BUENA NAVIGATION CENTER - RELEASE OF LIABILITY
I/we acknowledge that I, and if applicable, my/our family will be guests of the Buena Creek Navigation Center (“Center”). In consideration of being permitted to use the facilities located at the Center and /or participate in the activities and/or receive services provided by the Center, including emergency shelter, housing, food, clothing, counseling, case management and/or any other activities or services provided to me or those in my care at the Center (collectively, the “Program"), we, myself and all individuals enrolled in the Program with me, intend to be legally bound and hereby acknowledge and agree to the following:
Acknowledgment of Risk or Injury Possibility
As a participant in the Program, I/we recognize the risk and acknowledge that there are certain risks of physical injury – including death, damages, property damage, or loss – which we may sustain as a result of using the facilities at the Center and participating in any and all activities connected with the Program s conducted at the Center.
Waiver of Claim for Injury Clause
We, myself and all individuals enrolled at the Center with me, agree to waive and relinquish all claims that we may have for injuries or damages as a result of use of the Center facilities, participating in programs and activities at the Center and/or use of equipment at the Center against the City of Vista and/or the City of Encinitas, including, their officials, agents, contractors, employees, volunteers and affiliates.
Release from Liability Clause
We, myself and all individuals enrolled at the Center with me, do hereby release and discharge the Center and the Cities of Vista and Encinitas, including their officials, agents, contractors, employees, volunteers and affiliates, from any and all claims for loss and injuries, including death, damages, property damage, which I/we may have or may in future accrue to me, myself and all individuals enrolled at the Center with me, on account of use of the Center facilities and/or participating programs and activities at the Center.
Indemnity and Defense Clause
We, myself and all individuals enrolled at the Center with me, further agree to indemnify and hold harmless and pay defense costs and defend the Center and the Cities of Vista and Encinitas, including their officials, agents, contractors, employees, volunteers and affiliates, from any and all claims resulting from injuries and/or loss, including death, damages, property damage, or loss sustained by me/us and arising out of, connected with, or in any way associated with my/our use of the Center facilities and/or participating in programs and activities at the Center.
As indicated by my signature below, I have read and fully understand the terms of this release.
