S
TATEMENT ON THE SUBJECT: The City of Vista has a street easement located adjacent to 216 West Los Angeles Drive, in the City of Vista, that was recorded in the office of the County Recorder of San Diego County June 8, 1962, as File/Page No. 98084 and January 3, 1968, as File/Page No. 1087.

The pr
operty owner at 216 W. Los Angeles Drive has agreed to grant a recreational easement to the City of Vista in exchange for vacating a portion of the street easement along their property frontage , behind the existing fence. The portion of recreational easement to be granted is for the proposed Parkette at New Haven CIP 8369. The street easement is excess easement, is not needed for any current or future projects, and the area is being maintained by the property owner. The street easement to be vacated is described in Exhibit “A” and shown on Exhibit “B” of Exhibit 1.

The C
alifornia Streets and Highways Code Section 8331 authorizes the City Council of the City of Vista to approve the summary vacation of a street easement if the easement has been (a) For a period of five consecutive years the street or highway has been impassable for vehicular travel and (b) No public money was expended for maintenance on the street or highway during such period; therefore, staff recommends approval of the summary vacation.

F
