City Councilmembers and staff discussed the following:
• Mayor Franklins stated his opposition to the resolution. He believes that the resolution would limit federal law enforcement from upholding the constitution and due process rights. The measure would not protect from deportation but would only limit law enforcement from entering City facilities. He is concerned that it would hinder potential grant funding opportunities. • Councilmember O’Donnell stated that he is mostly in support of the resolution. He raised concerns about paragraph 2.C. of the resolution prohibiting contractors from disclosing sensitive/personal data. The language may dissuade contractors from contracting with the City, or could potentially open the City to litigation. The language is somewhat redundant with existing State laws.
• Councilmember Contreras stated her support for the resolution. City Attorney Walter Chung confirmed that the City does not provide sensitive data to law enforcement or contractors without a proper warrant.
• City Attorney Walter Chung proffered amending paragraph 2.C. to read “Any protected personal characteristic data of an individual collected by the city will not be shared, directly or indirectly, with any person or entity that contracts with the city unless required by law or court order.” • Councilmember Fox stated his opposition to the resolution. He is supportive of Know Your Rights but believes that the other points are restating already existing policies. He suggested disseminating State law to employees to make sure no laws are being broken. • Deputy Mayor Melendez stated her support for the resolution.

Motion by O’Donnell, Second by Melendez to extend the meeting past 10:30 pm. Carried by consensus.

Motion by Contreras, Second by Fox to extend the meeting time to 11:30 pm. Vote: 5-0

MOTION BY CONTRERAS, SECOND BY MELENDEZ, TO ADOPT CITY
COUNCIL RESOLUTION NO. 2025-191, ENTITLED “A RESOLUTION OF

TO READ “ANY PROTECTED PERSONAL CHARACTERISTIC DATA OF AN

INDIVIDUAL COLLECTED BY THE CITY WILL NOT BE SHARED, DIRECTLY

OR INDIRECTLY, WITH ANY PERSON OR ENTITY THAT CONTRACTS WITH THE CITY UNLESS REQUIRED BY LAW OR COURT ORDER.”
