatted they will be added to the interactive map.
The meeting ended at approximately 3:15 pm.

Hi Kathy,
I noticed that the map that was rendered from my data was a little different than my drawing (I didn't submit that). I realized it was my mistake. I had intended to put section 35 in D1, but put it in D2. I made some adjustments. Actually think the numbers work better. I like this version because I think it give more equal representation of the downtown sector. It seems to me the last time we did this, we had a preview available of what it would look like.
Thanks,

Good Evening council members,
In looking at the 2 maps, I noticed there is one sector in the NDC map that is split between D 3 and D4. It's where Sunset Dr turns into unincorporated. I believe the public map avoids this division.
Thank you,
Nanci Oechsle

Why Is Redistricting Necessary;* '
The City adopted its current district boundaries on June 13, 2017, based on 2010 census data as required.
By-district means the voters in each individual district vote for a representative residing in that district.
The first by-district elections:
2018 - Districts 1 and 4 and Mayor 2022
2020 - Districts 2 and 3 2024
Every 10 years the federal government conducts the Census, requiring review of districts to insure balanced population.
