COMMENDATION: Discuss current Joint Use Agreement with Vista Unified School District and receive City Council requests and recommendations for consideration to develop a new Joint Use Agreement.
CO
RRELATION TO CITY COUNCIL GOALS: Fiscal Responsibility and Parks & Recreation.
P
RIOR ACTION: On October 27, 2015 , adopted City Council Resolution 2015- 166, approving a Joint Use Agreement with the Vista Unified School District (Vote: 4-0, Aguilera absent).
S
TATEMENT ON THE SUBJECT: Since 1973, the City and the Vista Unified School District (District) have maintained a collaborative partnership through shared- use arrangements of facilities for recreational, educational, and community-based programs. These agreements have historically provided mutual benefit by expanding community access to public amenities while reducing duplicative capital and operational costs for both agencies.
O
ver time, community needs, programming demands, and operational costs have evolved. Amendments to the current agreement have incrementally addressed specific uses; however, the cumulative changes no longer comprehensively reflect the present -day priorities, fiscal realities, and service expectations of either organization.
The agr
eement and amendments to the Joint Use Agreement (JUA) are attached as Exhibit 1 and include the following:
• O
n August 30, 2016, the agreement entered into a First Amendment to add Luz Duran Park grass and picnic areas for its Summer Seamless Feed Program in the amount of 100 hours. • On May 10, 2017, the agreement entered into a Second Amendment to include the Buena Vista Park Overflow Parking, Buena Vista Park Athletic Fields, Breez Hill Park, and Luz Duran Park for 58 hours in exchange for 3 Peach Jar program postings.
• On May 1, 2018, the agreement entered into a Third Amendment for use of Luz Duran Park in exchange for four Peach Jar program postings.
• On June 23, 2022, revisions were made to the District’s scheduling procedures at Wave Waterpark to modify dates after inconsistencies with the agreement guidelines were identified.

SUBJECT: JOINT USE AGREEMENT WITH VISTA UNIFIED SCHOOL DISTRICT Accordingly, staff recommend a thorough review of the existing JUA and consideration of its termination and replacement with a modernized agreement. The new agreement would:
• Clearly define reciprocal facility use and scheduling protocols; • Establish updated cost-recovery standards, fee structures, and staffing considerations; • Ensure equitable value exchange between facility use and promotional considerations; and • Strengthen accountability, compliance, and administrative clarity.
The pur
pose of this agenda item is to engage the City Council in a policy-level discussion and to solicit specific guidance, priorities, and recommendations to inform negotiations with the District. Council input is essential to shaping a balanced and fiscally responsible framework that advances community access while safeguarding City resources.
A
n illustrative example of successful collaboration is the shared use of facilities such as the VAVPA Community Park, where coordinated access enhances community recreation opportunities while optimizing school-owned assets outside of school hours. A future agreement should continue to prioritize shared, multi- use spaces, including athletic fields, playgrounds, and open space, that serve the public when not in active school use.
Fol
lowing Council discussion and direction, staff will initiate formal engagement with the District to incorporate Council recommendations and return with a proposed draft JUA for Council consideration.
F
ISCAL IMPACT: Since adoption of the current agreement in 2015, joint staffing expenses, operational costs, and facility maintenance expenditures have increased. An updated JUA would incorporate current fee schedules, cost-recovery standards, and administrative policies to ensure fiscal sustainability and equitable resource allocation for both agencies.
A
revised agreement is intended to reinforce long- term fiscal responsibility while maintaining meaningful public access to shared community facilities.

SUBMITTED BY: Donna Caperton, Assistant Superintendent - Business Services ISSUE/ BACKGROUND: The City of Vista notified the District on June 25, 2015 that they are terminating the current joint use agreement for facilities dated May 10, 2005. The effective date of the termination is November 30, 2015.
The City and the District worked out a new agreement for the use of facilities for the period from December 1, 2015 thru June 30, 2017.
The City and the District mutually agree to cooperate in the coordination of programs and activities. The City commits to the following:
Through June 30, 2016, the City will grant use of the City's Morris BVance Community Room for month Board meetings and six community meetings. The District may use the Wave Water Park for District Aquatic Programs through June 30, 2016. Starting in 2016/ 17 school year, the District will pay to the City for the use of the Wave Water Park on an hourly basis.
In exchange the District will grant the City the use of District facilities up to 200 hours. The District will still get to use the Buena Vista Park overflow parking for Rancho Buena Vista High School along with the athletic fields for school activities.
FISCAL IMPACT/ FUNDING SOURCE:
Effective December 1, 2015, the District will be billed at the City' s approved rate schedule ( Group B hourly rate) for the use of various facilities. According to estimates provided by the City based on 2014- 15 usage the District would have paid approximately $ 35,000 for facility usage. Any such scheduling of facilities usage will be paid from department/ site budgets.
For Fiscal Year 2016/ 17 the estimated fee for the use of the Wave Water Park is $ 70, 000 which is approximately 772 hours by District teams.

To: Pat rick Johnson, City Manager
From: Colleen Smith, Operations Manager
Angela Palasik, Waterpark Manager
Subject: Revisions to VUSD Scheduling Process at Wave Waterpark cc: Amanda Lee, Assistant City Manager
Mike Pacheco, Recreation and Community Services Director Thi
s memo is in response to a request from VUSD regarding a proposal that would revise the scheduling process at the Wave Waterpark. The current scheduling process outlined in the joint use agreement in section 4, “Scheduling Facilities” states, “The meetings shall be held in May and December of each year. The purpose of the scheduling meetings shall be to coordinate the uses of the facilities and to avoid conflict between District, City and third-party uses and to protect the real and personal property involved.”
I
n the recent past, VUSD staff has not met the scheduling meeting timeframes. Going forward and making the assumption that the timelines are adhered to, City staff is comfortable moving forward with the following proposed changes to the dates in Superintendent Doyle’s email from June 10, 2022:
• For Fall sports starting on 08/01, requests due on 04/30 • For Winter sports starting on 11/05, requests due on 07/31 • For Spring sports starting on 02/04, requests due 10/31 I
n the meantime, and since the fall request date has passed, Superintendent Doyle requested that VUSD schools be provided a 4 hour and 30-minute daily window of pool time at the Wave for the Fall season. The Wave is currently available in the Fall (Sept. 6 to Nov. 4) Monday to Thursday, from 12:30pm to 6:15pm with additional flexibility on Fridays.
