RECOMMENDATION: Adopt City Council Resolution No. 2022- , approving an agreement with Orion Construction Corporation for design / build services for the Brengle Terrace Park Well & Water Distribution Project (CIP No. 8278).
CORRELATION TO CITY COUNCIL GOALS: Routine operational item not directly corresponding to a specific City Council goal.
PRIOR ACTION: On June 23, 2020, the City Council adopted Resolution No. 2020-107 approving the Six-Year Capital Improvement Program, the Capital Project Budget for Fiscal Years 2020/21 and 2021/22, and authorizing appropriations for Fiscal Years 2020/21 and 2021/22 capital projects (Vote: 5-0).
STATEMENT ON THE SUBJECT: The City purchases potable water for irrigation use at Brengle Terrace Park. To reduce the amount of purchased water, a limited preliminary investigation was conducted to determine if groundwater is available. The investigation revealed that there is a source of groundwater, but more investigation is needed to determine how much water and the reliability of the groundwater source. Once all variables are confirmed, the design of pumping and storage systems for the well can commence, and the Brengle Terrace Well and Distribution System can be constructed.
On August 12, 2021, staff issued a Request for Proposal (RFP) for qualified design / build entities for the Brengle Terrace Well & Water Distribution project. There were no proposals submitted in response to the RFP. Staff reached out to Orion Construction Corporation (Orion) as they have provided similar services to the City in the past. They were familiar with the project, the City’s processes, and submitted a thorough proposal. Staff reviewed the proposal and recommends approving a design / build contract with Orion Construction Corporation in the amount of $173,706 for Phase 1, design and pre-construction services.
Staff further recommends that this procurement be exempted from competitive bidding per Vista Municipal Code (VMC) Section 3.018.150.Q as the City solicited bid in accordance with the VMC and did not receive any responses. A Guaranteed Maximum Price and construction schedule will be developed at the end of Phase 1, and an amendment for construction will be presented for City Council approval at a future date.
FISCAL IMPACT: The cost for Orion Construction Corporation to provide design / build services for the Brengle Terrace Park Well & Water Distribution project Phase 1 is $173,706. Sufficient funding is budgeted and available in the Fiscal Years 2020/21 and 2021/22 Capital Improvement Budget in CIP AGENDA

A RESOLUTION OF THE CITY COUNCIL OF THE CHARTERED CITY OF
VISTA, CALIFORNIA, APPROVING AN AGREEMENT WITH ORION
CONSTRUCTION CORPORATION FOR DESIGN / BUILD SERVICES FOR
THE BRENGLE TERRACE PARK WELL & WATER DISTRIBUTION PROJECT (CIP NO. 8278)
The City Council of the City of Vista does resolve as follows:
1.Findings. The City Council hereby finds and declares the following:
A.Pursuant to section 3.08.075 of the Vista Municipal Code, a request for proposals (RFP) was issued on August 12, 2021 for design / build services for the Brengle Terrace Park Well & Water Distribution Project (CIP No. 8278).
B.No proposals were received in response to the RFP.
C.Staff reached out to Orion Construction Corporation as they have completed projects of a similar nature for the City of Vista, and Orion submitted a proposal.
D.Staff reviewed their proposal and recommend approved an agreement for design/build services for the Brengle Terrace Park Well & Water Distribution project (CIP No. 8278).
2.Action.s
A.The agreement with Orion Construction Corporation for design/build services for the Brengle Terrace Park Well & Water Distribution Project in the amount of $173,706 is approved, this procurement is exempt from the competitive bidding process, and the Mayor is authorized to execute the agreement.
3.Adoption. PASSED AND ADOPTED at a meeting of the City Council of the City of Vista held on March 22, 2022, by the following vote:
