RECOMMENDATION: Adopt City Council Resolution No. 2022- , authorizing the Mayor to accept an Irrevocable Offer of Dedication for portions of Grand Avenue and Poinsettia Avenue.
CORRELATION TO CITY COUNCIL GOALS: Routine operational item not directly corresponding to a specific City Council goal.
PRIOR ACTION: None.
STATEMENT ON THE SUBJECT: In 2005, the owner-developer of the industrial building development located at 921-925 Poinsettia Avenue in the Vista Business Park, granted an Irrevocable Offer of Dedication (IOD) to the City, which was recorded on June 6, 2005, as Recorded Document No. 2005- 0473545 (Exhibit 2). A Vicinity Map is attached as Exhibit 3. The IOD is for the dedication of public streets and covers a 42-foot-wide strip of Poinsettia Avenue that fronts the development's east side, and a portion of a traffic/fire-truck turn-around at the western end of Grand Avenue. These areas are already part of the City's public street system. Staff's research of the subject area revealed that this IOD has not been formally accepted. The acceptance of this IOD will confirm these sections of Poinsettia Avenue and Grand Avenue as public streets.
California Government Code Section 7050 specifies that an offer of dedication shall be irrevocable and may be accepted at any time by the City Council of the City within which the affected real property is located at the time of acceptance. Staff recommends that the City Council accept the Irrevocable Offer of Dedication.
FISCAL IMPACT: There is no direct fiscal impact associated with the staff recommendation.

VISTA, CALIFORNIA, AUTHORIZING THE MAYOR TO ACCEPT AN

The City Council of the City of Vista does resolve as follows:
1. Findings. The City Council hereby finds and declares the following:
A. In 2005, the City was granted an Irrevocable Offer of Dedication (IOD) for public streets covering portions of Grand Avenue and Poinsettia Avenue. This IOD was recorded on June 6, 2005 as Document No. 2005-0473545. This IOD was granted by the owner of the industrial buildings development located at 921-925 Poinsettia Avenue, identified as Assessor Parcel No. 217-255-01.
B. California Government Code Section 7050 specifies that an offer of dedication shall be irrevocable and may be accepted at any time by the city council of the city within which the affected real property is located at the time of acceptance.
C. The City now desires to accept the Irrevocable Offer of Dedication, recorded as Document No. 2005-0473545.
2. Action.
A. The City Council accepts the Irrevocable Offer of Dedication, recorded on June 6, 2005 as Document No. 2005-0473545.
B. The City Clerk, or her agent, is hereby authorized and instructed to record a copy of this Resolution in the Office of the County Recorder of San Diego County. [Continued on Page 2.1
