Approved by:

Greg Mayer, Director of Engineering
John Conley, City Manager Agenda Location: Consent Calendar SUBJECT: CIP NO. 8331 – FIRE STATION NO. 3 REPLACEMENT PROJECT – FIRST AMENDMENT TO THE AGREEMENT WITH ERICKSON-HALL CONSTRUCTION CO.

RECOMMENDATION:

1. Adopt City Council Resolution No. 2024- , approving the first amendment to the agreement with Erickson-Hall Construction Co. for design/build services for the Fire Station No. 3 Replacement Project (CIP No. 8331).

2.Adopt City Council Resolution No. 2024- , amending the Capital Project Budget for Fiscal Years 2022/23 and 2023/24.

CORRELATION TO CITY COUNCIL GOALS: Public Safety.

PRIOR ACTION: On October 11, 2022, the City Council adopted Resolution No. 2022-149 approving an agreement with Erickson-Hall Construction Co. for design/build services for the Fire Station No. 3 Replacement Project (CIP No. 8331) (Vote: 4-0, Green absent).

On June 28, 2022, adopted City Council Resolution No. 2022-108, approving the Six-Year Capital Improvement Program and FYs 2022/23 and 2023/24 Capital Project Budget and authorizing appropriations for Fiscal Years 2022/23 and 2023/24 Capital Projects (Vote: 4-0, Ritter absent (Ritter experienced technical difficulties)).

STATEMENT ON THE SUBJECT: Vista Fire Station No. 3, located at 1070 Old Taylor Street (Vicinity Map included as Exhibit 5), is over 60 years old and is in need of modernization. Capital Improvement Program (CIP) Project No. 8331, the Fire Station No. 3 Replacement Project, will demolish the existing structures and construct an approximately 8,200 square foot fire station and all appurtenances. The replacement will provide a new facility built to current essential services standards to allow for firefighters to rapidly respond to the growing needs of the community. In addition, the project includes remodeling an existing Vista Unified School District (VUSD) building, located at 1250 Arcadia Avenue, to temporarily serve as the fire station during the fire station reconstruction. A separate License Agreement for temporary use of the VUSD facility was previously processed.

First Amendment to the Design-Build Agreement. On October 11, 2022, City Council awarded the Design-Build Team (DBT) of Erickson-Hall Construction Co. (Erickson-Hall) the design portion of the project. The DBT has completed the design, and staff has negotiated a Guaranteed Maximum Price AGENDA

Approved above recommendation, adopted the following: City Council Resolution No. 2024-66, Vote:

MEETING DATE: MAY 28, 2024 PAGE 2
SUBJECT: CIP NO. 8331 – FIRE STATION NO. 3 REPLACEMENT PROJECT – FIRST AMENDMENT TO THE AGREEMENT WITH ERICKSON-HALL CONSTRUCTION CO.
(GMP) with the DBT and recommends approval of the first amendment to establish the GMP of $15,149,181. The proposed amendment to the agreement with Erickson-Hall establishes the GMP and allows the DBT to begin Phase 2 construction services and Phase 3 operation/startup services as specified in Sections 6 and 7 of the original agreement (Exhibit 4).

Appropriation Request. The appropriation request is necessary due to a significant cost increase. The cost for off-site work items is significantly higher than estimated. The cost for undergrounding of overhead utilities, the traffic signal, the street improvements, and the water and sewer connections, increased from an estimated $1.27 million to a bid cost of $1.75 million.

The costs for labor and materials were higher than estimated. The bidding process to establish the GMP and the bid leveling process resulted in bids that were consistently higher in all of the trades. The plans are very complete, so the scope of work is well defined. The bid leveling process was reviewed in detail by the City’s construction management team to ensure that all of the work was included in the bids and that the best value bid was selected.

Based on conversations and information provided by the City of Oceanside and the City of San Diego, both of whom are currently proceeding with fire station projects, the construction management team believes the cost of labor and materials have increased significantly in the past two years. The City of San Diego stated they believe the cost has increased 50 percent over the last four years, and their budget for Fire Station No. 48 has increased from $22 million to $32 million in the past year. The City of Oceanside’s anticipated increase in cost is 25 percent.

In response to concerns about the increase in the GMP over prior estimates, Erickson-Hall prepared a list of value engineering items for consideration. A number of these items, that did not change the quality or the program for the project were implemented, and a savings of $257,859 was included in the GMP, as detailed in Exhibit “A” to the Amendment.

After all the analysis and comparison of fire station data from other local cities, the City’s construction management team believes that the GMP proposed by Erickson-Hall is fair and represents the current market. Therefore, staff recommends approval of the GMP included in the proposed contract amendment and proceeding with the project at this time.

FISCAL IMPACT: The cost of this amendment is $14,340,331 for a new contract ceiling of $15,149,181 for Erickson-Hall to provide design-build services for the Design and Construction of the Fire Station No. 3 Replacement Project Phase 2 and Phase 3. City Council approval of the staff recommendation will amend the Capital Project Budget for Fiscal Years 2022/23 and 2023/24 by authorizing the appropriations of $4,919,704 from available fund balance in the Underground Utility Fees, Fire Development Impact Fees, and Prop L Reserve accounts (Nos. 0010000.310526, 1100000.310525, and 0010000.310744).
