John Conley, City Manager Agenda Location: Public Hearing SUBJECT: CITY RENTAL AND PROGRAM FEES
RECOMMENDATION:
1.Open, conduct and close a public hearing to consider fee changes for Recreation and Community Services facility rental and program fees and Regulatory Inspection and Financial Audit Fees for cannabis businesses.
2.Adopt City Council Resolution No. 2024- , approving revisions to the Recreation and Community Services facility rental and program fees.
3.Adopt City Council Resolution No. 2024- , approving annual regulatory inspection and financial audit fees for cannabis businesses in the City of Vista.
CORRELATION TO CITY COUNCIL GOALS: Fiscal Responsibility and Parks and Recreation.
PRIOR ACTIONS: On May 23, 2023, City Council adopted Resolution No. 2023-85 approving revisions to the Recreation and Community Services facility rental and program fees (Vote: 5-0).
A comprehensive list of prior actions is included in Exhibit 3.
On May 21, 2021, adopted City Council Resolution No. 2021-80, approving regulatory inspection and financial audit permit fees for cannabis businesses in the City of Vista (Vote: 5-0).
A comprehensive list of prior actions is included in Exhibit 4.
STATEMENT ON THE SUBJECT: Staff annually review the fees for Recreation and Community Services Department services and programs as these updates enable the City to continue providing the community with valuable services. Based on this review, staff recommend revising fees to Moonlight Amphitheatre ticket prices, which if approved, would become effective on October 1, 2024. Moonlight Amphitheatre ticket prices were not changed last season. Staff recommend a 3.5% average increase in prices to assist with rising costs in providing the associated services, which are also subsidized through the General Fund.
Staff further recommend removing parking fees ($15 for residents, $30 for non-residents) at Brengle Terrace Park for the Fourth of July event effective this year. Staff were not able to implement paid parking last summer due to staffing limitations related to our contracted parking attendants at Moonlight Amphitheatre. Resident AGENDA

feedback highlighted a significant improvement in traffic flow compared to previous years. It is worth noting that most cities do not charge parking fees for their Fourth of July events. There will still be a charge of $5 at the entrance into Moonlight Amphitheatre, which includes live music.
The General Fees Section has been updated for clarity and would become effective on January 1, 2025. The language now reflects that a convenience fee applies to all software-managed systems, including facility booking, program registration, and ticketing, regardless of whether registration is done online or in person.
Additionally, we've removed the specific software vendor name "ActiveNet."
Cannabis Business Fees
Both the passage of Measure Z in 2018, and the City Council’s adoption of regulations permitting certain forms of cannabis testing, manufacturing, distribution, and delivery in 2019, included requirements that cannabis businesses in the City of Vista be subject to annual financial auditing by the City and periodic regulatory inspections. The coordination of these inspections has been consolidated into a Cannabis Management Program (CMP) that is currently coordinated by the City Clerk’s Office, with support from the City Manager’s Office.
The City Council adopted fees for the CMP, based on a fee study conducted by HdL Companies, in June of 2020. After implanting the program, staff reviewed the fees and proposed a reduced fee which the City Council adopted in May 2021. Staff has again reviewed the amount of staff time spent on cannabis management and is proposing reducing the frequency of financial audits now that two audits have been conducted with each business. Staff proposes that a financial audit be conducted every three years on a rotating basis, with the initial schedule determined by a random draw. If a business has significant findings, they will be required to have another audit the following year and will be charged for the cost of the audit.
The new proposed annual fee is $10,000, which is about half the cost of the previous fee. This fee applies to all cannabis businesses in the City.
FISCAL IMPACT: Staff do not anticipate an increase to bottom line budget in Fiscal Year 2024/25 from these changes. Therefore, staff do not request any budget adjustments.
