RECOMMENDATION: Introduce and adopt City Council Ordinance No. 2022- , amending Title 16 of the Vista Municipal Code, adopting by reference Parts 1 through 6, 8, and 10 through 12 of Title 24 of the California Code of Regulations.
CORRELATION TO CITY COUNCIL GOALS: 1) Homelessness and Housing, and 2) Public Safety.
PRIOR ACTION: On March 23, 2021, introduced and adopted City Council Ordinance No. 2021-2, Amending Title 16 of the Vista Municipal Code, adopting by reference Parts 1 through 6, 8, and 10 through 12 of Title 24 of the California Building Code of Regulations (Vote: 5-0).
STATEMENT ON THE SUBJECT: California Government Code Section 38660 empowers the legislative body of a city to regulate building construction. Section 50020 through Section 50022. 7 provides for adoption of the codes by reference. California Health and Safety Code Section 17958 requires the City to adopt the most recent edition of the model building codes as amended and adopted by the California Building Standards Commission.
New editions of the model codes are issued every three years. The last code adoption occurred on January 1, 2020. New model codes have been published by the State and become effective on January 1, 2023. The proposed Ordinance (Exhibit 1) formally adopts the latest California Building Standards Code as amended by the California Building Standards Commission.
Staff recommends the City Council adopt the latest model building codes, which will go into effect on January 1, 2023.
FISCAL IMPACT: There is no direct fiscal impact associated with the staff recommendation.

ORDINANCE NO. 2022-
AN ORDINANCE OF THE CITY COUNCIL OF THE CHARTERED CITY
OF VISTA, CALIFORNIA, AMENDING TITLE 16 OF THE VISTA
MUNICIPAL CODE, ADOPTING BY REFERENCE PARTS 1, THROUGH
6, 8, AND 10 THROUGH 12 OF TITLE 24 OF THE
CALIFORNIA CODE OF REGULATIONS
The City Council of the City of Vista does ordain as follows:
1. Findings. The City Council herby finds and declares that:
A. The City Council of the Chartered City of Vista finds that the public health, safety, and welfare will be best protected and served by the adoption of various building and construction industry codes that are established and maintained by the State Building Standards Commission.
B. Section 17958 of the Health and Safety Code mandates that the City of Vista adopt ordinances and regulations imposing the same requirements as are contained in the regulations adopted by the State pursuant to the Health and Safety Code Section 17922.
C. Section 18938 et seq. of the California Health and Safety Code specifies that the California Building Standards Code applies to all occupancies throughout the State.
2. Code Amendment.
A. Section 16.08.010 of the Vista Development Code is hereby amended to read as follows:
"Section 16.08.010 Adoption
The 2022 California Building Standards Code, California Code of Regulations, Title 24, Part 2, Volumes 1 and 2, inclusive of all current and future appendixes and amendments, as published and adopted by the California Building Standards Commission, and commonly known and/or referred to as the California Building Code, is hereby adopted by reference and incorporated herein as if fully set forth herein as if fully set forth in this chapter." B. Section 16.10.010 of the Vista Development Code is hereby amended to read as follows:
"Section 16.10.010 Adoption
The 2022 California Historical Building Standards Code, California Code of Regulations, Title 24, Part 8, inclusive of all current and future appendixes and amendments, as published and adopted by the California Building Standards Commission, is adopted by reference, and incorporated herein as if fully set forth in this chapter." C. Section 16.14.010 of the Vista Development Code is hereby amended to read as follows:
"Section 16.14.010 Adoption

The 2022 California Existing Building Code, California Code of Regulations, Title 24, Part 10, inclusive of all current and future appendixes and amendments, as adopted by the California Building Standards Commission, is adopted by reference, and incorporated herein as if fully set forth in this chapter."
D. Section 16.22.010 of the Vista Development Code is hereby amended to read as follows:
"Section 16.22.010 Adoption
The 2022 California Residential Code, California Code of Regulations, Title 24, Part 2.5 including all current and future appendixes and amendments, as published and adopted by the California Building Standards Commission, including amendments, is hereby adopted by reference and incorporated herein as if fully set forth." E. Section 16.24.010 of the Vista Development Code is hereby amended to read as follows:
"Section 16.24.010 Adoption
The 2022 California Mechanical Code, California Code of Regulations, Title 24, Part 4, inclusive of all current and future appendixes and amendments, as published and adopted by the California Building Standards Commission, is adopted by reference, and incorporated herein as if fully set forth in this chapter."
F. Section 16.26.010 of the Vista Development Code is hereby amended to read as follows:
"Section 16.26.010 Adoption
The 2019 California Energy Code, California Code of Regulations, Title 24, Part 6, inclusive of all current and future appendixes and amendments, as published and adopted by the California Building Standards Commission, is adopted by reference, and incorporated herein as if fully set forth in this chapter."
G. Section 16.28.010 of the Vista Development Code is hereby amended to read as follows:
"Section 16.28.010 Adoption
The 2022 California Electrical Code, California Code of Regulations, Title 24, Part 3, inclusive of all current and future appendixes and amendments, as published and adopted by the California Building Standards Commission, is adopted by reference, and incorporated herein as if fully set forth in this chapter."
H. Section 16.30.010 of the Vista Development Code is hereby amended to read as follows:
"Section 16.30.010 Adoption

The 2022 California Green Building Standards Code, California Code of Regulations, Title 24, Part 11, inclusive of all current and future appendixes and amendments, as published and adopted by the California Building Standards Commission, and sometimes known and/or referred to as CALGreen, is adopted by reference and incorporated as if fully set forth in this chapter."
I. Section 16.32.010 of the Vista Development Code is hereby amended to read as follows:
"Section 16.32.010 Adoption
The 2022 California Plumbing Code, California Code of Regulations, Title 24, Part 5, inclusive of all current and future appendixes and amendments, as published and adopted by the California Building Standards Commission, is adopted by reference, and incorporated as if fully set forth in this chapter."
J. Section 16.34.010 of the Vista Development Code is hereby amended to read as follows:
"Section 16.34.010 Adoption
The 2022 California Referenced Standards Code, California Code of Regulations, Title 24, Part 12, inclusive of all current and future appendixes and amendments, as published and adopted by the California Building Standards Commission, is adopted by reference, and incorporated as if fully set forth in this chapter."
3. Findings. The City Council finds that the amendments of the above-referenced Vista Development Code sections are required by California Health and Safety Code sections 17922 and 17958.
