Recommendation:
Staff recommends the City Council:
1) A
dopt a Resolution Confirming the Assessment for the Levy and Collection of Assessments within Sewer Lift Station District 2008-01 for Fiscal Year 2024-25; and 2) F
ind that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.
Environmental Review:
The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.
D
iscussion:
The Sewer Lift Station Assessment is levied on parcels within housing tract numbers 6334 Phases 1 and 2 and TTM 6460 for the purpose of paying the operating and replacement cost of the sewer lift station constructed by the developer and dedicated to the City. This lift station was needed to facilitate the development of the subject tracts. On April 1, 2008, a new assessment district was created in accordance with all applicable laws.
T
he initial assessment amount was based upon the Engineers report prepared by Quad Knopf and dated March 25, 2008. For each subsequent year the tax may be increased by the Consumer Price Index (CPI) factor not to exceed 4%. Provided, however, that in no
STAFF REPORT

event shall the Special Assessment per parcel for any fiscal year be less than the amount established for the first fiscal year.
The amount of annual adjustment shall be the percentage increase from the April 2023 Consumer Price Index (CPI), Los Angeles Area- to April 2024, up 3.9% from a year ago; thus, the tax per parcel for FY 2024/25, including County charge per parcel is:
Annual Assessment per Lot this past FY 2023/24: $86.08 CPI (3.9%): $ 3.35
City of Wasco assessment per lot for FY 2024/25: $89.43 Plus, this year, Kern County Administration Charge per
parcel:
$ 0.20
FY 2024/25 Annual Assessment per Lot: $ 89.63
The calculation is in accordance with ordinance number 2008-571 of the City of Wasco, which was approved by the voters and is compliant with Proposition 218.
Fiscal Impact:
Tract 6334 Phases 1, and 2 recorded and have been included in the District. There are 146 lots being billed for FY 2024/25. The anticipated revenue for FY 2024/25 is, therefore, $89.43 per lot x 146 lots = $13,056.78

WHEREAS, on June 3, 2008, the City Council of the City of Wasco established by Ordinance No. 2008- 571 a special assessment d istrict for the Lift Station Project known as the “Sewer Lift Station District 2008 -01” ( see Exhibit A, attached); and
WHEREAS, the amounts of the special assessment proposed to be l evied on the parcels identified in the Fund Number 2067 3 District Maintenance Information Report for the assessment district for fiscal year 2024 -25 are appropriate and necessary to continue to provide for the operational, maintenance, and capital replacement costs for the sewer lift station within the assessment district; and
WHEREAS, Ordinance No. 2008 -571 was adopted in compliance with the procedures and authority set forth in the Municipal Improvement Act of 1913, Government Code s ections 53750-53756, Proposition 218, and the provisions of Cal. Const. Art. XIII D; and

Notwithstanding anything to the contrary in the foregoing, as to this assessment:
(i) The secured roll tax bills shall be the only notices required for this assessment; and
(ii) The homeowners and veterans exemptions shall not be applicable because such exemptions are determined by dollar amount of value.
SECTION 6: Costs of Administration by County of Kern. The reasonable costs incurred by the County officers collecting and administering this assessment shall be deducted from the collected taxes.

SECTION 7: City Manager Authority. The City Manager, or a designee of either, is authorized and required to take any and all actions required by the County staff to ensure that the purpose of this resolution is given full force and effect.

SUBJECT: Adopt a Resolution Confirming the Assessment for the Levy and Collection of Assessments within Special Tax Assessments within Special Tax Area Zone 2005- 1 within the Wasco Special Police Tax Area Subdivision for Fiscal Year 2024/25
Recommendation:
Staff recommends the City Council:
1) Adopt a Resolution Confirming the Assessment for the Levy and Collection of Assessments within Special Tax Assessments within Special Tax Area Zone 2005 -1 within the Wasco Special Police Tax Area Subdivision for Fiscal Year 2024/25; and
2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.
Discussion:
The Police Parcel Tax is a tax on new development designed to pay for the increasing cost of providing police services to the residences of new developments . All new subdivisions are required to approve by vote the assessment of this tax.
Wasco Police Service District 2005-1 was originally established on July 5, 2005, by resolution 2005-2257, with an initial tax rate of $105.00 per parcel. For each subsequent tax year, the rate may be increased by the Consumer Price Index (CPI) factor for the previous year as
STAFF REPORT

On July 20, 2021, through Resolution No. 2021- 3649, the City Council approved the establishment of Community Facilities District No. 2020 -01 (CFD 2020-01), which allows for the financing of public improvements and services . another local agency pursuant to an agreement entered into under Government Code Section 53316.2. By law, the CFD is also entitled to recover expenses needed to form the CFD and administer the annual special taxes and bonded debt.
The Special Tax will be secured by recordation of a continuing lien against all non-exempt real property in the District and will be collected in the same manner as ordinary ad valorem property taxes are collected or in such other manner as may be provided by the City Council, including, without limitation, direct billing of the affected property owner, and shall be subject to the same penalties, procedure, sale and lien priority in case of delinquency as applicable for ad valorem property taxes.
The Maximum Annual Special Tax was established in FY 2022/23 at an amount of $1,060.96 per parcel. Due to COVID and Tract 7373 not being built-out, this is the first FY that the City will charge the special tax. Per the “Rate and Method of Apportionment of Special Tax” section of Resolution No. 2021-3649, this Maximum Annual Special Tax shall be adjusted for inflation annually to account for inflation. The annual adjustment shall be the percentage increase from the April 2023 Consumer Price Index (CPI), Los Angeles Area, to April 2024, up 3.9% from a year ago. Thus, the tax per parcel for FY 2024/25 is $1,102.55, including the County charge per parcel.
City of Wasco assessment per lot for FY 2024/25: $ 1,060.96 CPI (3.9%): $ 41.39
Plus, this year, Kern County Administration Charge per parcel: $ 0.20 FY 2024/25 Annual Assessment per Lot: $ 1,102.55
Fiscal Impact:
Tract 7373 Phase 1 was recorded on 10/26/2021, Phase 2 and Phase 3 were recorded on October 12, 2022, and have been included in the CFD . There are 144 lots being billed for FY 2024/25. The anticipated revenue for FY 2024/25 is, therefore, $1,102.35 per lot x 144 lots = $158,738.40.

WHEREAS, in connection with the establishment of Special Tax Area Zone 2006-3, the voters approved the Special Tax to be levied and the amount of the Special Tax being levied is no higher than the amount approved by the voters; and
WHEREAS, the City Council of the City of Wasco has determined that it is necessary and appropriate that the Special Tax be confirmed and that the City request the County Recorder of Kern County to record the annual notice of special tax lien levied and collected on real property within Special Tax Area Zone 2006-3 for fiscal year 2024/25 for the purpose of maintaining and police and safety services within the tax area zone.
60 of 113
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Wasco as follows:
SECTION 1: Findings. The City: finds that (a) the special tax to be levied on parcels within the Special Tax Area Zone for fiscal year 2024/25 for police and safety costs as outlined in the Fund Number 20671 District Maintenance Information Report, are based upon the proportionate service provided to each such parcel which has been determined in relationship to the entirety of the cost of providing police and safety services; and (b) no assessment will be imposed on any parcel which exceeds the reasonable cost of the proportional special benefit conferred on that parcel , and (c) the Special Tax being imposed is not higher than the amount approved by the voters and is therefore in compliance with the provisions of the Constitution governing the levy of special taxes.
SECTION 2: Confirmation and Levy of Special Tax. The special tax in the amount specified in the Fund Number 20671 District Maintenance Information Report is hereby confirmed as originally proposed.
SECTION 3: Filing. The City Clerk is directed to file the special tax as contained in the Report, or a certified copy thereof, with the County Auditor . Upon filing of the diagram and special tax levy, the County Auditor shall enter on the County assessment roll opposite each lot or parcel of land the amount levied thereupon, as shown in the report.
SECTION 4: Effect. The amount of special taxes for each parcel shall constitute a lien on such property, in accordance with Revenue and Taxation Code Section 2187, and shall have the same effect as an ad valorem real property tax lien until fully paid.
SECTION 5: Collection. The special taxes on each parcel shall be billed on the secured roll tax bills of ad valorem property taxes and are to be collected in the same manner in which Kern County collects secured roll ad valorem property taxes.
Insofar as feasible and insofar as not inconsistent with this Ordinance, the times and procedure regarding exceptions, due dates, installment payments, corrections, cancellations, refunds, late payments, penalties, liens, and collections for secured roll ad valorem property taxes shall be applicable to the collection of this tax. Notwithstanding anything to the contrary in the foregoing, as to this tax:
(i) The secured roll tax bills shall be the only notices required for this tax; and
(ii) The homeowners and veterans exemptions shall not be applicable because such exemptions are determined by dollar amount of value.
SECTION 6: Costs of Administration by County of Kern . The reasonable costs incurred by the County of ficers collecting and administering this tax shall be deducted from the collected taxes.
SECTION 7: City Manager Authority. The City Manager or a designee is authorized and required to take any and all actions required by the County staff to ensure that the purpose of this resolution is given full force and effect 61 of 113

Discussion:
The City of Wasco will soon welcome a new Wendy’s restaurant on Hwy 46 next to the Dutch Brothers Coffee. To provide water to the new Wendy’s location and avoid any Cal Trans right-of-way issues, the city's water meters will be placed on the Wendy’s property.
An easement agreement is needed between Wasco GO, LLC (the grantor) and the city of Wasco (the grantee) to allow the city's water department access to their equipment, such as water meters and water boxes for reading and maintenance. The specific area for this easement is shown in the attachment provided. The easement paperwork has been reviewed by Wiley Hughes Surveying, which has been hired by the City to review surveying documents.
After the easement documents are finalized and approved by the consultant and city staff, we request that the council approve the city manager or designee to sign the easement paperwork, granting the city the necessary access rights to their water meter.

Recommendation:
Staff recommends the City Council:

The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. DATE: July 16, 2024
SUBJECT: Adopt a Resolution Authorizing the City Manager or Designee to Enter into an Agreement with Westrock LLC for the Alley Pavement Rehabilitation Project in the amount of $96,969.00 and allowing the City Manager to execute Contract Change Orders in an amount not to exceed an aggregate of $25,000.00.
Recommendation:
Staff recommends the City Council:
1) Adopt a Resolution Authorizing the City Manager to Enter into an Agreement with Westrock LLC in the amount of $96,969.00 for the Alley Pavement Rehabilitation Project; and
2) Allow the City Manager to execute Contract Change Orders in an amount not to exceed an aggregate of $25,000.00.; and
3) Find that this Project is found to be exempt under Section 15301 of the California Environmental Quality Act State Guidelines; no environmental review is required.
Environmental Review:
Staff has reviewed the proposed activity for compliance with the California Environmental Quality Act ( CEQA) and has determined that the Project is found to be exempt under Section 15301 due to the nature of the work being conducted as alterations of existing facilities; no environmental review is required.
Discussion:
A series of Projects funded by the California High-Speed Rail was approved as part of the 2024-25 FY budget, one of which being the rehabilitation of the existing alleyway between 12th Street and Poso Avenue. The City’s Asphalt Zipper equipment was used to complete a portion of the preparation work on this alleyway, thereby reducing the amount of work required by bidders.
STAFF REPORT
City of Wasco
80 of 113
The Alley Rehabilitation Project was advertised for bid on June 2, 2024. On June 27, 2024, the City of Wasco received four bids from the following Contractors:
FIRM BID TOTAL
Westrock LLC $ 96,969.00
Burtch Construction $ 148,346.90
Bowman Asphalt $ 108,430.00
Griffith Company $ 170,450.00
After completion of the review, Staff has determined that Westrock LLC is the lowest-cost qualified bidder, and as such Staff recommends awarding the Project to Westrock LLC.
Existing infrastructure including shallow utility lines may require field adjustments to the design and warrant the authorization of legitimate change orders. Authorization of up to $25,000.00 for project change orders is requested.
Fiscal Impact:
The 2024/202 5 FY budget (Project 2 3002) allocated a total of $ 225,883.00 for the implementation of Design and Construction for the Alley Rehabilitation Project. To date, the City has encumbered $ 11,773.71 in costs for design and advertisement fees. The lowest cost, a qualified bid from Westrock LLC of $96,969.00, leaves $117,140.29 remaining for Project contingencies.
As such, Staff recommends an award to Westrock LLC.

Keri Cobb, Community Development Director
DATE: July 16, 2024
SUBJECT: Receive an update on the City of Wasco Downtown Streetscape Re-Design Project and Provide Direction for the Placement of Existing City Monuments.
Recommendation:
Staff recommends the City Council:
1) Receive an update on the City of Wasco Downtown Streetscape Re-Design Project; and
2) Provide direction for the Placement of Existing City Monuments; and
3) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.
Environmental Review:
The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.
Background:
On January 8, 2024, after four years of planning and preparation, the City broke ground on the Historic Downtown Business District Transformation project. Planning and preparation for this project included:
• Development of concept designs using public input provided through electronic surveys and in -person public workshops, as well as City Council input provided during periodic project updates presented during Council meetings. • Grant writing and funding procurement.
STAFF REPORT
City of Wasco
112 of 113
• Development of engineered construction, landscap e, irrigation, electrical plans, and bid documents.
• Procurement of a contractor.
Discussion:
Our initial deadline for expenditure of funds was July 1, 2024. However, staff was able to obtain a 6-month extension to allow time to tie up loose ends , including completion of art installations, finishing touches in Veterans Park, install ing tree grate s, and installing children’s swings in the Plaza, as well as a few other outstanding items.
One outstanding item on which staff is seeking informal direction from the Council is the placement of existing City monuments currently in storage.
Once all outstanding items are completed, Staff intends to schedule a communitywide ribbon-cutting celebration near the Veterans Day Holiday. This will provide an opportunity to honor our Veterans with the new park and give the weather time to cool off.
Fiscal Impact:
Project expenditures and outstanding commit ments to date total approximately $6,000,000. The total project budget, as identified in the City’s Capital Improvement Plan, is approximately $6,500,000. We are currently anticipating the completion of the project at or just under budget.
