TO: Honorable Mayor and Council Members

FROM: M. Scott Hurlbert, City Manager
Maria O. Martinez, City Clerk

DATE: March 19, 2024

SUBJECT: Approval of Travel and Training Expenses Exceeding $500.00 per trip for two Administrative Assistants to attend the Laserfiche Empower Conference on April 22-25, 2024, in Las Vegas, NV.

Recommendation:

Staff recommends the City Council:
1) Approval of Travel and Training Expenses Exceeding $500.00 per trip for two Administrative Assistants to attend the Laserfiche Empower Conference on April 22-25, 2024, in Las Vegas, NV; and

2) Find that this action is not a project as defined under the California Environmental Quality Act State CEQA Guidelines; therefore, pursuant to State Guidelines Section 15738, no environmental review is required under CEQA.

Environmental Review:

The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA). It has been determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity that does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

Discussion:

This request is for approval of staff to attend the Laserfiche Empower 2024 Conference on April 22-25, 2024, in Las Vegas, CA.

Laserfiche is the document management software platform used by the City to securely store and ma nage documents from every department. Council earlier approved a licensing upgrade for this product that will greatly expand features and staff access to these new capabilities.

STAFF REPORT
City of Wasco

17 of 123
The training will update and provide hands-on training for the Community Development Department Administrative Assistant Yolanda Tinajero and the Public Works Department Administrative Assistant Cinthia Ugalde on the Laserfiche Records Management software for city records. The conference offers classes, hands -on lab sessions, and technical training sessions to expand the staff’s knowledge of records management and administration features and to gain insights into the latest Laserfiche product innovations, best practices, and helpful techniques of the software.

The cost of the conference, hotel fees, and food per diems will exceed the Expense and Use of Public Resources Policy limits established by City of Wasco Resolution No. 2006 - 2327, limiting expenses to $500.00 per trip. TO: Honorable Mayor and Council Members

FROM: M. Scott Hurlbert, City Manager
Maria Lara, Assistant City Manager
Maria Martinez, City Clerk/Administrative Manager

DATE: March 19, 2024

SUBJECT: Adopt a Resolution Authorizing the City Manager or Designee to Execute the FY 2023/2024 Certifications and Assurances and Authorized Agent Forms for the Low Carbon Transit Operations Program (LCTOP) for the following Project: New Transit Operating and Maintenance Facility, $71,171.00

Recommendation:

Staff recommends the City Council:
1) Adopt a Resolution Authorizing the City Manager or Designee to Execute the FY 2023/2024 Certifications and Assurances and Authorized Agent Forms for the Low Carbon Transit Operations Program (LCTOP) for the following Project: New Transit Operating and Maintenance Facility, $71,171.00; and

2) Find that this action is not a project as defined under the California Environmental Quality Act State CEQA Guidelines; therefore, pursuant to State Guidelines Section 15738, no environmental review is required under CEQA.

Environmental Review:

This action is not a project within the meaning of CEQA Guidelines Section 15378 and is, therefore, not subject to CEQA since it does not have the potential to result in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. The approval of this agenda item does not commit the City to a definite course of action concerning a project since the action authorized herein may lead to the negotiation of a grant agreement. This proposed activity is, therefore, not subject to CEQA. Any future action connected to this approval that constitutes a project will be reviewed for compliance with CEQA.

Background:

The Low Carbon Transit Operations Program (LCTOP) was created to provide operating and capital assistance for transit agencies to reduce Greenhouse Gas (GHG) emissions and improve mobility, with a priority on serving disadvantaged communities (DACs). Per

STAFF REPORT
City of Wasco

34 of 123
Public Resource Code 75230 (f) (1- 3), monies for the program shall be expended to provide transit operating or capital assistance that meets any of the following:

1. Expenditures that directly enhance or expand transit service by supporting new or expanded bus or rail services, new or expanded water -borne transit, or expanded intermodal transit facilities, and may include equipment acquisition, fueling, and maintenance, and other costs to operate those services or facilities.

2. Operational expenditures that increase transit mode share.

3. Expenditures related to the purchase of zero-emission buses, including electric buses, and the installation of the necessary equipment and infrastructure to operate and support these zero-emission buses.

Caltrans, in coordination with the California Air Resources Board (CARB), will review each project to determine if the project supports at least one of the above -listed criteria, decreases GHG emissions, and benefits low -income households, low -income communities, and/or a DAC (also known as Priority Populations).

The City of Wasco is working on a New Transit Operating and Maintenance Facility Project. The project aims to support the Dial -a-Ride Transit Department by providing the necessary fueling infrastructure for electric, CNG, and gasoline buses. The facility will be situated on the southeast corner of Filburn Street and Central Avenue.

This resolution authorizes the submission of the application for LCTOP funds and the City Manager's execution of the Certifications and Assurances and Authorized Agent forms.

Fiscal Impact:

The City of Wasco will have four fiscal years from the project award date to expend funds.

For rollover funds, the four years begin with the last rollover year in which funds are accrued.

Lead Agencies cannot expend LCTOP funds on costs incurred before LCTOP award/approval. LCTOP is not a reimbursement program; funds are awarded annually upfront for expenses approved and outlined in the Allocation Request to be incurred after the project is awarded.

The City of Wasco must track interest earned on LCTOP funds. Project Activity Repo rts (PAR) must include interest earned for each project. Interest on LCTOP funds must be used similarly as the principal. Interest remaining after a project has been completed can only be applied to an approved LCTOP project.

DATE: March 19, 2024

SUBJECT: Approval of Acceptance of Old Farm Labor Camp Abatement Project and Authorization of the City Clerk to file the Notice of Completion

Recommendation:

Staff recommends the City Council:
1) Review and accept the Notice of Completion and acceptance and authorize the City Clerk to file the Notice of Completion; and,

2) Find that this Project is classified as categorically exempt pursuant to CEQA Section 21080 (b)(4); 15269(b)(c).

Environmental Review:

Staff has reviewed the proposed Project for compliance with the California Environmental Quality Act (CEQA) and has determined that the Project is categorically exempt pursuant to CEQA Section 21080 (b)(4); 15269(b)(c), as it is characterized as emergency project due to the nature of the project site. Thus, no environmental review is required.

Discussion:

The abatement of asbestos, lead paint and PCB’s at the old Labor Camp location on H Street was approved by Council on October 17, 2023 to be awarded to CVE Contracting Group, Inc. in the amount of $2,597,000. This abatement phase was the first step in the process of getting the site completely cleared since abatement needed to take place prior to demolition.

CVE Started their work on October 30, 2023 with their last day being January 17 th, 2024.

In all, they completed the project within their originally allotted time. Upon completion, Staff contacted the Valley Air Pollution Control District and received their approval of project completion.

As such, Staff recommends filing of a notice of completion for the Project.

Environmental Review:

Staff has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA). The Developer has submitted Parcel Map No. 12481 for the City Council’s Approval. This parcel map includes improvements within the City right of way on the East side of Poplar Avenue just north of Highway 46, including, but not limited to, sidewalks, curbs and gutters, street lighting, drainage, and minor landscaping. DATE: March 19, 2024

SUBJECT: Adopt a Resolution Authorizing the City Manager or Designee to Approve the Purchase of a Rebuild Kit for Raw Sewage Pumps from Xylem Water Solutions USA, Inc. for up to $20,000.00.

Recommendation:

Staff recommends the City Council:
1) Adopt a Resolution Authorizing the City Manager to approve the purchase of a rebuild kit for Raw Sewage Pumps from Xylem Water Solutions USA, Inc. for up to $20,000.00; and

2) Find that this action is not a project as defined under the California Environmental Quality Act State CEQA Guidelines; therefore, pursuant to State Guidelines Section 15738, no environmental review is required under CEQA.

Environmental Review:

Staff has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA).

Discussion:

The influent pump station has a critical role in any wastewater treatment facility. It is responsible for collecting all the water that enters the facility and pumping it out of the raw sewage well for treatment. Due to the harsh and corrosive environment that the submersible pumps are exposed to, the pump station experiences regular wear and tear.

It is an essential part of the process and requires proper maintenance to ensure its smooth functioning.

STAFF REPORT
City of Wasco

49 of 123
It is important to keep spare parts in stock to ensure the treatment process runs smoothly and without disruption. This will allow quick repair or replac ement of any faulty pumps and minimize system downtime. By taking these measures, we maintain compliance and ensure that the treatment process operates efficiently.

Staff received a $16,826.00 spare parts estimate from Xylem Water Solutions USA, Inc., an authorized distributor of Flygt pump parts. The $20,000.00 request includes a contingency for parts, taxes, and freight charges that are subject to change.

Attachments include the quotation or the parts order and a sole source letter identifying Xylem as the authorized Flygt parts distributor in the region.

Fiscal Impact:

The procurement of these parts will be covered under the adopted Wastewater Equipment Repair #30400-50530 budget. No budget action is required with approval of this item.

FROM: M. Scott Hurlbert, City Manager
Maria O. Martinez, City Clerk

DATE: March 19, 2024

SUBJECT: Approval for Travel Expenses Exceeding $500.00 per trip for the Water Supervisor and Water Operator to attend the 20 24 California Rural Water Association Expo on April 22 – 25, 2024, in South Lake Tahoe, CA.

Recommendation:

Staff recommends the City Council:
1) Approval for Travel and Training Expenses Exceeding $500.00 per trip for the Water Supervisor and Water Operator to attend the 20 24 California Rural Water Association Expo on April 22 – 25, 2024, in South Lake Tahoe, CA.; and

2) Find that this action is not a project as defined under the California Environmental Quality Act State CEQA Guidelines; therefore, pursuant to State Guidelines Section 15738, no environmental review is required under CEQA.

Environmental Review:

Staff has reviewed the proposed activity for compli ance with the California Environmental Quality Act (CEQA).

Discussion:

This is a request for staff approval for the attendance of Water Supervisor Cesar Montes and Water Operator Raul Gutierrez at the 2024 California Rural Water Association, which will be held from April 22 to April 25, 2024, in South Lake Tahoe. The purpose of this educational expo is to enhance the skills of water system operators. During this 3 -day seminar, attendees will receive updates on critical aspects of operating and maintaining a water system, including treatment technologies, regulatory compliance, generator operations, and leak detection.

STAFF REPORT
City of Wasco

57 of 123
The cost of attending the conference, which includes hotel fees and per diems for food, will surpass the expense limit of $500.00 per trip as set by the Expense and Use of Public Resources Policy of the City of Wasco. Ther efore, the travel request must be approved by the City Council because the expenses for this trip will exceed the limit of $500.00. It is anticipated that the total cost for the two attendees will not exceed $2500.00.

Fiscal Impact:

The cost of the trai ning will be covered using account #31400- 50230 from the water enterprise budget. No budget action is required with approval of this item.

Alberto Martinez, Deputy Public Works Director

DATE: March 19, 2024

SUBJECT: Authorize the Mayor to S ign a Letter in Support of the E fforts Made by Shafter-Wasco Irrigation District toward Groundwater Sustainability.

Recommendation:

Staff recommends the City Council:
1) Authorize the Mayor to sign a letter in support of the efforts made by Shafter - Wasco Irrigation District toward groundwater sustainability; and

It has been determined that the activity is not a “Project” as defined under Section 15378 o f the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity that does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

Discussion:

This is a request for the Mayor's endorsement of a letter supporting the Shafter Wasco Irrigation District's groundwater sustainability efforts, specifically the Dress er and Poplar Recharge Projects. The project s aim to improve the Shafter -Wasco Irrigation District's groundwater recharge capabilities, which will help ensure a more reliable water supply and build drought resiliency in the region. By increasing the ground water levels in the shared aquifer, we can preserve our city's only source of drinking water.

As a disadvantaged community, the City of Wasco faces challenges in maintaining a consistent water supply due to its limited recharge capabilities. The District' s efforts to bring in water and recharge it benefits our community enormously by improving the

water supply and ensuring that groundwater levels are maintained. This is essential for keeping water affordable for our community, as lower water levels can lead to higher system costs, such as increased energy costs associated with pumping water from lower levels. Efforts by the District to provide a reliable and sustainable water supply have a lasting impact on the prosperity and well-being of our community.

Subject: Letter of Support for Dresser and Poplar Recharge Project

Dear Mr. Valadao,

I am writing to express the City of Wasco's support for the Dresser and Poplar Recharge Projects.

These projects aim to enhance the Shafter -Wasco Irrigation District's groundwater recharge capabilities, which will improve water supply reliability and build drought resiliency in the region.

This effort will increase groundwater levels in the shared aquifer, which is the city's only source of drinking water.

As a disadvantaged community, the City of Wasco does not have its own recharge capabilities.

Therefore, any water brought in and recharged by the District significantly benefits our community by providing supply reliability and maintaining groundwater levels. This is crucial for system affordability, as lower water levels can result in higher system costs, such as increased pumping costs due to the additional energy required to pump water from lower levels.

We highly appreciate SWID's unwavering efforts and dedication to ensuring groundwater sustainability for all beneficiaries. We are eagerly looking forward to the implementation of the Dresser and Poplar Recharge Projects. If the funding agency wishes to discuss our interest and support for this project, we would be more than happy to do so.

Thank you for considering our support in securing grant funding to implement these projects.

Sincerely,

XXXXXXXXXXXXXX
Mayor, City of Wasco

SUBJECT: Adopt a Resolution Authorizing the City Manager or Designee to Accept current Donations totaling $3,350 from local vendors, donors, and Wonderful Company Grants, and future donations for the Wasco Police Department and appropriating the funds

Recommendation:

Staff recommends that the City Council:
1) Adopt a Resolution Authorizing the City Manager or Designee to accept current Donations totaling $3,350 from local vendors, donors, and Wonderful Grants, and future donations for the Wasco Police Department and appropriating the funds ; and

It has been determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

Discussion:

From time to time , companies and residents generously donate to city operations, and as such, staff will provide a report of donors and request authorization to accept the funds and i ncrease appropriations. In quarter two (July – Dec), the City received donations for the Wasco Police Department and Animal Control Department. In quarter three, the city received two unknown donations highlighted in the breakdown below.

STAFF REPORT
City of Wasco

11/06/2023 Maria Elena Bueno Wonderful Citrus - AC $1,000.00 TOTAL $3,350.00

Staff recommends accepting these funds to use for the new Wasco Police Department and Animal Shelter projects. Staff will provide a quarterly update of future donations as they occur.

Fiscal Impact:

Increased appropriations and revenue accounts of $2,350.00 to the Wasco PD account and $1,000.00 Wasco Animal Control account. No fiscal impact on the funding balance by this action.
