STATEMENT ON THE SUBJECT: Staff recommends the City Council set a date for a public hearing to consider a proposed street vacation of excess street right-of-way at 165 Eucalyptus Avenue (Assessor Parcel Number 175-306-11). A vicinity map is attached as Exhibit 2. The proposed vacation area is a 7- foot-wide strip that runs along the perimeter of the circular parcel. This portion is part of the public street that was dedicated and accepted as “Park Avenue” on Map No. 2002 in 1927. The applicant, LLJ Cross Park, LLC, plans to redevelop the subject property.
The Public Streets, Highways, and Service Easement Vacation Law, within Section 8320 of the California Streets and Highway Code, requires a two-step process: 1) set the date for a public hearing, and 2) hold the public hearing.
To meet advance noticing requirements, staff recommends the public hearing to be held on May 24, 2022.
FISCAL IMPACT: The applicant, LLJ Cross Park, LLC, paid the $3,348.74 easement vacation fee, which was deposited to the Engineering Fees Revenue Account (No. 0010032.433000).

A RESOLUTION OF THE CITY COUNCIL OF THE CHARTERED CITY OF
VISTA, CALIFORNIA, DECLARING ITS INTENT TO INITIATE PROCEEDINGS TO VACATE STREET RIGHT-OF-WAY AT 165 EUCALYPTUS AVENUE

The City Council of the City of Vista does resolve as follows:
1.Findings. The City Council hereby finds and declares the following:
A.The Public Streets, Highways, and Service Easements Vacation Law, at Section 8320 of the California Streets and Highway Code (“Street Vacation Law”), authorizes the City to initiate proceedings for the vacation of public streets and easements.
B.The City Council desires to initiate proceedings to vacate a portion of Park Avenue, which was dedicated and accepted on Map No. 2002, recorded by the Recorder of San Diego County as File No. 12704 on March 2, 1927. The vacation area is a 7-foot-wide strip located along the perimeter of 165 Eucalyptus Avenue (APN 175-306-11), as shown on the attached Exhibit “A”.
2.Action.
A.The City Council declares its intent to hold a public hearing on May 24, 2022, at 5:30 p.m., or as soon thereafter as the matter may be heard, in the City Council Chambers located at 200 Civic Center Drive, Vista, California or by teleconferencing and electronic means consistent with State of California Executive Order N-29-20, pursuant to the Street Vacation Law to consider the street vacation at 165 Eucalyptus Avenue.
B.The City Engineer is authorized and directed to prepare notices for publication and to post such notices along the proposed vacation area in accordance with the Street Vacation Law.
C.The City Clerk is authorized and directed to publish a notice of public hearing at least fifteen days following the date this Resolution is approved and to publish that notice for two successive weeks prior to May 24, 2022.
