John Conley, City Manager Agenda Location: Discussion
SUBJECT: COMMUNITY SAFETY AND DUE PROCESS RESOLUTION
RECOMMENDATION: Discuss City Council Resolution No. 2025- , related to community safety and due process and either approve or deny.
PRIOR ACTION: On September 23, 2025, the City Council discussed community safety and due process and directed staff to prepare a resolution to include items 1 through 4 from the agenda report exhibit (Vote:
3-2, Franklin and Fox opposed).
On February25, 2025, discussed Civil Rights community presentations, and directed staff to follow current facility rental policies and procedures (No Vote).
STATEMENT ON THE SUBJECT: On September 23, 2025, at the request of Councilmember Contreras, the City Council discussed a proposal to address issues related to community safety and due process. The discussion was framed around an exhibit to the agenda report that was provided by Councilmember Contreras, which outlined several items for the City Council’s consideration (Exhibit 2).
At the completion of the discussion, the City Council directed staff to prepare a resolution to include items 1 through 4 from the exhibit, as follows:
1.The city will actively disseminate “Know Your Rights” information and will create a web page on the city’s official website detailing information and critical information links to other “Know Your Rights” information.
2.Prohibit federal law enforcement personnel from immigration enforcement in non-public areas of City- owned or City-controlled properties without a judicial warrant.
3.Future City contracts to include clauses prohibiting contractors from disclosing sensitive, personal, or non-public information to federal immigration enforcement agencies. Unless otherwise required by state and federal law.
4.Sensitive or personal data collected by the City will not be shared with immigration enforcement agencies, directly or indirectly, unless otherwise required by state and federal law.
Staff prepared a resolution addressing these items, which is attached as Exhibit 1. Additional background and information related to each of these items is provided below.

website. Some recent examples of this information have been posted by other local jurisdictions, including the cities of Oceanside and Encinitas.
Access to Non-Public Areas in City Facilities. Access to non-public areas in City facilities is subject to Administrative Policy 13-4 (Exhibit 3). Administrative policies generally address administrative duties under the authority of the City Manager. Policy 13-4 was created shortly after completion of the current Civic Center to address internal security and the issuance of security badges to City employees. As stated in the Policy, any visitors or non-City employees requesting access to City facilities must be escorted by a City employee into areas that are not publicly accessible. Such access is subject to the approval of the Department Director (responsible for such facility) and ultimately the City Manager.
Moreover, CA Gov. Code section 7285.1(a), part of the California Immigrant Worker Protection Act, already prevents the City from providing federal immigration agents from accessing non-public areas of City owned or City controlled property. That state code section states, “Except as otherwise required by federal law, an employer, or a person acting on behalf of the employer, shall not provide voluntary consent to an immigration enforcement agent to enter any nonpublic areas of a place of labor. This section does not apply if the immigration enforcement agent provides a judicial warrant.” This code section applies to both private and public employers. (CA Gov. Code section 7285.1(e).)
To staff’s knowledge, no federal immigration enforcement activities have occurred on City property in areas that are not publicly accessible.
City Contracts and Agreements. The City’s standard agreement template does not currently include clauses specifically prohibiting contractors from disclosing sensitive, personal, or non-public information to federal immigration enforcement agencies.
The City expects all contractors to adhere to state and federal law regarding non-public or private information collected and distributed in relation to City-procured or City-sponsored services. This is because City contract templates already require that all persons entering into a contract with the City agree to follow all applicable federal and state laws. City contract templates already include the following verbiage: “Contractor agrees to comply with Title VII of the Civil Rights Act of 1964, as amended, the California Fair Employment Practices Act, the Americans with Disabilities Act of 1990, any other applicable federal and state laws and regulations hereinafter enacted.”
Should the resolution under consideration be approved by the City Council, the City Attorney would review all future contracts and agreements to incorporate appropriate additional language.
Sensitive or Personal Data Collected by the City. Sensitive and personal information collected by the City is currently protected under the California Constitution. Art. I, section 1 of the California Constitution holds, “ ‘[a]ll people are by nature’ entitled to a right to privacy.” Any breach of this inalienable right could subject the City to liability and damages, as the State has affirmed that all persons have a right to enforce their right of privacy in a court of law.
If anyone were to try to obtain sensitive or personal information pursuant to the Public Records Act, the City already has a practice of invoking Gov. Code section 6254(c) to exempt from disclosure any sensitive or personal information.
Accordingly, the City has already had a long-standing practice of not sharing any sensitive and personal information with any outside agency/entity unless otherwise required by state law, federal law or court order.
The resolution under consideration by the City Council would not change the City’s practices with respect to protecting sensitive and personal information.

U.S. Conference of Catholic Bishops, November 12, 2025 (vote 216 in favor, 5 against, 3 abstain) As pastors , we the bishops of the United States are bound to our people by ties of communion and compassion in Our Lord Jesus Christ. We are disturbed when we see among our people a climate of fear and anxiety around questions of profiling and immigration enforcement. We are saddened by the state of contemporary debate and the vilification of immigrants. We are concerned about the conditions in detention centers and the lack of access to pastoral care. We lament that some immigrants in the United States have arbitrarily lost their legal status. We are troubled by threats against the sanctity of houses of worship and the special nature of hospitals and schools. We are grieved when we meet parents who fear being detained when taking their children to school and when we try to console family members who have already been separated from their loved ones.
Despite obstacles and prejudices , generations of immigrants have made enormous contributions to the well-being of our nation. We as Catholic bishops love our country and pray for its peace and prosperity.
For this very reason , we feel compelled now in this environment to raise our voices in defense of God given human dignity.
Catholic teaching exhorts nations to recognize the fundamental dignity of all persons , including immigrants. We bishops advocate for a meaningful reform of our nation 's immigration laws and procedures. Human dignity and national security are not in conflict. Both are possible if people of good will work together.
We recognize that nations have a responsibility to regulate their borders and establish a just and orderly immigration system for the sake of the common good. Without such processes , immigrants face the risk of trafficking and other forms of exploitation . Safe and legal pathways serve as an antidote to such risks.
The Church's teaching rests on the foundational concern for the human person , as created in the image and likeness of God ( Genesis 1 :27). As pastors , we look to Sacred Scripture and the example of the Lord Himself, where we find the wisdom of God 's compassion. The priority of the Lord, as the Prophets remind us , is for those who are most vulnerable: the widow, the orphan, the poor, and the stranger (Zechariah 7:10). ln the Lord Jesus , we see the One who became poor for our sake (2 Corinthians 8:9), we see the Good Samaritan who lifts us from the dust (Luke 10:30-37), and we see the One who is found in the least of these (Matth ew 25). The Church 's concern for neighbor and our concern here for immigrants is a response to the Lord 's command to love as He has loved us (John 13:34).
To our immigrant brothers and sisters , we stand with you in your suffering , since , when one member suffers, all suffer (cf I Corinthian s 12:26). You are not alone!

Dear Mayor John Franklin and Vista City Council Members, As Pastor of St Thomas More Catholic Church , which has half of its members living in Vista, I write to ask you to carefully consider the Vista Community Safety and Due Process Resolution.
This Resolution will create important mechanisms that protect immigrant communities from detention and deportation and mitigate harm to our communities that occur from immigration enforcement operations within the City of Vista.
Several Vista families have already been torn apart by the increase in immigration enforcement operations. With the upcoming implementation of H .R.1 ., we anticipate an even larger increase in immigration enforcement within Vista. H.R.1 would provide $170 billion to the Department of Homeland Security (OHS) over the next four years , making OHS the largest law enforcement agency in the country and bigger than most militaries in the world . This surge in funding will supercharge the deportation machine and result in even more families ripped apart by detention and deportation in the region. The City of Vista must prepare now for this increase in enforcement activity to do everything within its local power to ensure all community members are safe and provided with supports .
The Community Safety and Due Process Resolution seeks to build trust with immigrant community members and minimize harm to Vista communities from immigration raids and operations. Specifically , the Resolution will implement several ways to protect community members from detention and deportation , such as ensuring Know Your Rights information is readily available and visible in multiple languages across the Vista .
I strongly urge you to carefully consider the Community Safety and Due Process Resolution.
Sincerely ,
S/ Rev Brent Kruger

To All Vista City Council members and Mayor Franklin:
As faith leaders , we are called and mandated to protect the vulnerable from abuse in body, mind and spirit. We are called to justice , which we know is rooted in love and compassion and expressed in public policy and practice . We are called to oppose the false idols of supremacy of one group over another. We are called and commanded to love our neighbor, to welcome the stranger, to heal the sick . This is what it means to do justice , love , kindness , and walk humbly with our God.
We lead the community of Vista from various spiritual traditions and histories . We serve and call on you to serve Vistans who are currently being targeted , defamed, kidnapped and torn from their families simply because of their racial and ethnic appearance . This is the very definition of racism. Our members live in fear, whether they may be the direct targets of ICE or as beloved friends of those targeted. In the recent Vista City Council meeting , the proposal for Due Process and Safety was passed and will be voted on in the upcoming council meeting . This proposal ensures the rule of law will be followed in Vista . This law protects citizens as well as non-citizens from harassment, assault and worse from agents who operate with no regard to the due process requirement of our constitution and city charter. We urge you to follow the current state law and more importantly, the moral law to protect families and to say no to the ongoing unlawful, immoral and inhumane treatment of our community members who are targeted as undocumented Vistans . We believe that this issue transcends politics because it is our responsibility to live up to the values of justice, the values of sister and brotherhood as we are all God's children, the values of human dignity.
Thank you for your service . We hope you will find it in your hearts to leave aside the rhetoric that demonizes our brothers and sisters and vote to implement the Due Process and Safety Policy.

Dear Council Member O'Donnell,
As faith leaders, we are called to protect the vulnerable-from harm in body, mind, and spirit. Our calling is to pursue justice-justice rooted in love and compassion, and expressed through public policy and everyday practice. We are called to reject the false idols of supremacy that elevate one group above another. We are commanded to love our neighbor, welcome the stranger, and bring healing to the sick. This is what it means to do justice, love kindness, and walk humbly with our God.
We represent a diverse community of faith leaders from North County San Diego, each from different spiritual traditions and histories. Together, we serve-and we call upon you to serve--our neighbors who are being targeted, defamed, detained , and tom from their families simply because of their racial or ethnic identity. This is the very definition of racism.
Many in our congregations live in fear-whether as direct targets of immigration enforcement or as family members and friends of those affected. Recently, the North County San Diego City Council introduced the Due Process and Safety Policy , which will soon come to a vote . This proposal reaffirms the rule of law in our community, ensuring that all people--citizens and non citizens alike-are protected from harassment, assault, and other abuses committed without respect for due process as guaranteed by our Constitution and local laws.
We urge you to follow not only the law of the state but the higher moral law-to protect families and to reject the ongoing unlawful , immoral, and inhumane treatment of undocumented members of our community. •
This issue transcends politics. rt is a matter of justice, of shared humanity, and of faithfulness to our deepest values. We are all children of God, bound by the sacred responsibility to uphold human dignity and to act with compassion.
Thank you for your service to our community . We pray that you will set aside rhetoric that divides and dehumanizes , and that you will vote to adopt the Due Process and Safety Policy-a step toward justice, safety , and love for all.
In solidarity and faith,
The Faith L eaders of North County San Diego

To All Vista City Council members and Mayor Franklin:
As faith leaders , we are called and mandated to protect the vulnerable from abuse in body, mind and spirit. We are called to justice, which we know is rooted in love and compassion and expressed in public policy and practice. We are called to oppose the false idols of supremacy of one group over another. We are called and commanded to love our neighbor, to welcome the stranger, to heal the sick.
This is what it means to do justice, love , kindness, and walk humbly with our God.
We lead the community of Vista from variou s spiritual traditions and histories. We serve and call on you to serve Vistans who are currently being targeted , defamed , kidnapped and tom from their families simply because of their racial and ethnic appearance. This law protects citizen s as well as non-citizens from harassment, assault and worse from agents who operate with no regard to the due proces s requirement of our constitution and city charter. We urge you to follow the current state law and more importantly, the moral law to protect families and to say no to the ongoing unlawful , immoral and inhumane treatment of our community members who are targeted as undocumented Vistans. We believe that this issue transcends politics because it is our responsibility to live up to the values of justice, the values of sister and brotherhood as we are all God's children, the values of human dignity.
The Muslim community has long faced seriou s discrimination rooted in both race and faith . More recently , Muslims have been singled out for their advocacy on human rights issues. This scrutiny from federal authorities isn't driven by evidence-it's fueled by a broader climate of hostility toward immigrants and Muslims.
The recent spike in Islamophobia is driven by unfounded fear , not facts . Many in our community are immigrants navigating complex legal systems , often without full English proficiency or a clear understanding of their rights . Newly arrived individual s are especially vulnerable and may struggle to communicate their legal status. They deserve due process-nothing less. Before anyone is detained by ICE or pushed toward deportation, they mu st be given a fair chance to understand their situation, assert their rights , and receive proper legal protection. No community should be punished for who they are or what they stand for.
We hope you will apply the law of the land to all community members to all community members regardless of their race, religion, color of skin or immigration status and vote to implement the Due Process and Safety Policy.
In solidarity,
Abdulllah Tahiri
Board President
