COMMENDATIONS:
1. Rescind City Council Resolution No. 94-38, designating the Shadowridge Development as a real estate development offering golf facilities, designating certain streets for the combined use of g olf carts and ot

2. Adopt City Council Resolution No. 2026- , designating the Shadowridge Development as a real estate dev
elopment offering golf services, designating certain public streets for the combined use of golf carts and ot
her vehicles, prescribing rules and regulations for the operation of golf carts, and establishing golf cart crossing zones.

RRELATION TO CITY COUNCIL GOALS: Traffic: Continue to enhance mobility safety, improve the flow of traffic for all forms of travel, reduce congestion, and improve our roads and sidewalks.
PRIOR ACTION: On May 24, 1994, adopted Ordinance No. 94-13, repealing Ordinances 90-30, 93-04 and 94-09 which provided for combined use of streets by golf carts, prescribed rules and regulations for the use of golf carts on public and private streets, and established certain golf cart crossing zones. (Vote: 4-0, Smith Abstained).

TATEMENT ON THE SUBJECT: City Council Resolution No. 94 -38 (Exhibit 3) was adopted as a comprehensive resolution compiling all past relevant Shadowridge Development golf cart actions into one document. The Resolution designated all streets in the Shadowridge Development, including private streets, for the combined use of vehicles and golf carts based on California Vehicle Code (CVC) §21115. However,
this CVC section is applicable to a “highway”, which is defined as a publicly maintained way pursuant to CVC §360.
Ther
efore, Resolution No 94-38 incorrectly designated private streets for the combined use of vehicles and golf carts and must be rescinded. A new Resolution, 2026- (Exhibit 1) is attached, which includes all relevant AGENDA
