Director Conley provided the following clarification of the new State Housing Legislation in response to City Council Members questions:
• ADUs are allowed in multi-family housing developments if there is room on site; can add two detached ADUs or modify (up to 25 percent) of existing building(s) • ADUs are required to include solar (PV) to power the unit • The City cannot require green building standards on a discretionary basis; however, the State code includes some green building requirements
• Under the density bonus, a 100 percent affordable project within a half mile of the Sprinter station could be up to eight or nine stories in most of the surrounding zones • On-site requirements for open space are in place; off-site cannot require unless there is a nexus, and the improvements are proportional to the impact of the project • The State waives some development fees; the City collects all eligible fees
