ZONING CODE TEXT AMENDMENT FOR 2079 MT. DIABLO TO ALLOW HOUSING MINISTERIALLY WITH 20% AFFORDABLE UNITS Assistant Director of Community Development Sung H. Kwon provided the staff presentation. He reported that the City Council is asked to consider the introduction of an ordinance to implement a Zoning Code Text Amendment for a specific site (2079 Mt. Diablo Blvd) in the Office Commercial (O-C) zone to allow multi-family development by right with an allowed density of up to 56 dwelling units per acre where at least 20 percent of units are affordable. The current land use regulations allow residential developments subject to a Conditional Use Permit (CUP) and a 90 percent affordability requirement. This site was identified in the City’s adopted housing element and was previously identified in a prior housing element as a potential housing site. This Zoning Code Text Amendment is part of Housing Element implementation and a mandate from the State of California to encourage housing development.
Public comments were received from: Steve Depper. Written public comments were received, provided to the City Council and posted online as part of the meeting record.
City Attorney Steve Mattas stated the City is aware of the potential contamination on the site and when a project is put forward, the issue will be analyzed. He also shared that this item is before the Council as one of the implementation items under the Housing Element and one of the actions that HCD understands the City will undertake and complete before the end of January 2024.
Mayor Haskew closed the public hearing.
Motion by Mayor Pro Tem Darling, second by Silva,

CONSIDERATION AND ACTION ON PROPOSED PURCHASE AND SALE AND JOINT ESCROW INSTRUCTIONS AGREEMENT INCLUDING THE RELATED EXEMPT SURPLUS LAND DETERMINATION, ACCEPTANCE OF IRREVOCABLE OFFER OF DEDICATION AS SET FORTH IN SUBDIVISION MAP NO. 4006, TREE REMOVAL PERMIT APPEALS, IMPROVEMENT AGREEMENT, MAINTENANCE AGREEMENT, AND COVENANT NOT TO OPPOSE ANNEXATION AND ASSOCIATED CEQA COMPLIANCE DETERMINATIONS ALL IN RELATION TO CITY ACTIONS RELATED TO THE COUNTY-APPROVED SPIEKER SENIOR COMMUNITY CARE RETIREMENT COMMUNITY PROJECT Mayor Haskew discussed the public hearing process and opened the public hearing.
The City Council disclosed ex parte contacts:
Councilmember Francois noted he had met with the applicants representative, with the President of HOA and with the Seven Hills School group, and toured the project site with members of Save Seven Hills. Councilmember Wilk reported he had met with applicant and the Seven Hills School, and toured the project site with the Save Seven Hills group. Councilmember Silva stated she had met with the Spieker representatives and local neighbors. Mayor Pro Tem Darling noted she met with the Spieker representatives, toured the Seven Hills School, met with members of the neighborhood and the Save Seven Hills group. Mayor Haskew reported she had met with local neighbors and had conversations with the developer.
Assistant City Manager Teri Killgore provided the staff presentation. She reported that on November 29, 2022, the Contra Costa County Board of Supervisors ("County") conducted a public hearing and approved land use entitlements and agreements for the Spieker Senior Continuing Care Retirement Community Project, also known as "The Glen at Heather Farm" ("Project"). The Project site is located at 850 Seven Hills Ranch Road, situated in the unincorporated area of Contra Costa County adjacent to the City of Walnut Creek ("City"). While the Project itself is entirely in the County, the two possible Project access routes that were considered in the Project Environmental Impact Report ("EIR") flow directly into the streets of the City.
The Project applicant has proposed that the primary access occur through the extension of the current Kinross Drive along the route shown in the Heather Farm subdivision approved by the City in 1970 as Subdivision No. 4006. This would require, in part, the sale of a fifty (50) square foot piece of City-owned real property (hereinafter described as "Lot A") to the Project applicant and owner of the Project site property, previously identified as Spieker Senior Continuing Care Retirement Community and currently "The Glen at Heather Farm Walnut Creek CCRC, LLC" ("Developer") as well as agreement by the City to accept the irrevocable offer of dedication of the roadway easement as set forth in Subdivision No. 4006, as well as other actions including a determination that Lot A qualifies as exempt surplus property, approval of a purchase and sale agreement related to Lot A, affirming the decision of the Zoning Administrator regarding the tree removal permits, approval of an improvement agreement and maintenance agreement and a covenant not to oppose annexation.
In consideration for the sale of Lot A and the potential impacts of the new development on the Walnut Creek community, staff has negotiated a Purchase and Sale Agreement that requires the payment of $500,000 for Lot A as well as other community benefits payments which together have a value of $4.75 million. The community benefits include payments that provide for $2 million in improvements to Heather Farm Park, $1.75 million in transportation improvements that are beyond any required traffic mitigation measures, and a $500,000 payment towards the Lesher Center. The Purchase and Sale Agreement also requires that the Developer enter into an improvement agreement to construct off-site public improvements within the City and maintenance agreement to maintain those improvements. This report sets forth the substantive issues and procedural steps that the City Council should consider and take action upon in relation to actions summarized above.
The City Council asked questions of staff.
The meeting was recessed from 7:42 p.m. to 7:58 p.m.
City Attorney
Mattas provided an update in regards to the earlier discussion about the 1989 General Plan, in referencing the provision that said "Seven Hills Ranch" should not connect to Kinross Drive, he clarified that the language in the 1989 General Plan was to "Seven Hills Ranch Road," not "Seven Hills Ranch." Troy Bourne, speaking on behalf of Spieker Senior Development, the project applicant / Appellant No. 1, discussed the project further, including the appeal of the tree permit.
The City Council asked questions of the applicant.
Rachel Doughty, Greenfire Law, representing the Heather Farm Homeowners Association / Appellant No. 2 and on behalf of Mitchell Tsai, Attorney at Law, discussed their appeal. She noted additional correspondence was presented at the meeting from the Law Offices of Mitchell Tsai.
Public comments were received from: Caroline Love; Richard Skow; Jodi Davenport; Karin Sayegh; Ann H.; Denise Kahm; Diane Crowley Young; Carol Weed; Terryann Sturiale; Carol Curtis; Karen Perkins; Michael Metcalf; Lesley Hunt, Friends of the Creek (provided a letter); Steve Curtis; Taylor Dahlke; Marcia McLean; Jan Warren; Neil Johannessen; Rosemary Nishikawa; Paul Banta; Carl L.; and David Price. Written public comments were received, provided to the City Council and posted online as part of the meeting record.
Ms. Doughty provided the rebuttal for Appellant No. 2.
Mr. Bourne provided the rebuttal for Appellant No. 1.
Mayor Haskew closed the Public Hearing.
City Attorney Mattas noted for the record that a letter was distributed at the meeting from the Law Office of Mitchell Tsai. He also addressed some of the issues raised, including the Subdivision Map Act, "Do Not Disturb" areas, Lot A restrictions, street vacation process, annexation agreement, General Plan consistency and design aspects.
The Council deliberated.
City Attorney Mattas discussed two potential additions to the documents presented to the City Council for consideration based upon their deliberations: (1) the addition of a Condition No. 7 to the Tree Removal Resolution that would read: Prior to removal of any of the ten (10) trees requested to be removed, Developer shall first obtain a Clean Water Act Section 401 certification from the Regional Water Quality Control Board, applicable in part to the Kinross Drive extension; and (2) adding language to the Purchase and Sale Resolution regarding the use of the transportation improvement funds being used within the vicinity of Heather Farm -- The City Council intends to establish a designated account for the use of the transportation improvement funds which, pursuant to a Capital Improvements Project, would be used for transportation improvements in and around the vicinity of Heather Farm.
City Attorney Mattas suggested that if the City Council is going to consider adding a Condition 7 to the Tree Removal Resolution, that the applicant indicate for the record acceptance of the language identified. The applicant noted their agreement for the record.
