Clerk/Secretary
Department: City Manager/City Clerk Item No: C4
Prepared by: Kathy Valdez, City Clerk Meeting Date: March 8, 2022 Approved by: Patrick Johnson, City Manager Agenda Location: Consent Calendar SUBJECT: LAW ENFORCEMENT SERVICES AGREEMENT
RECOMMENDATION: Adopt City Council Resolution No. 2022- , approving the agreement between the City of Vista, the County of San Diego, and the San Diego County Sheriff for municipal law enforcement services.
CORRELATION TO CITY COUNCIL GOALS: Public Safety.
PRIOR ACTION: On June 27, 2017, adopted City Council Resolution No. 2017-102, approving an agreement between the City of Vista, the County of San Diego, and the San Diego County Sheriff for general and specialized law enforcement and traffic services, and authorizing the Mayor to execute the agreement (Vote: 4-0, Rigby absent).
See Exhibit 3 for a complete list of prior City Council actions.
STATEMENT ON THE SUBJECT: Along with eight other cities in San Diego County, the City of Vista contracts with the County of San Diego for law enforcement services. The contract is jointly negotiated between the County and the nine cities (collectively, the “contract cities”), taking advantage of common needs and economies of scale that result in a lower cost for law enforcement services than having a municipal police department or individually contracting with the County.
The Vista Sheriff’s Captain serves as the City’s Chief of Police, providing a full range of law enforcement services, including patrol, traffic, and investigative services. The Vista station employs approximately
93.25 full time equivalent sworn officers, as well as administrative and management personnel. The station currently has 13 volunteers who provide numerous hours of support each month. The number of volunteers has been significantly impacted by COVID and will likely increase as restrictions ease.
A committee was formed to negotiate the new agreement on behalf of the contract cities, consisting of representatives from the cities of Imperial Beach, Poway, and San Marcos (representing a small, medium, and large contract city respectively). Attached as Exhibit 2 is the proposed five-year agreement for law enforcement services, covering Fiscal Years (FY) 2022/23 through 2026/27.
The rate increases over the five-year term of the agreement are: Year 1: 1 percent, Year 2: 1 percent, Year 3: 3.5 percent, Year 4: 3.5 percent, Year 5: 3.5 percent. The total rate increase over the five-year term is 12.5 percent, compared to a 27 percent increase over the last five-year contract.

SUBJECT: LAW ENFORCEMENT SERVICES AGREEMENT
A cost model showing the direct, station support, direct support, and overhead costs for the City is included in the contract attachments. The City will pay for direct staff, which includes: Deputies, Detectives, Sergeants, Community Service Officers, Vehicles, and Handheld Radios. Station Support and Direct Support costs are allocated based on the number of deputies, detectives, sergeants, and community services officers in the station. Overhead costs are allocated based on the number of deputies, detectives, sergeants, community services officers, and station support staff in the station. The agreement makes some adjustments to which positions fall under each of the above listed categories; these changes do not result in significant changes in cost to the City.
A change in the agreement is the number of calendar days required to provide notice when requesting changes in staffing and for when relief from compensation for an individual absence or a vacancy goes into effect, from 30 calendar days to 60 calendar days. As well as the addition of language that the City will not be credited for a vacancy that exceeds 60 days if that vacancy was created due to a promotion or move to a competitive position since those types of vacancies are “considered to be a natural progression in Sheriff personnel’s career path.” Typically, this is not a problem for contract cities.
The proposed agreement will save the City over a million dollars in FY 2022/23 and represents significant savings from what staff had projected for the next five years.
The San Diego County Board of Supervisors approved the agreement on January 25, 2022. The governing bodies of all participating agencies must individually approve the agreement. All contract cities are taking the agreement to their respective elected bodies in February and March. Staff recommends the City Council approve the five-year agreement for law enforcement services.
FISCAL IMPACT: The cost of the first year of the agreement is $26,942,596.64. Sufficient funds are budgeted in the FY 2022/23 Operating Budget in the Law Enforcement Contracts with Other Agencies account (No. 0010200.521010). The cost of future years will be included in subsequent operating budgets.

The Sheriff's have terrorized communities of color in Vista. They tortured Sergio Weick to death by shooting him 28 times with hollow point bullets and also tortured Jonathon to death by shooting him 16 times with hollow point bullets, leaving him with 22 gunshot wounds.
They then harassed the families and witnesses for speaking out against their terror. This department has not been held accountable for those murders nor for any other murders they have committed in the past. There can be no healing and no justice without accountability. I ask that you do not renew their contract as through their actions, they have proved that they have not made communities of color safer rather they have terrorized us. --
