ECT: AGREEMENT FOR CONCESSION SERVICES AT THE MOONLIGHT AMPHITHEATRE RECOMMENDATION: Adopt City Council Resolution No. 2026- , approving an agreement with DLS Events LLC for concession services at the Moonlight Amphitheatre.

PRIOR ACTION: On March 23, 2021, adopted City Council Resolution No. 2021- 39, adopting the agreement between the chartered City of Vista and Bread and Cheese Catering for catering and concessionaire services at the Moonlight Amphitheatre (Vote:5-0).
On April 9, 2019, adopted City Council Resolution No. 2019 -42, approving the agreement between the Chartered City of Vista and Kitchens for Good for catering and concessionaire services at the Moonlight Amphitheatre (Vote: 5-0).

STATEMENT ON THE SUBJECT: The Moonlight Amphitheatre coordinates five regional productions of Broadway musicals annually and presents a range of additional entertainment, including a free holiday- themed community event, concerts , and specialty performances. Concession services are an important component of the overall guest experience, and s ince construction of the concession facility, four vendors have provided these services.
With the existing concession services agreement terminating April 1, 2026, staff issued a r equest for proposals (RFP) on November 13, 2025, through OpenGov, the city’s electronic bidding platform. A non- mandatory pre-proposal meeting was held on November 20, 2025, at Moonlight Amphitheatre, providing interested firms with the opportunity to tour the facility and ask questions. On December 17, 2025, the city received four proposals.
On March 20, 2026, the City canceled the November 13, 2025, request for proposals pursuant to Section 8 of the RFP, following significant community response. The city subsequently issued a new request for proposals on March 23, 2026. On March 31, 2026, the city received six proposals, listed below in alphabetical order:
