DATE: December 12, 2023
SUBJECT: Discussion and Adopt a Resolution repealing the City Council’s approval of the acceptance of the Resource Environmental , Inc. bid for the Wasco Farm Labor Camp Demolition and Cleanup 750 H Street Project; Rejection of all bids submitted on November 14, 2023, and Authorize the City Manager or Designee to reissue a request for proposal for the Wasco Farm Labor Camp Demolition and Cleanup 750 H Street project , and Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3), no environmental review is required.
Background:
On November 14th, 2023, at 2 PM, seven bids were received for the “Wasco Farm Labor Camp Demolition and Cleanup 750 H Street” project and publicly opened and read.
Below are the bids from lowest to the highest:

Discussion:
Following the November 14 bid opening, several inquiries were received by City Staff.
Again, following the December 5, 2023, City Council meeting, staff received additional inquiries and requests to clarify various aspects of the RFP. After consultation with the City Attorney, Staff has concluded that ambiguities may exist in the RFP that may result in

miscommunications about the project. T o ensure that there are no issues and to fully clarify the confusion amongst the bidders, it is in the best interests of the City to reject all bids and reissue the RFP. The City’s right to reject all bids is stated in the Invitation for Proposals section of the original RFP document, on page three.
Recommendation:
Staff recommends the City Council:
1) Adopt a Resolution: Repealing the City Council’s December 5 th, 2023, approval of the acceptance of the Resource Environmental, Inc. bid; Rejecting of all the bids submitted on November 14, 2023; and Authorizing t he City Manager or designee to reissue a Request for Proposal; and
2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3), no environmental review is required.
Environmental Review:
The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.
Fiscal Impact:
The City has allotted funds for this Project under Project No. 21003. In total, The budget shows $9,360,432 coming from the General Fund. The agreement with the High -Speed Rail Authority has authorized us to be reimbursed for up to $9,000,000 related to the abatement and demolition of this site. After the abatement contract is paid out , $2,597,000 (not including the material testing) that would leave $6,763,432 (budgeted) with $6,403,000 (reimbursable) for the demolition & site clearing phase. Approval of this item will incur only minor expenses related to re-advertising the RFP. 4 of 7
