The Planning Commission met on July 19, 2022 and unanimously voted (6 nays as Commissioner John Aguilera was absent) to NOT approve a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program for a General Plan Amendment, Zone Change, and Tentative Subdivision Map including a Density Bonus for a 15-lot single-family residential subdivision located at 1205 Melrose Way (APNs 166- 184- 10- 00, 166- 184- 09- 00, and 166- 183- 17-00), and NOT approve a General Plan Amendment, Zone Change, and Tentative Subdivision Map including a Density Bonus for a 15-lot single- family residential subdivision located at 1205 Melrose Way (APNs 166- 184- 10- 00, 166- 184- 09- 00, and 166- 183- 17-00).
Major concerns raised by project P21-0130 include a large increase in density, increased traffic, decreased value of current residents' property, and incompatibility with the current neighborhood style.
The proposed very large increase in density may be significantly compounded by the addition of an accessory dwelling unit (ADU) which is allowed by State law within each one of the proposed lots.
Traffic impact is always a concern with new housing projects. Project P21-0130 does not meet screening criteria for a City traffic study. However, Melrose Way is a small, 2-lane residential street with an elementary school at the corner of Melrose Dr. Traffic congestion already occurs morning and afternoon during drop-off/pick-ups. The additional traffic generated by the high density of project P21-0130 will worsen bottlenecks. We feel it is critical that parking not be PH3
allowed on Melrose Way. Any residential project off Melrose Way must provide adequate on-site parking.
There were also apprehensions, particularly by area residents, about the negative impact Project P21-0130on property values.
The Planning Commission did not approve Project P21-0130 because of an increased density not in line with the status quo, substandard lots which are not compatible with existing housing in the area (as they would be much smaller), and substandard streets with inability to handle increased traffic.
South Vista Communities views are in line with the "No Approval" decision on Project P21-0130 made by the Planning Commission.
Thank you for the opportunity to provide input regarding this proposed residential project that would necessitate a zone change.
Respectfully submitted,
South Vista Communities Board of Directors
Francis Dumler
President

As previously stated McGavran Terrace is not a legal address, the home on the private road legally receive mail as McGavran Drive. This road is very narrow and an ambulance can access the entire road; however, due to the bends a fire truck was unable to several months ago. Picture attached above.

Re: Melrose Way 15 lot subdivision (P21-0130)
Honorable Mayor and City Council:
I request that you confirm the Vista Planning Commission's recommendation to deny a zone change from the E1 Estates Zone to the R-1 Residential zone for this location.
There are multiple reasons to oppose this change.
1. Zoran Djordjevich has the opportunity to redevelop this property with the existing land use designation. He would be able to build five large houses which would certainly provide him with a healthy profit, while increasing property values for the community.
2. The neighborhood has no trust in Zoran Djordjevich. He owns property in the community but doesn't live in the community. Several years ago, he put the land at 1205 Melrose Way up for sale with a realtor, but during a ZOOM meeting with the community, discussing his proposed development, he lied and said he had never put the property up for sale.
3. Zoran Djordjevich is a terrible landlord. There is no assurance that Zoran Djordjevich won't rent all 15 of these properties. Zoran Djordjevich does not adequately vet his renters. As adjacent property owners we have had his renters:
a. have run to our house yelling for us to call 911 due to domestic violence incidents; b. catch his property on fire;
c. perform drug deals;
d. wander the community intoxicated;
e. pull our mailbox out of the ground and drop it down the street; f. have more than five families living in one domicile; g. caused an explosion on his property;
h. hoarding household items stored on the back patio and side yard.
4. Zoran Djordjevich has owned the eyesore at 1205 Melrose Way for many years. It has remained an eyesore all those years. The neighborhood does not want 15 eyesores to drag down property values.
I have attached some images of the property at 1205 Melrose Way. I pray that we don't wind up with 15 properties that look like this.

Attach is a Traffic count preformed in the morning on August 22, 2022 at the intersection of Melrose Way and Marsopa Drive in Vista California. The vehicle count was conducted in person between 7:30 am and 8:30 am Monday morning August 22, 2022. All of the vehicles counted during this period had moved either east or west on Melrose Way passing proposed intersection of the new road from the 1205 Melrose Way project (P21-0133) and Melrose Way and in front of Breeze Hill Elementary School at 1111 Melrose Way, Vista California.
During the City Planning Commission meeting on construction project P21-0133, Melrose Way 15-lot subdivision, there was little information regarding vehicle traffic patterns on Melrose Way. After the meeting I ask one of the Planning Commission if an actual vehicle count had been conducted on Melrose Way. His answer was No.
Thank you for your actions with this information.

Vista, California City Council
Public Hearing of the City Council
In regard to P21-0130
We the neighbors of the proposed P21 - 0130 Project at 1205 Melrose Way would like to strongly support the PH3 recommended action of denying the General Amendment, Zone Change, Tentative Subdivision Map, and Density Bonus; (Number 5 of the recommended action list for the August 23, 2022 City Council Meeting).
At last month's General Plan meeting the city was presented with 88 signatures against this project, as well as oral statements clearly to that effect. At a Zoom facilitated meeting (back on January 26, 2021) five pages of signatures were presented and ten oral statements were made against the project.
The Tentative Subdivision Map incorrectly shows a proposed secondary access point from "McGavran Terrace". As you can easily confirm there is NO MAIL delivered to any such address by the Postal Service. The "McGavran Terrace" portion is a shared private access to residents who can ONLY receive their mail from a corner of McGavran Drive. As this is not a public road, it seems impossible to make it a proposed secondary access point for this proposed Melrose Way project. (Page 71 of 194 of the Subdivision Project Final). There is also no such designation as "McGavran Terrace"—even though the official Notice of Public Hearing displays a map with that label. The "Final Initial Study and Mitigated Negative Declaration" also states that the project borders McGavran Drive. It does not border McGavran Drive. "McGavran Terrace" is a convenience for FedEx, UPS, DoorDash—but it is NOT a cup-de-sac (as incorrectly stated on page 146 of 194 of the Final IS?MND); it is a shared private residential driveway/easement.
Pictures of McGavran Drive (Terrace) attached. The street is Private and a Fire truck was unable to drive it as pictures show. Due to size limit a second email will show the limited access due to the bend in the road.
The proposed zoning changes are an attempt to take a currently E1 /R1 designated parcel (that is part of an R! Neighborhood) and use it as a bridge to not just an additional two parcels but to two parcels that should only be accessed from Melrose Way. Such a proposed"bridge" would create a traffic intrusion in to our otherwise "set-apart"neighborhood. (While there is contiguous ownership of the parcels, these parcels do not share the other common and necessary descriptors or designations for a subdivision.) While Pacific International Investments, Inc. is looking for points of residential expansion, the current proposed project attempts zoning jumps for one proposed parcel (of this project) from
El/RIone half-acre and then to low density and then (thirdly) to Medium Low density, of 5 DU's/Acre. This E1/R1 parcel does not belong with this project. (Such a zoning jump from half acre minimum through a double bump to Low—and then to Medium Low Density is a normative breach of the General Plan's purpose and stated intention by the City of Vista. This does nothing to preserve our neighborhood. We think that is what our council is for. I will attend and request the opportunity to speak and develop some points in further detail.
The McGavran neighborhood supports the City of Council in the denial of this project- as currently proposed.
Regards,
Betty Randolph

I am writing this to you to oppose the 15 unit subdivision on Melrose Way in Vista.
I am sure the entire neighborhood would be in support of a development of the property at 1205 Melrose Way in the fashion of the nearby Presidio development off Ridge Road in Vista. The property owner could develop five beautiful homes with % acre lots such as the one pictured below:

Why can't the property owner build five house on five lots that raise the property values of the neighborhood?

Zoran Djordjevich owns the two properties(1205 and 1235 Melrose Way)circled in Red.For the property at 1235,Zoran added an additional granny flat circled in Blue.He does not live at these properties but rents them out.
My concern is that Zoran Djordjevich will get approved for 15 houses, but then immediately add granny flats to those locations increasing the total of his proposed development to 30 houses.
You can image how an additional 30 houses will impact our neighborhood.

Subject: Opposition to 15 units on Melrose Way
Date: Tuesday,August 23,2022 1:18:33 PM
Mayor and City Council,
We are writing to you to oppose the 15-unit subdivision at 1205 Melrose way in Vista.
Zoran has requested a density bonus and waivers for certain development standards in exchange for providing ONE affordable housing property on-site.
These waivers include those that pertain to lot size, parking, setbacks roadway and storm drain easement widths, and retaining walls.
Essentially, you are surrendering your own City development standards of an entire 15-unit development to get on low-income housing unit. This can only lead to decreasing property values in the surrounding homes around it.
We moved to this community and area for the quaint town it was, and I know you guys say it's about growth and change. But you are asking for our input and we all say NO, and we have been for the last three attempts that he has tried this, but you keep asking anyway.
What part of NO don't you get, we don't want 15 homes, we are okay with 4 homes on half acre lots, to keep the street as it is.
Sincerely, Curt and Jamie Nelson 23 years residents of Melrose Way Vista, Ca 92081

Project History
• On November 6, 2007, the Planning Commission recommended City Council denial of a request for a General Plan Amendment on the subject site from Low Density Residential (LD) to High Density Residential (HD) per Planning Case No.
PC19-063. However, no decision was rendered due to a continuance at the property owner's request. • On August 9, 2016, the City Council discussed a request for a General Plan Amendment on the subject site from Low Density Residential (LD) to High Density Residential (HD), and a Zone Change from Estates Residential (E-1) to Multi- Family Residential — (R-M (21)). Staff did not recommend support for the proposed land use changes and the City Council confirmed with consensus (Vote: 4-0, Aguilera absent).
• On January 26, 2021, the City Council discussed a preliminary request by the applicant to amend the General Plan land use designation from Low Density Residential (LD) to Medium Low Density Residential (MLD), and to correspondingly change the zoning from the Estate Residential (E-1) to Single-Family Residential (R-1) to enable the subdivision of 15 single-family residential lots per a Tentative Subdivision Map and Density Bonus. The Council provided input to the applicant and directed Staff to accept an application for the proposed entitlement.

Traffic Analysis
• CEQA threshold for a traffic study for Vehicle Miles Traveled (VMT): 1,000 average daily trips (ADT) and is consistent with the adopted General Plan. If a project is inconsistent with the adopted General Plan, a VMT analysis will be required if the project is 500 or more ADT. • City of Vista Transportation Impact Analysis Guidelines (TIA) — Projects that generate less than 500 daily vehicle trips are not required to conduct a VMT impact analysis.
— The proposed project can be implemented without impacting the operations of the surrounding roadway system.
— The proposed project is forecast to generate approximately 150 daily vehicular trips at full buildout (i.e., when all 15 homes are built). A Vehicle Miles Traveled (VMT) analysis was not required for this project.

Density Bonus — Concessions and Waivers
1. Concessions can be a reduction in development standards but are tied to identifiable and actual cost reductions.
Applicant shall receive one concession for projects that include at least S percent of the total units for very low-income households.
• Requested Density Bonus: 20 percent
• Percent of units provided as very low-income: 6.67 percent of total units • Equates to 1 very low-income residential unit. Per the State Density Bonus law, the applicant is allowed one concession related to a cost saving measure, which will be minimum lot size reduction.
2. Waivers are a reduction in development standards and are granted where the development standard would physically prevent the project from being built at the permitted density and with granted concession(s). The waiver or reduction of a development standard does not count as an incentive or concession, and there is no limit on the number of development standard waivers that may be requested or granted. Development standards for waivers being utilized for this project include:
a. Side yard setback e. Private street width
b. Rear yard setback f. Retaining wall type
c. Minimum lot width g. Width of storm drain easement d. Minimum lot depth

Density Bonus Calculation
The Density Bonus calculation is as follows:
- Project Site: 2.55 Gross Acres
- 2.55-acres x 5 du/ac = 12.75 DU's
- 12.75 DU's x 20% density bonus = 2.55 units (rounded up to 3 density bonus units) - Total DU's ( 12 + 3) = 15 DU's
Affordability calculation is as follows:
- 2.55-acres x 5 du/ac = 12.75 DU's
- 12.75 DU's x .05 affordable unit = .63 (rounded up to 1 very low-income unit) - .05 affordable unit is derived from CA Govt Code sec. 65915(b)(1)(B), applicant must provide at least 5% (e.g., .05) of the total units to very low-income households to obtain the density bonus. - Total number of affordable units = 1 very low-income unit

Concession
Minimum Lot Size - The R-1 zone requires at a minimum 10,000 square foot lot for subdivision per Vista Development Code Section 18.28.060. Per State Density Bonus allowances, the applicant will be utilizing this concession to create lots that are smaller than the required 10,000 square foot minimum lot size. This concession is being utilized because the proposed project would not otherwise be considered a viable project economically due to monetary constraints and cost saving measures. This higher density and smaller lot sizes would allow more units to be constructed and sold, thus, making the project more viable in return for providing one very low-income residential unit.
CITY OF VISTA
