Discussion
SUBJECT: COMMERCIAL FLIGHTS AT MCC LELLAN-PALOMAR AIRPORT - OPPOSING

RESOLUTION
RECOMMENDATION: Discuss proposed City Council Resolution No. 2024- , opposing the acceptance of any commercial flights in and out of McClellan -Palomar Airport, and provide direction to staff.

PRIOR ACTION: None.

STATEMENT ON THE SUBJECT: Councilmember O'Donnell requested the City Manager place an item on an upcoming agenda to discuss a Resolution opposing commercial flights in and out of McClellan - Palomar Airport. Commercial airline service through American Airlines is scheduled to return to McClellan - Palomar Airport in February 2025. This commercial service will have at least two daily commercial flights in and out of McClellan -Palomar Airport to Phoenix. The Palomar Airport Advisory Committee (PAAC) approved this item on September 19, 2024 (with a vote of 5-4) and it is scheduled to go before the San Diego County Board of Supervisors for final consideration on December 11, 2024.

FISCAL IMPACT: No direct fiscal impact with this recommendation.

EXHIBITS:

1. City Council Resolution No. 2024- , opposing the acceptance of any commercial flights in and out of McClellan -Palomar Airport
ACTION: Discussed opposition to commercial flights in and out of McClellan -Palomar Airport and adopted City Council Resolution No. 2024-174. Vote: 3-1-0 (Franklin Opposed, Melendez Absent) Clerk/Secretary

RESOLUTION NO. 2024-

A RESOLUTION OF THE CITY COUNCIL OF THE CHARTERED CITY OF

VISTA, CALIFORNIA, OPPOSING THE ACCEPTANCE OF ANY

COMMERICAL FLIGHTS IN AND OUT OF MCCLELLAN-PALOMAR AIRPORT The City Council of the City of Vista does resolve as follows:

1. Findings. The City Council hereby finds and declares the following:

A. No commercial flights currently operate out of the McClellan -Palomar Airport.

B. Commercial airline service through American Airlines is scheduled to return to McClellan -Palomar Airport in February 2025. This commercial service will have at least two daily commercial flights in and out of McClellan -Palomar Airport.

C. Commercial flights will depart McClellan -Palomar Airport as early as 6:15 a.m. on a daily basis. This would be a direct violation of the current Voluntary Noise Abatement Plan (VNAP) period. Per VNAP, no jets may depart between the hours of 10 p.m. to 7 a.m.

Moreover, that departing 6:15 a.m. aircraft presumably would need to arrive into McClellan - Palomar Airport the evening prior to departure which would particularly impacting the residents of the City of Vista, as the City of Vista lies directly beneath the landing approach for arriving aircraft landing at McClellan -Palomar Airport.

D. The San Diego County Board of Supervisors' approval of a commercial flight contract with American Airlines would be in direct opposition to the County -owned McClellan Palomar Airport Voluntary Noise Abatement Plan (VNAP).

E. American Airlines would presumably use the Embraer E-175 or similar size jet for service into and out of McClellan -Palomar Airport. The Embraer E-175 holds 76 passengers.

As this jet is substantially larger than the aircraft currently using the airport, four tie -downs at the airport will be removed to make room for the E-175, indicating the need for more space to facilitate the E-175.

F. The Embraer E-175 Design Group Classification is C-III (wingspan between 79 feet and 118 feet) and the runway at McClellan -Palomar Airport is designed for B-II Design Group Classification aircraft (wingspan between 49 feet and 79 feet.) G. The stated takeoff field length needed for the Embraer E-175 at medium take -off weight is 5,656 feet. The McClellan -Palomar Airport runway length is currently 4,897 feet, or 759 too short.

H. While private aircraft have been using this airport with larger planes (C-II I and D- III) at pilot discretion and against FAA recommendations, the County allowing American Airlines to use Embraer E-175 or similar size aircraft overlooks certain safety standards put in place by the Federal Aviation Administration ("FAA") designed to protect the public. At the same time, the County would be also be creating their own safety issue, providing a de facto reason for the County to justify airport runway expansion to meet the FAA criteria of a C-II I airport.

2. Action.

A. The Vista City Council opposes any commercial flights into and out of McClellan - Palomar Airport and implores the San Diego County Board of Supervisors to 1) support City of Vista residents and the City of Vista and surrounding communities by declining to sign any commercial flight contracts; 2) request that the San Diego County Board of Supervisors affirmatively show support of its existing VNAP policy; and 3) have the San Diego County Board of Supervisors affirm its stated goal to reduce GHG emissions to zero by 2035, by retaining the current smaller McClellan -Palomar Airport runway, designed to safely facilitate B-II aircraft, as it is today.

Adoption. PASSED AND ADOPTED at a meeting of the City Council of the City of Vista held on October 22, 2024, by the following vote:

I am writing to request that you please oppose any more airlines from flying out of Carlsbad. I have lived in Shadowridge for 14 years (and love it), but I am sad about the change in flight patterns over the years and they are now flying right over our area!
I so appreciate all that you do to look out for us!

Dear Vista City Council,
Please implore the county to reject the proposal from American Airlines, in its current state, and revise/resubmit to be in compliance with county policies and federal policy.
• They can revise their plan to use a plane that fits the airport to promote safety and a departure time that is in compliance (only 45 minutes later).
• Would you want to board a plane that didn't have a safety rating for your airport? Please ask them to revise their plan to an appropriate aircraft type that is rated for the airport. There is no regulation that allows safety to be compromised. • Airport Sponsor Assurances (agreement between the federal government and the county), Noise Abatement through the FAR Part 150 and Airport Compliance Manual are a requirement. AA's proposal violates all of it. • To impose this kind of interference with Land Use (an exception to the Airport's Land Use Agreement), they would need to purchase avigation easements and compensate property owners. They have not done this. Those easements would devalue homes leading to a lower community tax base for the cities that they are impacting. Everyone would lose. With two international airports within a 45 minute drive of Carlsbad, they have other options that would not impose this level of impact.

Below are the documents and sections pertaining to reasons to push back/the county's responsibility.

It is a bad business plan that asks for exception to safety, regulations and community balance. Please be our checks and balances and escalate this to the county on behalf of the citizens.

Sincerely,
Tanja Freeman

b. Safety and Efficiency Standards. Federal law and policies requiring airport sponsors to provide airport access to all types, kinds, and classes of aeronautical activity, as well as to the general public, include certain exceptions.

Exceptions to the general rule may apply when airport safety or efficiency would be compromised. *Note: Commerce cannot compromise safety.

Chapter 20: Compatible Land Use and Airspace Protection

20.1. Background. Land use planning is an important tool in ensuring that land adjacent to, or in the immediate vicinity of, the airport is consistent with activities and purposes compatible with normal airport operations, including aircraft landing and takeoff. Ensuring compatible land use near federally obligated airports is an important responsibility and an issue of federal interest. In effect since 1964, Grant Assurance 21, Compatible Land Use, implementing Title 49 United States Code (U.S.C.) § 47107 (a) (10), requires, in part, that the sponsor: ... take appropriate action, to the extent reasonable, including the adoption of zoning laws, to restrict the use of land adjacent to or in the immediate vicinity of the airport to activities and purposes compatible with normal airport operations, including landing and takeoff of aircraft. In addition, if the project is for noise compatibility program implementation, it will not cause or permit any change in land use, within its jurisdiction, that will reduce its compatibility, with respect to the airport, of the noise compatibility program measures upon which federal funds have been expended. *Note: Noise abatement is not voluntary. There is a huge difference between the FAR Part 150 and the VNAPs.

The City of Vista was supposed to work with the FAA per PDF page 58 of the airport's Land Use Agreement. "City of Vista... Work with transportation agencies to control noise generated by both existing and future facilities and equipment; Prohibit the establishment of take off) flight or landing." patterns that would disturb the Vista Sphere of Influence (Noise Element, p. 5). https://www.lee-associates.com/elee/sandiego/LecLandTcam/Ponto/McClellan-Palomar ALUCP_20111.pddf State Code

Navigable Airspace and Private Property Rights
Under the Federal Aviation Act, the federal government holds the authority to regulate the use of US airspace. The Federal Aviation Administration sets the rules for navigable airspace, in which all US citizens have a public right of transit. Navigable airspace includes space at or above the minimum altitude for flights, as well as the space needed for aircraft to safely take off and land. Most airspace now falls within this definition, since some new types of aircraft have no minimum flight altitude. The FAA also holds statutory authority to buy navigation easements around airports that allow planes to take off and land.

Property owners are entitled to compensation when the government or a trespasser substantially impairs the use of their property. This includes the airspace above their land. Formerly, courts considered whether a flight remained in navigable airspace as a threshold question in deciding whether substantial impairment had occurred. Modern decisions generally do not consider whether a flight remained within navigable airspace in deciding whether a substantial impairment occurred and whether a property owner is entitled to compensation.

Section 4
"Flight in aircraft over the lands and waters of this State is lawful, unless at such low altitude as to interfere with the then existing use to which the land or water, or the space over the land or water, is put by the owner, or unless so conducted as to be imminently dangerous to persons or property lawfully on the land or waters beneath." Unless you have an avigation easement on your property title, yes you technically own the airspace over your home. httns://voutu.be/EcS1zI31 JR8?feature=shared

When I bought my home in downtown Carlsbad, I bypassed several other homes near San Marcos and Palomar airport road. Because of airplane noise. I absolutely emphatically do not support the expansion of the Carlsbad airport as they will have large planes flying directly over my home. This is not what I signed up for when I bought and the runway is too small and we already know they are planning on leaving at 6:15 in the morning, which is unacceptable.

This will affect many homeowners values and I urge you to defeat this proposition.

Hello council,
Is like to register my support for for commercial aircraft flying out of Palomar airport. I have followed closely, and recently attended a Carlsbad meeting where frustrated residents expressed anger at American.

It is clear (and a board member stated this for the record) that all the anger is not really about commercial service like the American flight. They are all very angry at the private pilots and the instructors who turn too early and who generally have loud prop planes.

Commercial pilots will fly straight in jets that are more quiet then most people planes.

Remember, American, America West, and United all used to service Palomar.

More commercial service is good for North county business and residents.

I'm writing the council to please support the residents of Vista by adopting the resolution to oppose any large commercial air service at Palomar Airport. I commend the Vista City Council to be the first council to oppose the County's proposed contract with American Airlines. Airport traffic over my home from Palomar Airport is already very loud and disruptive and the contract with American Airlines will make it much worse.

To the City Council,
I would like to know why the City should have any say in the City of Carlsbad and the County of San Diego regarding the expansion of McClellan -Palomar Airport. In my opinion this should not be addressed by Council. The Airport was started with the idea to improve travel to North County. * 1957 — County of San Diego picks Carlsbad site to replace Del Mar Airport. * 1958 — Construction begins.
* 1959 — Airport opens March 20, for daytime operations. * 1960 — Terminal building constructed
* 1961 — Airport expanded to a 4700' runway.
* 1962 — Terminal expanded, adding airport administrative offices. * 1973 — FAA control tower placed into operation March 26. * 1977 — Instrument landing system (ILS) and approach lights installed. * 1978 — Airport annexed into the City of Carlsbad.
* 1982- The Airport is named for aviator Gerald McClellan, a North County community leader.

If the City of Carlsbad and the County have decided to accepted commercial aircraft then it's been decided. The people who bought homes near there knew they were buying homes near an airport and need to accept the fact and get on with living.

This being fact, the Council should have no say and not be addressing the issue.

Sincerely,
Franchot & Betty Randolph

Please oppose commercial flights at the McClellan Airport.

The planes are carbon bombs, their fuel pollutes the air, causing health problems, especially for children. They cause obnoxious noise pollution.

Non-commercial flights have the same environmentally
harmful attributes. Actually, these planes are unnecessary polluting toys for the wealthy.

Please resolve that Vista would like to see the airport close and the land be used for socially and environmentally sound projects, such as opening an environmentally focused
business park. Let's invite job -creating, climate -friendly businesses to open in north county.
