SUBJECT: A pproval of the acceptance of the Alley Rehabilitation Project and Authorize the City Clerk to file the Notice of Completion. _____________________________________________________________________________________ Recommendation:

Staff recommends the City Council:
1) Approval of the acceptance of the Alley Rehabilitation Project and authorize the City Clerk to file the Notice of Completion; and

2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.

Environmental Review:

The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

Discussion:

On July 17, 2024 the City Council approved an agreement with Westrock LLC for the rehabilitation of the alley between HWY 43 and G Street from 12 th Street to Poso in the amount of $96,969.00. High Speed Rail’s closure of G Street prompted the need for this Project and as such it was funded by the California High Speed Rail Settlement Funds.

This Project was completed on August 15, 2024.

Fiscal Impact:

The 2024-2025 Capital Improvement Plan Project # 23002 budgeted $168,783.00 for the Construction of this Project. With a few minor quan tity adjustments, the final cost came in at $97,394.00, which leaves $71,389.00 remaining. Some of the project savings can be

attributed to use of the City’s Ashpalt Zipper equipment in preparation of the alley.

Budgeted funds not spent on this project will remain in the Settlement Funds balance.

Final Balancing Change Order

Date of Contract: July 17, 2024 Date: October 15, 2024 Contract Amount: $96,969.00
Contractor: Westrock LLC Project: Wasco Alley Rehabilitation Project 23002

Quantity Adjustment #1: V-Gutter

The original scope of work included 510 linear feet of v -gutter to be installed for drainage. During Construction the Contractor was directed to install 30 feet of additional v -gutter to improve drainage at the South end of the Alley where during rain events water would have backed up into one of the properties from the alley. With a line item price of $56.50/foot this quantity adjustment cost $1,695.00

Total Quantity Adjustment: $ 1,695.00

Quantity Adjustment #2: AC Paving

The bid quantity of asphalt to be paved came in at 160 TONS. After project completion and review of load tickets, the Contractor only used 155 TON (after waste). This variation is typical because through design the estimates are often rounded up to ensure proper project budgeting. With a line item bid price of $254/TON this quantity adjustment gave us a credit of $1,270.00

Total Quantity Adjustment: $(1,270.00)

Original Contract Amount $ 96,969.00
Net Quantity Adjustments/Change Orders $ 425.00
Final Balance $ 97,394.00

SUBJECT: Adopt a Resolution Authorizing the City Manager or D esignee to execute an Emergency Purchase Order with Farm Pump and Irrigation to perform emergency repairs of Well #12 in an amount not to exceed $150,000.00 Recommendation:

Staff recommends the City Council:
1) Adopt a R esolution Authorizing the City Manager or designee to execute an emergency purchase order with Farm Pump and Irrigation to perform emergency repairs of Well #12 in an amount not to exceed $150,000.00; and

2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.

Environmental Review:

The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which doe s not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

Discussion:

The city's water system consists of six active wells that provide water to its residents. Well #12, which is approximately 17 years old and has experienced significant wear and tear, has been taken offline due to mechanical issues. This has reduced the cit y's available water supply. Recognizing the critical nature of the well issues and the urgent need to bring the well back online, our staff took immediate action to have Farm Pump and Irrigation assess the well. The assessment revealed that there is a need to pull the entire 500 feet of column tubes and pump.

After removing the well pump and bowls, we found significant wear and tear on the column tubes and well pump, which will need replacement. While the well piping and

STAFF REPORT
City of Wasco

pump were removed, our staff decided to conduct a video survey of the well and check the structural integrity of the entire well casing as a best practice. Everything checked out fine, but cleaning the well perforations was recommended. After cleaning, it is recommended to extend the pump by another 100 feet while it is out. This would require new tubing and a change in the well pump. This would provide a n additional buffer below the water table, where the water quality is expected to remain unchanged. It is seen as a long-term solution for the production well.

While we do not have the exact scope of work needed, we are requesting approval to spend up to $150,000.00 for Farm Pump and Irrigation to complete all the necessary work to bring this well back online. Even though having the well offline reduces the city's system capacity, we do not expect any production or pressure shortages because well 13 is available.

Fiscal Impact:

The emergency work will be funded by the Water Enterprise Reserve fund.

Contractor: Amerivet Contracting Project: Wasco Labor Camp and Demolition Cleanup Project

CHANGE ORDER #1: Unforeseen painted CMU

One hundred percent of the exterior Concrete Masonry Unit (CMU), which makes up the exterior walls of the buildings, is painted in a non-neutral color. This makes the painted CMU unable to be recycled due to the risk of paint bleeding through the manufactured base. This condition was unforeseen during the bidding process, as the exterior stucco covered the CMU since it was not stripped beforehand, nor was it disclosed in the provided as-built plans. The subcontractor is obligated to dispose of the exterior CMU, as part of the scope of work. As a result of being unable to recycle the CMU, the subcontractor has incurred higher disposal costs than initially estimated, including additional expenses for trucking due to the longer distance to the landfill instead of the recycling facility.

Total Change Order: $ 217,543.29

CHANGE ORDER #2: Unforeseen vapor barrier conditions

A change order is requested due to the unforeseen condition of the vapor barrier being placed in between the concrete slabs. The building foundations were not poured monolithically. The building footers were poured, and then the building slab was poured. The vapor barrier was placed in between the footers and the slab. Due to this action, Amerivet has to chip the slab off the footers and separate the plastic from the concrete so it can be recycled. This additional task has added three hours per foundation. Out of 102 buildings, there were 12 buildings that lacked any vapor barrier, insulation, and metal protective shield around the footers. Leaving 90 buildings affected by the vapor barrier, and only 3 were specified on the as-built plans, leaving 87 affected foundations as unforeseen.

Total Change Order: $ 44,609.29

PERMIT #1: Demo Permit 24-000050

Per the contract, the City is to pay all permit fees that Amerivet needs for the labor camp demo project.

Total Permit reimbursement: $ 204.55

Original Contract Amount $ 1,149,525.00
Net Quantity Adjustments/Change Orders $ 262,152.58
Demolition Permit #24 -000050 $ 204.55
Final Balance $ 1,411,881.90

TO: Honorable Mayor and Council Members

FROM: M. Scott Hurlbert, City Manager
Luis Villa, Public Works Director

DATE: October 15, 2024

SUBJECT: Adopt a Resolution Authorizing The City Manager or designee to Endorse and enter into an Agreement with Nagle Earthworks for the Poso Avenue Bicycle and Pedestrian Improvement Project in the amount of $168,455.00 and allowing the City Manager to execute Contract Change Orders in an amount not to exceed an aggregate of $50,000.

Recommendation:

Staff recommends the City Council:
1) Adopt a Resolution a uthorizing The City Manager or designee to Endorse and enter into an Agreement with Nagle Earthworks for the Poso Avenue Bicycle and Pedestrian Improvement Project for $168,455.00 and allowing the City Manager to execute Contract Change Orders in an amount not to exceed an aggregate of $50,000; and

2) Find that this action is not a project defined under the California Environmental Quality Act State Guidelines; therefore, no environmental review is required pursuant to State Guidelines Section 15378.

Environmental Review:

The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act ( CEQA). It has been determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because it consists of a governmental fiscal/administrative activity that does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

Discussion:

The Palm Avenue Rehabilitation Project has two funding components. The Congestion Mitigation and Air Quality (CMAQ) grant is the first funding component. The City received a CMAQ grant to improve the shoulders of Poso Avenue between Central Avenue and Martin Court. These shoulder improvements include widening the roadway and installing a curb, gutter, and sidewalk. The CMAQ grant that the City received totaled $355,936.00, including $306,780.00 for the Construction phase.

STAFF REPORT
City of Wasco

Background:

On February 24, 2024, City Council held the annual Strategic Planning Meeting with staff to review current and proposed goals for the departments of the City. During this session, the staff presented an overview of departmental accomplishments and incentives. The goal of the Strategic Planning Meeting was to establish a concise, prioritized list of areas of focus. The list guided the Council and Staff in establishing an efficient and effective government.

F
rom this meeting, one of the top prioritie s for the Council was to improve the City’s engagement with the Community through various media channels including social media platforms.

Discussion:

Implementation of the City’s Community Engagement goals will require both one -time and ongoing investment.

It is in the best interest of the City of Wasco to invest in media communication by utilizing American Rescue Plan Act (ARPA) funds to effectively engage and inform the public about critical resources and services . The wake of COVID -19 pandemic, timely and accessible communication was essential in keeping residents informed about health guidelines, economic assistance, programs. A variety of media channels, particularly social media platforms, offer a cost-effective way to reach a broad audience including underserved communities who may not have access to traditional communication channels. By leveraging ARPA funds for this purpose, the city can enhance transparency and promote community engagement which aligns with ARPAs goals of addressing related challenges such as future health events, natural disasters, and to support public safety efforts.

One-time Costs:

Attorney F
ees - $16,000
Having an attorney to review the C ity's social media policy ensures that the City stays compliant with laws, protects citizen rights, minimizes legal risks, and reduces potential liabilities. An attorney can tailor the policy to our local regulations, safeguard employee conduct, and provide critical legal guidance on issues such as pub lic records, free speech, and privacy. A well-drafted, legally compliant policy ultimately protects the City from costly legal disputes while fostering transparent, fair, and lawful engagement with the community.

Trademark Development and/ or Ordinance Filing - $1,400 With wider distribution, it is prudent to protect the City logo and other content. The fee for trademark filings is currently $350 per mark, but we may incur additional costs for legal assistance and trademark design. Adequate protection may also be available through properly implemented Municipal Ordinance. Staff is researching various options. More information can be found at the United States Patent and Trademark Office https://mrsc.org/stay-i nformed/mrsc-insight/march-2023/protecting-your-municipal- brand.

Ongoing Costs:

Archiving Tools
– $8,400.00/yr
45 of 48
Investing in a Social Media Archiving Tool helps to stay compliant with legal requirements, protect against risks, and ensure transparency. It not only safeguards records for potential audits, legal requests, or public inquiries but also enhances communication strategy through organized, searchable archives. In today’s digital age, where social media plays a critical role in public engagement, having a reliable record of interactions is key to maintaining accountability, trust, and efficiency in how the City serves its community.

Social Media Scheduling and publishing - $1, 500/yr
A Social Media Scheduling and Publishing tool is essential for modernizing communication efforts. It ensures consistent, timely, and professional engagement with citizens while saving valuable time and resources. By streamlining workflows, enabling data-driven strategies, and improving responsiveness in both routine and emergency situations, the tool can significantly enhance public service delivery. Investing in such technology not only meets the growing demands for digital communication but also strengthens the municipality’s relationship with its community, fostering greater trust and transparency.

Accessibility Tools
- $4,200/yr
The Americans with Disabilities Act (ADA) is a landmark civil rights law that prohibits discrimination against individuals with disabilities in all areas of public life. It gives millions of individuals with disabilities equal access to all public and priv ate places, from employment to government, telecommunications, and businesses. Title II of the ADA addresses local governments specifically. It prohibits discrimination against people with disabilities by public entities – state or local government and any of their departments, agencies, or other instrumentalities. Software is needed to comply with the Americans with Disabilities Act (www.ada.gov), including digital websites. Ensuring full accessibility is a benefit to the estimated one -in-four U.S. adults with some disability that can affect access to digital content.

Fiscal Impact:

The implementation of Capital Improvement Project #25013 ( City Media Initiative ) will incur one -time costs of approximately $17,400 and ongoing annual recurring costs of approximately $14,100. If the recurring tools and services are billed annually, the entire expense will likely be recognized in the current FY 2024/2025. Therefore, to cover the estimated expenses plus contingencies, a total appropriation of $33,000 is requested to fund CIP #25013 and the recurring expenses in the Adopted Operating Budget.
