RIOR ACTION: On June 11, 2024, adopted City Council Resolution No. 2024- 86, adopting a Capital Project Budget for Fiscal Years 2024/25 and 2025/26 (Vote: 5-0).

n April 8, 2025, adopted City Council Resolution No. 2025-54, approving a contract with CXT Incorporated for the purchase of a restroom facility for the Luz Duran Park Community Center Project (CIP No. 8351) (Vote: 5-0).

TATEMENT ON THE SUBJECT: At Luz Duran Park, there is a 1,500-square-foot structure that formerly served as a Sheriff’s Substation and is now being repurposed into a community facility. Attached to this structure is an existing public restroom that has been identified for replacement due to deterioration.
The
project includes all necessary utility connections and site work to install a new prefabricated restroom, provide additional diagonal back -in street parking, add accessible parking spaces, and remove parking adjacent to the existing building. Construction Change Order No. 1 includes converting this portion of the parking lot into a drought-tolerant landscaped area with additional trees.
I
n addition, the project includes the work required to install a decomposed granite sitting area with picnic tables to accommodate a 20' x 20' shade sail structure which will be installed under a separate contract with the shade sail vendor.

ISCAL IMPACT: The construction contract is $342,341, with a 10 percent contingency for a total budget of $376,575.10. Construction Change Order No. 1 is $27,260. The total budget associated with staff recommendations is $403,835.10. Sufficient funding is budgeted and available in the Fiscal Years 2024/25 and 2025/26 Capital Improvement Budgets in CIP No. 8351, Source Appropriation Accounts (No. 0026555.578999.8351 and 1176208.578999.8351).

The City Council of the City of Vista does resolve as follows:
1. Findings. The City Council hereby finds and declares the following:
A. The City solicited bids for the Luz Duran Park Community Room Restroom Project (CIP No. 8351) and on October 30, 2025, public bids for construction were opened and In the Dirt Engineering was the lowest bidder.
B. Staff determined that the bid submitted by In the Dirt Engineering is responsive in all material aspects to the request for bids, and that the bid from In the Dirt Engineering for the construction of the Luz Duran Park Community Room Restroom Project has been determined to be the lowest responsive, responsible bid.
2. Action.
A. The contract between the City of Vista and In the Dirt Engineering for the Luz Duran Park Community Room Restroom Project is approved and the Mayor is authorized to execute the contract.
3. Adoption. PASSED AND ADOPTED at a meeting of the City Council of the City of Vista held on January 13, 2026, by the following vote:

Contractor is hereby directed by the City of Vista to make the following changes to the plans and specifications or do the following described work not included in the plans and specifications.
1.1 Revisions to Sheet 7 of the Improvement Plan Set to include drought tolerant landscaped area, trees, and decomposed granite sitting area with picnic tables resulting in an increase of $27,260.00 and an increase 5 Working Days.
It is agreed that the full and final compensation for this work shall result in a final contract increase in the amount of $27,260.00.
Reference is made to the Contract Documents with specific reference to Section 6-7.1 of the Supplementary General Provisions.
Total increased cost associated with this Change Order is $27,260.00
This change order is not valid until signed by both the owner and the contractor. Signature of the contractor indicates his agreement herewith, for full compensation including mark-ups and extended overhead to the contract sum and adjustments to contract time. By executing this change order, the contractor agrees that no additional compensation or claims for items of work listed in this change order will be allowed. Any attempt to change this form by transmittals or other means shall render this change order void.
