6. CONSIDERATION
a.

ADOPTION OF RESOLUTION APPROVING THE GUIDELINES FOR THE DOWNTOWN PERMITTED OUTDOOR DINING STRUCTURES (PODS) INCENTIVE PROGRAM Economic Development Manager Mike Nimon provided the staff presentation. He reported that on December 6, 2022, the City adopted the Outdoor Dining Program following from Rebound, a COVID-19 response that enabled restaurants and bars to serve food in Permitted Outdoor Dining Structures (PODS) located on public right of way. The Outdoor Dining Program has generated the intended enhancement in street activity. However, the PODS which were expected to activate the City-owned right-of-way have not taken off to the level experienced under Rebound. To that end, City Council directed staff to deploy $100,000 to stimulate PODS activity in downtown. The proposed PODS Incentive Program (PODS Incentive Program) Guidelines are designed to meet this Council objective.

Public comments were received from Kathy Hemmenway, Walnut Creek Downtown Association; and Rolla Ghaben.
