Clerk/Secretary
Department: Community Development Item No: PH1
Prepared by: Patsy Chow, Acting Director Meeting Date: April 11, 2023 Approved by: John Conley, City Manager Agenda Location: Public Hearing SUBJECT: APPEAL FOR SMOKE SHOP AT 1745 E. VISTA WAY, SUITES 3-5 (P22-0401) RECOMMENDATION:

1.Open, conduct, and close a public hearing to receive testimony regarding an appeal of Planning Case No. P22-0401, proposed smoke shop at 1745 E. Vista Way, Suites 3-5.

2. Adopt City Council Resolution No. 2023- , denying the appeal and granting a Special Use Permit to establish a smoke shop at 1745 E. Vista Way, Suites 3-5 (APN 173-070-40-00).

CORRELATION TO CITY COUNCIL GOALS: Relates to but does not directly support the following City Council goals: (1) A Cleaner Vista, and (2) Economic Development.

PRIOR ACTION: None.

PRIOR PLANNING COMMISSION ACTION: On February 21, 2023, adopted Planning Commission Resolution No. 2023-07, granting a Special Use Permit for a smoke shop at 1745 E. Vista Way, Suites 3-5 (Vote: 4-2, Rosaler and Hastings opposed).

STATEMENT ON THE SUBJECT: The project consists of a request for a Special Use Permit (SUP) to establish a smoke shop within an existing 2,313-square foot suite within the commercial center. A “smoke shop” is defined as “a retail place of business engaged primarily in the sale of any one or combination of the following: (1) tobacco; (2) tobacco derivatives; (3) non-tobacco substances produced for purposes of smoking; and (4) any type of paraphernalia or accessory manufactured or sold for the purpose of smoking, ingesting, preparing, or storing any of the preceding. No smoking of tobacco or any other product shall occur on any portion of the premises owned, rented, controlled, used, or operated by a smoke shop.” The project proposes to engage in the sale of items covered under the definition of a smoke shop and other retail goods, including smoking-related products, such as rolling papers, water pipes, and other related accessories (i.e. hookah, vaporizers, lighters, glass cleaner, grinders, ash trays, and hemp wick).

In addition, applicant will also be selling t-shirts, snacks, food items and beverages. All snacks, food items, and beverages will be pre-packaged items. The sale of alcoholic beverages is not proposed as part of the smoke shop. All products will be kept in either glass display cases or on racks behind the front counter, which will be only accessible by authorized personnel. The proposed hours of operation are Monday through Sunday, 9:00 AM to 10:00 PM.

Approved above recommendation with additional conditions of approval, adopted City Council Resolution No. 2023-50.

Vote: 5-0

MEETING DATE: APRIL 11, 2023 PAGE 2
SUBJECT: APPEAL FOR SMOKE SHOP (P22-0401)
The proposed floor plan for the space is included in Exhibit B of Exhibit 1. The retail facility is anticipated to have three to five total employees onsite during regular business hours; and at least one employee per shift (Shift 1: 9AM to 4PM and Shift 2: 4PM to 10PM). The project proposes a retail use only, no smoking of any product sold onsite or carried in would be permitted on the premises.

Conceptual floor plans for the proposed buildings are included as part of the proposed project (Exhibit B of Exhibit 1). The project is proposed to be located in existing commercial suites (suites# 3-5) in a multi- tenant commercial center. Interior tenant improvements are proposed within the space of the existing suites. The improvements will consist of counters and display areas, wall displays for sale of the merchandise, as well as office/employee breakroom and merchandise storage areas. No exterior modifications to the building are proposed as part of this application or permitted without an amendment to the SUP. Any future signage will go through a separate permitting process with the Planning Division.

The project site contains 32 off-street parking spaces within the commercial center (APN 173-070-40).

Neighborhood retail centers require a parking ratio of 4 spaces per 1,000 square feet of floor area, which equates to 26 required parking spaces for this entire commercial center (6,475 square feet total). Based on the proposed retail use, the existing 32 parking spaces within the center are anticipated to accommodate the project as well as existing and future retail uses allowed under the zoning. The 2,313 square foot suite for the smoke shop would generate the need for 10 parking spaces that are included/provided in the existing total of 32 parking spaces for the center.

Planning Review. The City’s Development Code requires consideration of a Special Use Permit in order to allow a smoke shop in the C-1 (Commercial) zone. The intent of the Special Use Permit process is to minimize potential impacts generated by the proposed uses. Specific operational restrictions have been included in the project or required as Conditions of Approval to minimize potential impacts. The SUP includes an evaluation of the project’s compatibility with surrounding land uses, as well as analysis of the project’s impact on City services. The project would be located within an existing retail center in the C-1 Zone. With implementation of the conditions of approval for the SUP, staff has determined that the project would be compatible with surrounding commercial retail, office and restaurant uses. The proposed project consists of a retail commercial use that would be consistent with similar commercial uses in the commercial center. The operating characteristics and hours of operation would be similar to the existing cannabis business within the same center. The applicant is not anticipating a significant increase in traffic as a result of proposed smoke shop. In addition, the Special Use Permit includes Conditions of Approval to minimize the potential for nuisance or disruption to other businesses. These include restricted access to anyone under 21 years of age, no smoking on the site, signs posted and enforcement of no loitering, onsite video surveillance, a dedicated security guard for the smoke shop, no outdoor events, and restrictions on exterior advertising.

General Plan: The proposed project is located within the General Commercial (GC) land use designation, which allows a range of commercial services including retail, restaurant, and office uses. The proposed smoke shop would comprise a commercial retail use consistent with the other commercial retail, office and restaurant uses within the vicinity, as well as within the commercial center itself where a cannabis business and a hair beauty salon are also located. Based on the characteristics of the proposed project, a Special Use Permit is required to ensure the smoke shop is compatible with surrounding land uses and the city can accommodate all needed public services. A number of Conditions of Approval are included (Exhibit A of Exhibit 1) to ensure compatibility of the proposed project with the existing land uses in the vicinity. With review and approval of the requested Special Use Permit (SUP), the project would be compatible with the GC General Plan land use designation.

The Healthy Vista Element of the General Plan includes policies 1.7 and 1.8 addressing tobacco use, which support a ban on smoking in City parks and public spaces, as well as the establishment of tobacco

MEETING DATE: APRIL 11, 2023 PAGE 3
SUBJECT: APPEAL FOR SMOKE SHOP (P22-0401)
free outdoor spaces. The proposed smoke shop would not include smoking areas or promote smoking in public places and, therefore, would not conflict with the policies in the Healthy Vista Element.

Zoning / Development Code: The proposed project is located within the C-1 Zone. A smoke shop is permitted in the C-1, C-2, C-3 and M-1 zones with approval of an SUP. With approval of an SUP, the proposed project would be consistent with the requirements of the C-1 Zone. Further, the Development Code restricts the establishment of a tobacco store within 1,000 feet of a public or private elementary or secondary school. Based on the Planning Division’s review of surrounding land uses, no public or private elementary or secondary schools are located within 1,000 feet of the proposed project.

Environmental Review. The proposed project is exempt under State CEQA Guidelines Section 15332 - In-Fill Development Projects, which is a Class 32 categorical exemption. The proposed project meets the following five in-fill conditions of Class 32 exemptions: (a) it would be consistent with the applicable designations and policies of the City’s General Plan and Zoning Ordinance; (b) it would be developed within City limits on a site no more than five acres that is substantially surrounded by urban uses; (c) the project site does not contain any habitat for endangered, rare or threatened species; (d) approval of the project would not result in significant effects related to traffic, noise, air quality, or water quality; and (e) the site can be adequately served by all required public utilities and services.

Planning Commission Review. The Planning Commission reviewed the proposal on February 21, 2023, and approved the SUP. The Planning Commission Staff Report and Minutes are included as Exhibit 2.

An appeal of the Planning Commission’s decision regarding the project was filed by Deputy Mayor Contreras on March 2, 2023 (Exhibit 4).

FISCAL IMPACT: The proposed project is estimated to generate approximately $55,000 in annual sales tax revenue, of which the City would receive approximately $6,667 in general sales tax and $3,333 in Proposition L sales tax.

PLANNING CASE NO. P22-0401
The City Council of the City of Vista does resolve as follows:

1. Findings. The City Council hereby finds and declares the following:

A. Pursuant to Section 18.74.120 of the Vista Development Code, the applicant, OTC SS Vista LLC, has submitted an application for a smoke shop located at 1745 E. Vista Way, Suites 3-5.

B. On February 21, 2023, the Planning Commission held a duly noticed public hearing on the request to grant the Special Use Permit on a property generally described as follows:

A 0.71-acre parcel of land addressed as 1745 E. Vista Way, and known as Assessor’s Parcel Numbers 173-070-40-00.

D. Pursuant to Title 18 of the Vista Development Code, the City Council did consider the recommendations of the City Planner, Vista Fire Department, the Vista Irrigation District, or their authorized representatives, with respect to appropriate fire flow, fire hydrants, public improvements and connections to be installed, and such other agencies as may have been deemed necessary by the Community Development Director, pertaining to the project.

E. The project is categorically exempt from the requirement to prepare an environmental document pursuant to State CEQA Guidelines Section 15332 - In-Fill Development Projects, which is a Class 32 categorical exemption.

F. At the public hearing staff reports both written and oral were received in evidence, and all persons desiring to speak on the project were heard. At the conclusion of said hearing, after consideration of all evidence presented, the City Council made certain findings and reached a decision on the project as hereinafter set forth.

2. Action.

A. The above recitations are true and correct.

B. The City Council makes the following findings with regards to the request for a Special Use Permit for the smoke shop within an existing commercial building located at 1745 E. Vista Way, Suites 3-5:

1. The project conforms with the following:
a) The proposed use is consistent with the General Plan and any applicable specific plan:
i) The Vista General Plan 2030 Land Use designation
for the project site is General Commercial (GC). This designation generally allows for a range of commercial and other compatible land uses as implemented through the City of Vista Development Code, Title 18, Zoning. Zones considered compatible with the GC Land Use designation include the Commercial Zones C-1, C-2 and Office Professional OP. The project site is zoned C-1 Commercial, which allows for a smoke shop provided that a Special Use Permit is obtained in accordance with the procedures specified under the Development Code.
ii) The project consists of a request for a Special Use Permit to establish a smoke shop in the C-1 Zone. The requested Special Use Permit will not adversely affect the General Plan because there are no goals or objectives specific to the project proposal, and the proposed use would provide smoking-related products and other general retail goods available to residents in the surrounding community. The General Plan further requires all development projects to be compatible with surrounding uses, therefore, the proposed use will be subject to Conditions of Approval to ensure such compatibility. With implementation of the Conditions of Approval included in Exhibit “A”, and adherence to the Project Plans in Exhibit “B”, the project would be consistent with the General Plan and the GC Land Use designation. There are no specific plans applicable to the subject site. b) The proposed use, in the manner to be conducted, is
permitted in the applicable zone and will conform to applicable federal, state, and local laws or regulations:

P22-0401 res
i) The project site is located within the C-1 Zone,
which permits a range of commercial uses, as well as a smoke shop provided that a Special Use Permit is obtained. The applicant has requested approval to establish a smoke shop within an existing commercial center that would operate during normal daytime and evening business hours; proposed hours are Monday through Sunday 9:00am to 10:00pm. A number of conditions of approval are included addressing age restrictions, smoking restrictions, security, advertising, and special events for the proposed use. Upon approval the proposed use, as conditioned, will be in compliance with local regulations and will not conflict with any federal or state laws. The use would also be compatible with the various commercial uses permitted in the surrounding area.
ii) The project site is not located within 1,000 feet of any public or private elementary or secondary school consistent with Development Code Section 18.58.475. The nearest school is the Alta Vista High School and the Vista Early Learning Center, located approximately 2,100 feet southeast of the project site.
c) The site for the proposed use has a size that is sufficient to reasonably accommodate the planned activities and will be served by existing infrastructure and utilities sufficient to serve the neighborhood, inclusive of the proposed use, or has been conditioned to install such infrastructure and utilities:
i) The subject property is part of an (approximate)

0.71-acre commercial center development. The site is currently served by all necessary utilities and public services and is fully parked. The project site is sufficiently sized to accommodate all activities associated with the proposed smoke shop onsite.
ii) The existing commercial suites at 1745 E. Vista
Way, Suites Nos. 3-5, are of sufficient size to accommodate the proposed smoke shop, which will occupy approximately 2,313 square feet. All facilities, equipment and personnel associated with the use will be accommodated within the proposed floor space. No outdoor events, promotions or other outdoor activities associated with the smoke shop are permitted.
iii) The existing parcel within the commercial center
includes 32 parking spaces, which accommodates the off-street parking needed for the 2,313 square foot smoke shop (commercial retail use) at a neighborhood center parking ratio in addition to the parking required for the center’s other uses. d) The design, location, size, and operating characteristics of the proposed use will be compatible with the existing and planned land uses in the vicinity:
04/11/2023 PH1 Page 6 of 39

RESOLUTION 2023-

CITY COUNCIL OF THE CHARTERED CITY OF VISTA

P22-0401 res
i) The proposed smoke shop would operate during
normal daytime and evening business hours consistent with the hours of operation for surrounding commercial tenants. In addition, specific conditions of approval are included to address security and other operating standards for activities associated with the project. Further, the project site is located in a commercial center that is surrounded by similar commercial land uses. Based on the project location and associated conditions of approval, the project would be compatible with existing and planned land uses in the vicinity of the site.
e) The proposed use, at its location, will provide the
neighborhood and/or city with a service or facility that will contribute to its general welfare:
i) The proposed project would provide smoking-
related products and other retail goods for the residents of the City of Vista, subject to age limitations and operational standards governed by State and local law. f) The proposed use, and its operation, will not be unduly detrimental to: (i) the health, safety or general welfare of persons residing or working in the vicinity; (ii) property or improvements in the vicinity; or (iii) the fiscal or economic interests of the City of Vista:
i) The proposed use involves the occupancy of an
existing building for a retail commercial use as a smoke shop. Conditions of Approval are included addressing age restrictions, smoking restrictions, security, advertising, hours of operation and special events, among other factors. The Conditions of Approval included as Exhibit “A” would ensure safe operations and compatibility with surrounding land uses.

C. In view of the above findings and the applicable law, the City Council hereby approves the Special Use Permit for a smoke shop at 1745 E. Vista Way, Suites Nos. 3-5, (P22-0401), subject to the Conditions of Approval in Exhibit A to this Resolution.

D. The applicant must execute a written acceptance of these Conditions of Approval no later than thirty (30) days after the permit is approved or the permit shall become null and void.

1.2 PROVIDE TRAPEZE OR OTHER SUPPLEMENTARY SUPPORT MEMBERS AT OBSTRUCTIONS TO TYPICAL HANGER SPACING. PROVIDE ADDITIONAL HANGERS, STRUTS OR BRACES AS REQUIRED AT ALL CEILING BREAKS, SOFFITS OR DISCONTINUOUS AREAS. HANGER WIRES THAT ARE MORE THAN 1 IN 6 OUT OF PLUMB ARE TO HAVE COUNTER-SLOPING WIRES.

1.3 CEILING GRID MEMBERS MAY BE ATTACHED TO NOT MORE THAN TWO (2) ADJACENT WALLS. CEILING GRID MEMBERS SHALL BE AT LEAST 1/2" FREE OF OTHER WALLS. IF WALLS RUN DIAGONALLY TO CEILING GRID SYSTEM RUNNERS, ONE END OF MAIN AND CROSS RUNNERS SHOULD BE FREE, AND A MINIMUM OF 1/2" CLEAR OF WALL.

1.4 AT THE PERIMETER OF THE CEILING AREA WHERE MAIN OR CROSS RUNNERS ARE NOT CONNECTED TO THE

ADJACENT WALL, PROVIDE INTERCONNECTION BETWEEN THE RUNNERS AT THE FREE END TO PREVENT LATERAL SPREADING. A METAL STRUT OR A 16 GA. WIRE WITH A POSITIVE MECHANICAL CONNECTION TO THE RUNNER MAY BE USED. WHERE THE PERPENDICULAR DISTANCE FROM THE WALL TO THE FIRST PARALLEL RUNNER IS 12" OR LESS, THIS INTERLOCK IS NOT REQUIRED.

1.5 PROVIDE BRACING ASSEMBLIES CONSISTING OF A COMPRESSION STRUT AND FOUR (4) 12 GA. SPLAYED BRACING WIRES ORIENTED 90 DEGREES FROM EACH OTHER AT THE FOLLOWING SPACING:
a. PLACE BRACING ASSEMBLIES AT A SPACING NOT MORE THAN 12" BY 12" ON CENTER. b. PROVIDE BRACING ASSEMBLIES AT LOCATIONS NOT MORE THAN ONE HALF (1/2) THE SPACINGS GIVEN ABOVE, FROM EACH PERIMETER WALL AND AT THE EDGE OF VERTICAL CEILING OFFSETS. c. SUSPENDED ACOUSTICAL CEILING SYSTEMS WITH A CEILING AREA OF 144 SQUARE FEET OR LESS, AND FIRE RATED SUSPENDED ACOUSTICAL CEILING SYSTEMS WITH A CEILING AREA OF 96 SQUARE FEET OR

LESS, SURROUNDED BY WALLS WHICH CONNECT DIRECTLY TO THE STRUCTURE ABOVE, DO NOT REQUIRE BRACING ASSEMBLIES WHEN ATTACHED TO TWO ADJACENT WALLS.

1.6 FASTEN HANGER WIRES WITH NOT LESS THAN THREE (3) TIGHT TURNS. FASTEN BRACING WIRES WITH FOUR (4) TIGHT TURNS. MAKE ALL TIGHT TURNS WITHIN A DISTANCE OF 12" INCHES. HANGER OR BRACING WIRE

ANCHORS TO THE STRUCTURE SHOULD BE INSTALLED IN SUCH A MANNER THAT THE DIRECTION OF THE WIRE ALIGNS AS CLOSELY AS POSSIBLE WITH THE DIRECTION OF THE FORCES ACTING ON THE WIRE.

NOTE: WIRE TURNS MADE BY MACHINE WHERE BOTH STRANDS HAVE BEEN DEFORMED OR BENT IN WRAPPING CAN WAIVE THE 12" REQUIREMENT, BUT THE NUMBER OF TURNS SHOULD BE MAINTAINED, AND BE AS TIGHT AS POSSIBLE.

1.7 ALL FIXTURES AND AIR TERMINALS OR SERVICES SUPPORTED ON INTERMEDIATE DUTY GRID SYSTEMS MUST BE INDEPENDENTLY SUPPORTED BY NOT LESS THAN FOUR (4) TAUT 12 GA. WIRES EACH ATTACHED TO THE FIXTURE OR TERMINAL, AND TO THE STRUCTURE.

1.8 SUPPORT SURFACE MOUNTED LIGHT FIXTURES BY AT LEAST TWO POSITIVE DEVICES WHICH SURROUND THE CEILING RUNNER AND WHICH ARE EACH SUPPORTED FROM THE STRUCTURE ABOVE BY A 12 GA. WIRE. SPRING CLIPS OR CLAMPS THAT CONNECT ONLY TO THE RUNNER ARE NOT ACCEPTABLE. PROVIDE ADDITIONAL SUPPORTS WHEN LIGHT FIXTURES ARE 8'-0" OR LONGER.

1.9 SUPPORT PENDANT MOUNTED LIGHT FIXTURES DIRECTLY FROM THE STRUCTURE ABOVE WITH HANGER WIRES OR CABLES PASSING THROUGH EACH PENDANT HANGER AND CAPABLE OF SUPPORTING FOUR (4) TIMES THE WEIGHT OF THE FIXTURE. A BRACING ASSEMBLY PER DETAIL 8 IS REQUIRED WHERE THE PENDANT HANGER PENETRATES THE CEILING. SPECIAL DETAILS ARE REQUIRED TO ATTACH THE PENDANT HANGER TO THE BRACING ASSEMBLY TO TRANSMIT HORIZONTAL FORCES.

B.Project Description
The project consists of a request for a Special Use Permit to establish a smoke shop within an existing 2,313-square foot suite within the commercial center. No smoking of tobacco or any 04/11/2023 PH1 Page 27 of 39EXHIBIT 2

P22-0401 SUP 2
other product shall occur on any portion of the premises owned, rented, controlled, used, or operated by a smoke shop.”
The project proposes to engage in the sale of items covered under the definition of a smoke shop and other retail goods, including smoking- related products, such as rolling papers, water pipes, and other related accessories (i.e. hookah, vaporizers, lighters, glass cleaner, grinders, ash trays, and hemp wick). In addition, applicant will also be selling t-shirts, snacks, food items and beverages. All snacks, food items, and beverages will be pre-packaged items. No sales of alcoholic beverages at the proposed smoke shop. All products will be kept in either glass display cases or on racks behind the front counter, which will be only accessible by authorized personnel.

The proposed hours of operation are as follows:
•Monday through Sunday: 9:00 AM to 10:00 PM
The proposed floor plan for the space is included in Exhibit B. And again, there will be no sales of alcoholic beverages at the proposed smoke shop.

C.Topography
The site is completely developed with a commercial building, paved parking, and landscaped areas. No changes to the physical arrangement of the project site are proposed.

F.Street Access/Frontage
The site fronts on E. Vista Way. One driveway provides full access to the project site from E. Vista Way. The fronting public street is fully improved; no additional improvements are required.

G.Environmental Review

H.Ordinance Requirements
A smoke shop is allowed in the C-1 Zone, subject to the issuance of a Special Use Permit (per VDC 18.38.020.33). The primary considerations for approval of the Special Use Permit are site functionality and the compatibility of the proposed use with surrounding land uses.

A tobacco store may not be located within 1,000 feet of any public or private elementary or secondary school (per VDC 18.58.475). The nearest school to the site is the Alta Vista High School and the Vista Early Learning Center (Preschool), which are both located at 1575 Bonair Road, approximately 2,100 feet away from the project site.

II.ANALYSIS
A.General Plan and Zoning

1.General Plan: The proposed project is located within the General Commercial (GC) land use designation, which allows a range of commercial services including retail, restaurant, and office uses. The proposed smoke shop would comprise a commercial retail use consistent with the other commercial retail, office and restaurant uses within the vicinity as well as within the commercial center itself where a cannabis business and a hair beauty salon are also found. Based on the characteristics of the proposed project, a special use permit is required to ensure the smoke shop is compatible with surrounding land uses and the city can accommodate all needed public services. A number of Conditions of Approval are included (in Exhibit 1A) to ensure compatibility of the proposed project with the existing land uses in the vicinity. With review and approval of the requested special use permit, the project would be compatible with the GC General Plan land 04/11/2023 PH1 Page 29 of 39

P22-0401 SUP 4
use designation.

The Healthy Vista Element of the General Plan includes policies 1.7 and 1.8 addressing tobacco use, which support a ban on smoking in City parks and public spaces, as well as the establishment of tobacco free outdoor spaces. The proposed smoke shop would not include smoking areas or promote smoking in public places and, therefore, would not conflict with the policies in the Healthy Vista Element.

2. Zoning: The proposed project is located within the C-1 Zone. A smoke shop is permitted in the C-1, C-2, C-3 and M-1 zones with approval of a special use permit. The requirements associated with the special use permit are discussed below. With approval of a special use permit, the proposed project would be consistent with the requirements of the C-1 Zone.

3.Special Use Permit: The special use permit (SUP) includes an evaluation of the project’s compatibility with surrounding land uses, as well as analysis of the project’s impact on City services. The project would be located within an existing retail center in a commercial zone C-1. With implementation of the conditions of approval for the SUP, staff has determined that the project would be compatible with surrounding commercial retail, office and restaurant uses. The proposed project consists of a retail commercial use that would be consistent with similar commercial uses in the commercial center. The operating characteristics and hours of operation would be similar to the cannabis business within the same center. The applicant is not anticipating an increase in traffic as a result of proposed smoke shop.

In addition, the Special Use Permit includes Conditions of Approval to minimize the potential for nuisance or disruption to other businesses.

These include restricted access to anyone under 21 years of age, no smoking on the site, signs posted and enforcement of no loitering, onsite video surveillance system, no outdoor events, and restrictions on exterior advertising.

With regard to city services, the project proposes a retail commercial use that is not anticipated to result in a high number of calls for emergency or law enforcement services. Maintenance and security for the facility and the surrounding area are the responsibility of the applicant and property owner and, therefore, are not anticipated to generate a high need for public maintenance. The project would require a tobacco license from the city which must be renewed annually. With implementation of the Conditions of Approval required under the Special Use Permit, the proposed project would be compatible with surrounding land uses and is not anticipated to result in negative impacts to city services.

B.Site Plan Analysis

1.Elevations and floor plans: The project is proposed to be located in existing commercial suites (suites# 3-5) in a multi-tenant commercial center. Future sign permit will go through a separate process for review.

2. Parking: The project site contains 32 off-street parking spaces within the commercial center (APN 173-070-40). Neighborhood retail centers require a parking ratio of 4 spaces per 1,000 square feet of floor area, which equates to 26 required parking spaces for this entire commercial center (6,475 square feet total). Based on the proposed retail use, the existing 32 parking spaces within the center are anticipated to accommodate the project as well as existing and future retail uses allowed per zone. The 2,313 square foot suite for the smoke shop would generate the need for 10 parking spaces that are
included/provided in the existing total of 32 parking spaces for the center.

3.Hours of Operation: The proposed hours of operation for the smoke shop are 9:00 AM to 10:00 PM Monday through Sunday. These hours of operation are included in the Conditions of Approval attached as Exhibit 1A. With adherence to the Conditions of Approval, the project’s operating hours would be consistent with businesses in the commercial center and immediate vicinity.

C.Public Service Availability
All necessary services are available to the site.

D.Traffic Impacts
The proposed use will be located in an existing commercial center and is not anticipated to generate a significant level of traffic. All required parking is currently in place. No additional improvements are proposed or are necessary.

E.Public Policy Consideration

1.General Plan Conformance: The project’s conformity with the General Plan is discussed above. With approval of the Special Use Permit and adherence with the Conditions of Approval, the project would conform to the policies of the General Plan.

2.Development Code: Section 18.38.020 of the Development Code requires the approval of a special use permit for the establishment of a smoke shop in the C-1 Zone. The findings to approve the Special 04/11/2023 PH1 Page 31 of 39

Use Permit are included in Exhibit 1. A smoke shop may not be located within 1,000 feet of a public or private elementary or secondary school. No public or private elementary or secondary school is located within 1,000 feet of the project site.

III.CONCLUSIONS AND REASONS FOR RECOMMENDATION:

Staff recommends approval of the attached Resolution for the Special Use Permit as the project meets the applicable Development Code standards, is compatible with surrounding land uses, and is not anticipated to negatively impact the community.

Respectfully submitted,
Patsy Chow
