TO: Honorable Mayor and Council Members
FROM: M. Scott Hurlbert, City Manager
Maria O. Martinez, City Clerk
DATE: August 14, 2024
SUBJECT: Adopt a Resolution of the City of Wasco accepting the City Clerks Certification that there are not more candidates than offices to be elected for in the upcoming November 5, 2024 General Election.
Recommendation:
Staff recommends that the City Council:
1) Adopt the Resolution accepting the City Clerks certification that there are not more candidates than offices to be elected for in the upcoming November 5, 2024 General Election; and
2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.
Environmental Review:
The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.
Discussion:
The nomination period for the upcoming General Election ended on August 9, 2024, and only the incumbents f iled papers to run in the election for District 2, and District 4. For District 5, only one candidate filed his nomination papers and has been certified. Election Code §10229 specifies that when there are not more candidates than offices to be elected the City Clerk is to bring a certification of those facts to the Council. Said certification details the available courses of action that can be taken by the Council as:
1. Appoint to the office the person who was nominated.
2. Appoint to the office any eligible voter if no one has been nominated.
3. Hold the election if either no one or only one person has been nominated.
