STAFF REPORT
CITY OF WASCO
TO: Honorable Mayor and Council Members
FROM: M. Scott Hurlbert, City Manager
Maria O. Martinez, City Clerk
DATE: May 21, 2024
SUBJECT: Adopt a Resolution of the City Council of the City of Wasco, California, calling and giving notice of holding a General Municipal Election for the Office of City Council Members for Districts 2, 4, and 5 for the full term of four (4)years and requesting the Board of Supervisors of the County of Kern to con solidate with the Statewide General Election to be held on Tuesday, November 5, 2024.
_____________________________________________________________________________________ Recommendation:
Staff recommends the City Council:
1. Adopt a Resolution of the City Council of the City of Wasco, California, calling and giving notice of holding a General Municipal Election for the Office of City Council Members for Districts 2, 4, and 5 for the full term of four (4)years and requesting the Board of Supervisors of the County of Kern to consolidate with the Statewide General Election to be held on Tuesday, November 5, 2024; and
2. Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.
Environmental Review:
The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA). It has been determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because it consists of a governmental fiscal/administrative activity that does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

Pursuant to the requirements of the Laws of the State of California regarding General Law Cities, there is called and ordered to be held in the City of Wasco, California, on Tuesday, November 5 , 2024, a General Municipal Election for the purpose of electing Council Members for Districts 2, 4, and 5 for the full term of four(4)years 16 of 36
The City Clerk must officially set the election date and request the Boa rd of Supervisors issue instructions to the Kern County Election Department regarding consolidation with the Statewide General Election and authorize certain procedures for conducting the said election.
The Notice of Election must be published no earlier than July 1st and no later than July 15 th before the municipal election. Section 5311) and the Execution of a Standard Agreement with the California Department of Transportation, Division of Rail and Mass Transportation.
__________________________________________________________________________________ Recommendation:
Staff Recommends The City Council:
1) Adopt a Resolution authorizing th e City Manager or designee to submit an application for federal funding under FTA Section 5311 (49 U.S.C. Section 5311) and the execution of a standard agreement with the California Department of Transportation, Division of Rail and Mass Transportation; and
2) Find the subject activity is not a project within the meaning of CEQA Guidelines Section 15378 and is, therefore, not subject to review under CEQA.
Environmental Review:
This action is not a project within the meaning of CEQA Guidelines Section 15378 and is, therefore, not subject to CE QA since it does not have the potential to result in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. The approval of this agenda item does not commit the City to a definite course of action concerning a project since the action authorized herein may lead to the negotiation of a grant agreement. This proposed activity is, therefore, not subject to CEQA. Any future action connected to this approval that constitutes a project will be reviewed for compliance with CEQA.
Background:
FTA Section 5311 provides supplemental funding for public transit in non- urbanized areas with fewer than 50,000 residents. Funds are apportioned based on the population size and will be used to fund Transit Operations such as labor, supplies, fuel, etc.
For the Fiscal Year 2024 -2025, the City of Wasco has received $161,622.00 in funds. To comply with FTA 5311 requirements, the funding must be split between a 44.67% local share and a 55.33% federal share. The City of Wasco plans to use 5311 for Transit Operating 20 of 36
Assistance. The estimated local share of $586,760.00 will be met using TDA, LCTOP, and STAF funds. The Net Operating Transit Cost is estimated at $748,382.00 for the FY 2024-25.
This resolution authorizes the receipt of federal funds and execution of a standard agreement for Fiscal Year 2024-2025. The FTA 5311 applications are due back to Caltrans via the BlackCat program no later than May 30, 2024, at 2 p.m.
Fiscal Impact:
FTA Section 5311 apportionment will fund Transit Operations for Fiscal Year 2024-2025, and the local share requirement will be covered by the Transportation Development Act (TDA), Low Carbon Transit Operations Program (LCTOP), and State Transit Assistance (STAF) funds.

Recommendation:
Staff recommends the City Council:
1) Adopt a Resolution Authoriz ing the City Manager or designee to Award and Finalize a Five (5) year agreement for payment acceptance device hardware and Transit Processor Services with Kuba, Inc. and LittlePay, Inc. through State of California Leveraged Procurement Agreements; and
2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.
Environmental Review:
The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.
Background:
On July 2022, the City of Wasco was awarded a California State Transportation Agency (CalSTA) Transit and Intercity Rail Capital Program (TIRCP) grant in the amount of one million dollars ($1, 000,000), to purchase three (3) medium electric shuttle buses and implement a contactless payment system that aligns with California Integrated Travel Project efforts.
STAFF REPORT
City of Wasco
25 of 36
Discussion:
The staff has collaborated with the California Integrated Travel Project (Cal -ITP) to implement contactless payment services. In June 2021, the State Department of General Services (DGS) issued Requests for Proposals for hardware payment acceptance devices (Category A) and transit processor services for fare calculation (Category B). The solicitations closed in September 2021. After completion of the evaluation, DGS proceeded to award Master Agreements to three contractors (INIT, Kuba, and SC Soft) for Category A and four contractors (INIT, Bytemark, Enghouse, and Littlepay) for Category B and Elevon for an Epay Vendor.
The Master Agreements provided by the State of CA through the Cal-ITP program to offer transit agencies a solid framework by which procurements are streamlined and transit agencies can be confident in the products and services they select.
The implementation of the contactless payment project requires three (3) separate agreements
1. Category A- hardware payment devices
2. Category B- Transit processor services for fare calculation
3. EPAY Vendor- Fare validator that transmits money from the rider’s bank card to the city’s bank account.
Staff solicited proposals from all available state contractors for the hardware and processing services. Staff received bids from Kuba Inc. and SC Soft for payment acceptance devices and a bid from Little Pay Inc. for the transit processor. The amounts below
Kuba ( Category A) SC Soft (Category A)
Littlepay $ 24, 918.35 $ 25,407.61
After evaluating bids, staff recommends Kuba, Inc. as the preferred vendor for Category A (Payment Acceptance Device) and Little Pay, Inc. for Category B (Transit Processor). Elavon is an acquirer and part of this technology stack. These systems will be installed in our new Zero Emission Electric transit buses.
Fiscal Impact:
The California State Transportation Agency (CalSTA) Transit and Intercity Rail Capital Program (TIRCP) grant will cover the implementation, software, and hardware.
