Memorandum : CITY OF WASCO
TO : City Manager, City Council DATE: March 1, 2024 FROM : Thomas F. Schroeter, City Attorney
SUBJECT: League of California Cities City Attorney Spring Conference The L
eague of California Cities A nnual Conference will be held on May 8-10 in Rancho Mirage. The registration fee is $625.00 and a two-night stay in the hotel is $239.00 per night. During the conference, there will be three days of presentations devoted to legal issues facing cities and updates on cases recently decided. This is a critical learning session for city attorneys and reduces the time and effort needed by the City Attorney to research these matters on his or her own.

My other
city, the City of Tehachapi, is being asked to contribute equally to the cost for the registration fee and one night's lodging. The City's share of the expenses would be $551.50. I would request permission to represent the City of Wasco at the Annual League Conference and for the City to pay up to $551.50 for my expenses. .

R
ecommendation:

Staff recommends the City Council:
1) Approval of Travel and Training Expenses Exceeding $500.00 for the Administrative Manager to attend the California Association for Coordinated Transportation (CALACT) Spring 2024 Conference on April 15–18, 2024, in San Diego, CA; and 2) F

A
s a result, the City Council will need to approve the travel request by the Administrative Manager as the expenses for the trip will exceed $500.00.

F
iscal Impact:

The estimated cost of the travel will not exceed $2, 500. This expense is covered in the Adopted FY 23/24 Budget. No budget action is needed with approval of this item.

BJECT: Adopt a Resolution Authorizing the City Manager or Designee to approve a Budget Amendment to the Adopted FY 2023-2024 Operating Budget of $30,000.00 for Existing and Future Building Plan Check Expenses.

Recommendation:

Staff recommends the City Council:
1) Adopt a Resolution Authorizing t he City Manager or Designee to approve a Budget Amendment to the Adopted FY 2023-2024 Operating Budget of $30,000.00 fo
r Existing and Future Building Plan Check Expenses, and 2) F
ind that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c) (3), no environmental review is required.

Environmental Review:

The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

Discussion:

The City initially budgeted $35,140.00 in the FY 23/24 operating budget for the Building Division Professional Services budget . The funds allocated to the professional services account are for any expenses related to outside professional services required by the Building Division for temporary fill-in building inspection in the event of a long- term absence of our Building Inspector.

T
he Professional Services budget is also where all third -party plan check invoices are coded. The City contracts with Interwest Consulting for building plan check services. The

STAFF REPORT
City of Wasco

City’s contract with Interwest establishes a set billing rate of 75% of the plan check fee collected by the City. The City retains the remaining 25% of the plan check fee to cover City administrative costs.

E
ach year the amount budgeted for professional services is our best estimate of what we may receive in plan check expenses and unforeseen absences in the division.

W
e recently received several larger plan checks that have resulted in plan check costs that exceed the amount identified in the professional services line item. All fees to cover the cost of these plan checks plus the 25% City Administration holdback have been collected, and staff does not authorize payment of any Interwest billings until this has been confirmed . However, the professional services budget line item needs to be adjusted to reflect the increase represented by these additional plan checks.

A
s a result, Staff is recommending an increase to this line item of $30,000 in order to cover the current plan check expenses and any future expenses through the end of the FY.

F
iscal Impact:

There is no net impact on the City’s budget. As described above, all Interwest plan check billings are fully recovered plus 25%.

Discussion:

On December 19, 2023, the City of Wasco City Council authorized the City Manager to Endorse and Enter into an Agreement with J.L. Plank , Inc. for the Construction of the Historic Downtown Restoration Project in the amount of $4,190,400.00 and allowed the City Manager to execute Contract Change Orders in an amount not to exceed an aggregate of $100,000.00

STAFF REPORT
City of Wasco

To date, the City has encountered various items that have required change order s, including, but not limited to , providing a Stormwater Pollution Prevention Plan per Caltrans Requirements, concrete crushing of removed concrete materials , which will provide the City with a usable road base , and give us recycling credits, Installation of some additional ADA truncated domes and t he purchase of materials for the replacement of ~ 400 feet of water main. These change orders to date are very near the currently authorized amount of $100,000.00.

A
s the Project sits , currently, we have various items of work identified as future change orders that will need to be addressed and would cause us to surpass the originally approved $100,000.00.

As such, the staff would request approval for the City Manager to execute change orders for an additional $100,000.00. The budget status can be found below in the Fiscal Impact section.

F
iscal Impact:

The 2023/2024 FY budget (Project 22012) allocated a total of $6,656,265.00 for the implementation of Design and Construction for the Downtown Rehabilitation Project. To date, the City has encumbered approximately $ 1,242,062.59 in costs for design , advertisement, art, equipment procurement , etc. The approved construction contract came in at $4,190,400.00, which, when added to the originally approved $100,000 in change orders, leaves approximately $1,123,802.41 remaining for the Project.

Recommendation (FY 2016-FY 2018) Implementation Status
Use the TDA definition in calculating FTE for reporting to the State Controller.

All City employees providing services to transit
operations track their time via timesheets and submit
them to the Finance Department. The Finance
Department then calculates full- time equivalent
(FTE)
according to the TDA definition.

Identify strategies to bring the farebox recovery ratio above 10 percent.

In FY 2018/19, the audited farebox recovery ratio was

9.76 percent. While this rounds to 10 percent, it was
considered out of compliance by the TDA fiscal
auditor for that year, and continues to warrant
improvement in order to ensure future compliance
once the waivers from penalties under AB 149 expire
after FY 2022/23.

Increase or revise staffing to ensure full coverage. The City currently has two full-time drivers. Due to the decrease in demand following the COVID-19
pandemic, service can typically be managed by a
single driver in situations when the second driver is
unavailable. The City still maintains an opening for a
part-time driver, though it is not currently advertising for the position at this time due to a lack of interest and an unsuccessful hire. As ridership recovers and
demand increases, it may be necessary to restart
more aggressive hiring for this position.

Update the City's 2008 Dial-A-Ride Service Policy and
Procedures manual.

An update to the manual is pending, with completion
anticipated for FY 2023/24.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO DECLARING THERE ARE NO

UNMET TRANSIT NEEDS THAT CAN REASONABLY BE MET WITHIN THE CITY OF WASCO WHEREAS, the City Council of the City of Wasco, on March 16, 2021, conducted a public hearing for the purpose of receiving oral and written testimony regarding unmet transit needs for the incorporated area of the City of Wasco; and WHEREAS, pursuant to Public Utilities Code 99401.5, Kern Council of Governments (Kern COG) is required to establish and define the terms "unmet transit needs." Kern COG Resolution 90-04 defines "unmet transit needs" as follows: "An unmet transit need exists if an individual of any age or physical condition is unable to transport himself or herself due to deficiencies in the existing transportation system. Excluded are 1) Those requests for minor operational improvements, and 2) Those improvements funded and scheduled for implementation in the following year. The term "reasonable to meet" is defined: A) Operational Feasibility: The requested improvement must be safe to operate, and there must be adequate roadways for transit vehicles; B) Duplication of Service: The proposed service shall not duplicate other transit services; C) Timing: The proposed service shall be in response to an existing rather than a future need; and D) Service must meet the legally required farebox ratio (PUC Sections 99268.2, 99268.5 and CAC Sections 6633.2, 6633.5) with fares close to fares of similar service."; and,
WHEREAS, a public hearing was duly advertised and held on March 16, 2021, to receive public comments regarding unmet transit needs that are reasonable to meet; and, WHEREAS, the City of Wasco is required to submit findings from the annual unmet transit needs public hearing to Kern COG by the end of April 2021.

NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Wasco as follows:

SECTION 1: That it does hereby find that within the City of Wasco, there are no unmet transit needs that can be reasonably met through modification or expansion of the Wasco transportation system.

SECTION 2: The City claims its share of Transportation Development Act Funds for FY 2021-2022.

SECTION 3: The Finance Director is directed to submit this finding and the supporting documentation to Kern COG.

BJECT: Conduct a public hearing to receive oral comments concerning unmet transit needs, consider comments, if any, and adopt the Resolution Establishing Unmet Transit Needs Finding for Fiscal Year 2024-2025.

RECOMMENDATION:

Staff recommends that the City Council;
1) Conduct a public hearing to receive oral comments concerning unmet transit needs, consider comments, if any, and adopt the Resolution Establishing Unmet Transit Needs Finding for Fiscal Year 2024-2025, and
2) F
ind that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3), no environmental review is required.

E
nvironmental Review:

The staff has reviewed the proposed activity for compliance wi th the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity wh ich does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

B
ACKGROUND:

The Transportation Developmen t Act of 1971 (TDA), as amended, provides for the disbursement of funds from the Local Transportation Fund for various eligible transportation uses. The funds are distributed by the Kern Council of Governments (Kern COG) in its capacity as the Regional Transportation Planning Agency. An eligible claimant wishing to receive TDA funding through Kern COG must conduct an annual review of the transit needs of the individuals and groups in the community.

STAFF REPORT
City of Wasco

DISCUSSION:

Kern Council of Governments is required to define “unmet needs” and “reasonable to meet”, and has defined them as follows:

U
nmet Need:

A
n unmet transit need exists if an individual of any age or physical condition is unable to transport himself or herself due to deficiencies in the existing tran sportation system.

Excluded are 1) Those requests for minor operational improvements and 2) Those improvements funded and scheduled for implementation in the following year.

Rea
sonable to Meet:

A. Operational Feasibility: The requested improvement must be safe to operate, and there must be adequate roadways for transit vehicles.

B. Duplication of Service: The proposed service shall not duplicate other transit services.

C. Timing: The proposed service shall be in response to an existing rather than a future need
D. Service must meet the legally required farebox ratio (Public Utilities Code Sections 99268.2, 99268.5 and (California Code of Regulation Sections 6633.2, 6633.5) with fares close to fares of similar service.” The legal farebox ratio is 10%.

T
he hearing was duly noticed on January 26, 2023. It would be appropriate to open the Public Hearing and receive written and oral comments regarding any “unmet transit need” and determine whether these “needs are reasonable to meet.” The documentation of the Public Hearing will be forwarded to Kern COG.

The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA). It has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guide lines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

D
iscussion:

With the direction of the City Council, the staff sent a recruitment notice to the Wasco Tribune to recruit for two vacancies to serve on the Wasco Sales Tax Oversight Committee.

The city did not receive sufficient applicants for the interview process in 2023, and the submittal of the application was extended until the position was filled. Applications were received from John P. Pallares and Rosalio Armendariz . Both candidates were found to be qualified.
