DATE: June 4, 2024

SUBJECT: Adopt a Resolution A uthorizing the City Manager or Designee to Execute Contract Change orders with J.L. Plank, Inc. in an amount not to exceed $300,000.00 in addition to the originally approved $200,000.00 as part of the Downtown Renovation Project
_____________________________________________________________________________________ Recommendation:

Staff recommends the City Council:
1) Adopt a Resolution authorizing the City Manager to execute contract change orders with J.L. Plank, Inc. in an amount not to exceed $300,000.00 in addition to the originally approved $200,000.00 as part of the Downtown Renovation Project; and

2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.

Environmental Review:

Staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

Discussion:

On December 19, 2023, the City of Wasco City Council authorized the City Manager or designee to Endorse and Enter into an Agreement with J.L. Plank, Inc. for the Construction of the Historic Downtown Restoration Project in the amount of $4,190,400.00 and allowed the City Manager to execute Contract Change Orders in an amount not to exceed an aggregate of $100,000.00

STAFF REPORT
City of Wasco

7 of 34
On March 5, 2024, the Council authorized the City Manager or designee to approve an additional $100,000.00 (in addition to the originally approved $100,000.00) worth of Change Orders.

To date, as expected, the City has made various changes to the design, including, but not limited to, the addition of colored concrete, changes to the block wall configuration at the park, the addition of temporary lighting, replacement of unsuitable soils and most notably the replacement of ~ 440 feet of water main and 11 valves along that water main.

The water main replacement alone ended up costing $228,721.74 to replace. In addition to this cost, we are nearing approximately $140,000.00 on the other change order items mentioned above, leaving us nearly $370,000.00 in total change order costs.

Not included in the breakdown above are various items for which the City will need to provide change orders, including, but not limited to, a basement discovered under the sidewalk of 7th Street, which needs to be filled in, the purchase of a digital screen for the new park location, the purchase of flagpoles for the new park location, the purchase of some misc. amenities, and likely more.

As such, Staff requests approval for the City Manager or designee to execute change orders for $300,000.00 in addition to the previously approved $200,000.00.

With a change order allowance of $500,000.00 on a $4,000,000.00 Project, the current ask would be ~12.5% of the original contract amount , which is still less than the industry standard of 15-20% for a Project of this magnitude.

Fiscal Impact:

The 2023/2024 FY budget (Project 22012) allocated a total of $6,656,265.00 for the implementation of Design and Construction for the Downtown Rehabilitation Project. To date, the City has encumbered approximately $1,342,062.59 in costs for design , advertisement, art, equipment procurement etc. The approved construction contract came in at $4,190,400.00, which when added to the requested $500,000 in change orders leaves approximately $623,802.41 remaining for the Project.

Discussion:

SB 1 (Beall) was filed with the Secretary of State on April 28, 2017, and is now going to be entering into its Fifth year. This bill established a Road Maintenance and Rehabilitation Account (RMRA) in the State Transportation Fund that is intended to address deferred maintenance on the state highway system and the local street and road systems. T he bill also requires the California Transportation Commission (CTC) to adopt criteria to ensure efficient use of these funds.

After reviewing the city's current Pavement Condition Index (PCI) map along with the current outlook for Street Projects funded by other sources and the budget outlook for SB1 Funds, it was determined that Gromer Avenue from Poplar to Annin and Beckes from Highway 46 to 5
th Street would be good locations for full road rehabilitation Projects.

STAFF REPORT
City of Wasco

12 of 34
Along with these two Projects, Staff would also like to include the various roadways in the NorthEastern Zone (Project #23019) for misc. pavement treatments in our 2024-25 SB1 Project List.

The reason for recommending approval of the attached resolution is to satisfy the requirements of SB 1 relative to holding local governments accountable for the efficient investment of public funds to maintain public streets and roads, and especially the following addition to the Streets & Highways Code: (a) (1) Prior to receiving an apportionment of funds under the program pursuant to paragraph (2) of subdivision (h) of Section 2032 from the Controller in a fiscal year, an eligible city or county shall submit to the commission a list of projects proposed to be funded with these funds. All projects proposed to receive funding shall be adopted by resolution by the applicable city council or county board of supervisors at a regular public meeting. The list of projects proposed to be funded with these funds shall include a description and the location of each proposed project, a proposed schedule for the project’s completion, and the estimated useful life of the improvement. The project list shall not limit the flexibility of an eligible city or county to fund projects in a ccordance with local needs and priorities so long as the projects are consistent with subdivision (b) of Section 2030.

Fiscal Impact:

Currently, the City holds around $500,000 in our SB1 account and is estimated by the State Department of Finance to receive an additional $702,292 in FY 24-25 which should cover the completion of these Projects.

RESOLUTION NO. 2024 -

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR 2024-25 FUNDED BY SB 1: THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017
WHEREAS, Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and Signed into law by the Governor in April 2017 to address the significant multi-modal transportation funding shortfalls statewide; and
WHEREAS, SB 1 includes accountability and transparency provisions that will ensure the residents of our City are aware of the projects proposed for funding in our community and which projects have been completed each fiscal year; and WHEREAS, the City must adopt by resolution a list of projects proposed to receive fiscal year funding from the Road Maintenance and Rehabilitation Account (RMRA), created by SB 1, which must include a description and the location of each proposed project, a proposed schedule for the project’s completion, and the estimated useful life of the improvement; and
WHEREAS, the City will receive an estimated $702,292.00 in RMRA funding in Fiscal Year 2024-25 from SB 1; and,
WHEREAS, this is the 7th year in which the City is r eceiving SB 1 funding and will enable the City to continue essential road maintenance and rehabilitation projects, safety improvements, repairing and replacing aging bridges, and increasing access and mobility options for the traveling public that would no t have otherwise been possible without SB 1; and
WHEREAS, the City has undergone a robust public process to ensure public input into our community’s transportation priorities/the project list; and WHEREAS, the City used a Pavement Management System to develop the SB 1 project list to ensure revenues are being used on the most high -priority and cost-effective projects that also meet the community’s priorities for transportation investment; and WHEREAS, the funding from SB 1 will help the City maintain and rehabilitate multiple local streets/roads throughout the City this year and an assortment of similar projects into the future; and
WHEREAS, the 2023 California Statewide Local Streets and Roads Needs A ssessment found that the City’s streets and roads are in an At-Risk condition and this revenue will help us increase the overall quality of our road system and over the next decade will bring our streets and roads into Good condition; and

14 of 34

WHEREAS, the SB 1 project list and overall investment in our local streets and roads infrastructure with a focus on basic maintenance and safety, investing in complete streets infrastructure, and using cutting-edge technology, materials and practices, will impact our community greatly because there are very limited funding sources such as this that allow us to conduct improvements on roads designated as “Local.”

TO: Honorable Mayor and Council Members

FROM: M. Scott Hurlbert, City Manager
Luis Villa, Public Works Director

DATE: June 4, 2024

SUBJECT: Authorize the City Manager or Designee to Approve two Purchase Orders, one with Jim Burke Ford and the other with a Truck Body Vendor, for a New Animal Control Vehicle with the amount not to exceed $95,000. _____________________________________________________________________________________ Recommendation:

Staff recommends the City Council:
1) Authorize the City Manager or designee to approve two purchase orders, one with Jim Burke Ford and the other with a truck body vendor, for a new animal control vehicle. The total amount should not exceed $95,000, and,

2) Find Authorize the City Manager or Designee to Approve two Purchase Orders, one with Jim Burke Ford and the other with a Truck Body Vendor, for a New Animal Control Vehicle with the amount not to exceed $95,000.

Discussion:

The animal control division within the Public Works department currently relies on a single aging Animal Transport Vehicle that needs to be replaced. The request is to purchase a new 2023 Ford F- 250 vehicle from Jim Burke Ford at a price of $4 7,482.89. After the acquisition, the vehicle will be fitted by a third -party truck body company to ensure it meets the specific animal transport and control operations requirements . This unit's acquisition is crucial, providing animal control staff with essential resources to carry out critical community services. This specialized unit will rescue animals in distress, remove potentially hazardous animals from public areas, and safely transport them to the animal shelter for further care and rehabilitation.

STAFF REPORT
City of Wasco

18 of 34

After acquiring the truck, the staff will gather bids from different truck body vendors and then use the remaining funds to customize the vehicle according to the city's requirements. Since there are long lead times for vehicles, it is best to acquire the truck first and then collaborate with truck body vendors to collect bids for this specialized unit.

This request is for the approval of two purchase orders enabling staff to carry out the upfitting without the need to return to the city council.

Quotes:

Staff obtained the following quotes and recommends purchasing from Jim Burke Ford. • Jim Burke Ford - $47,482.89
• Source well - $54,644.58

Fiscal Impact:

Currently, the city has set aside $95,000.00 for CIP Project NO. 21035 from the general fund for purchasing and upfitting this unit.

On March 27, 2024, the City of Wasco submitted a grant application to the Department of Alcoholic Beverage Control for the FY 2024-2025 Alcohol Policing Partnership

STAFF REPORT
City of Wasco

29 of 34
Program in the amount of $47,950.00 for 12 months, starting on July 1, 2024, and ending on June 30, 2025.

The Wasco Police Department will use the grant funds to enforce state laws related to the illegal sale and marketing of alcohol products to minors and youth. This includes, but is not limited to:
- Identifying and targeting problematic ABC-licensed establishments - Conducting retailer compliance and licensing checks
- Carrying out Minor Decoy Operations to prevent illegal alcohol sales to minors - Conducting Shoulder Tap Operations to prevent illegal alcohol sales to minors - Organizing retailer and public education outreach.

In the 2021 Office of Traffic Safety (OTS) Crash Ranking, Wasco reported 48 fatal and injury crashes, ranking it 17th among 93 similar localities. Notably, alcohol was a factor in 7 of these incidents. Moreover, the Kern County Sheriff's Office recorded 17 DUI arrests in 2022.

The presence of fourteen (14) on-sale and twenty-eight (28) off-sale retail alcohol licenses in Wasco heightens the challenge of managing unlawful alcohol consumption, particularly among individuals under 21, and the number of crashes involving alcohol.

We will identify and target problematic ABC establishments. Then, we will conduct Minor Decoy and Shoulder Tap operations to reduce alcohol-related incidents. We will also coordinate and host LEAD (Licensee Education on Alcohol and Drugs) and TRACE (Target Responsibility for Alcohol Connected Emergencies) training.

This grant will enable us to:

1. Reduce traffic fatalities and injuries related to alcohol.

2. Lower instances of illegal alcohol sales to minors.

3. Increase public awareness about the dangers of DUI and underage drinking.

Our initiative, supported by the ABC grant, will significantly contribute to making Wasco a safer community by addressing critical traffic safety and underage alcohol consumption issues. We are committed to fostering a responsible environment for all Wasco residents and visitors.

Fiscal Impact:

There is no local match requirement. The Alcohol Policing Partnership Grant Program is a reimbursement grant. ABC will reimburse the city, in arrears, for approved expenditures upon receipt of invoices and quarterly progress reports.

Dear Chief Fivecoat:

Congratulations! Your agency has been selected by the Department of Alcoholic Beverage Control (ABC) to receive a 2024/2025 Alcohol Policing Partnership (APP) grant.

We look forward to working with your department to meet the goals and objectives in your proposal.

A grant agreement will be forthcoming in the next couple of weeks which requires a resolution from your agency’s governing body. A sample resolution was included in the Request for Proposal packet. Due to the fact that these resolutions typically have to be on your governing body’s calendar, we ask that you do so as soon as possible.

We will be hosting a two and half day training conference beginning at 8:30 am on July 8, 2024 and ending at approximately 12:00 pm on July 10, 2024. This conference offers valuable training in alcohol enforcement and serves as an excellent opportunity for the representatives from your agency to meet our ABC staff and share information with other law enforcement agencies from across the State.

This year the conference will be held at the Courtyard by Marriott Sacramento Cal Expo located at 1782 Tribute Road, Sacramento, CA 95815. The conference will accommodate up to two sworn attendees from each agency. It is recommended that your sworn Project Director and an officer/deputy assigned to the grant program attend.

There is a $325 registration fee per person to attend the conference. This fee is reimbursable through the grant.

A block of rooms at the state rate has been reserved at the Courtyard by Marriott Sacramento Cal Expo and Fairfield by Marriott Sacramento Cal Expo. These rates will be available until the block of rooms sell out or until the reservation cut-off date of June 7, 2024. Please see registration form for hotel booking information. Please note that all attendees must make reservations by the hotel deadline of June 7, 2024.

Due to the short time frame for registering for the conference, your prompt attention is greatly appreciated. Please find enclosed with this letter the APP Conference Registration form to be completed and returned as soon as possible.

If you have any questions, please email Kristine Okino, Grant Coordinator at [email protected].
