Recommendation:

Staff recommends the City Council:
1) Approval for Travel Expenses Exceeding $500.00 f or California Police Chief’s Association Annual Training Symposium scheduled for March 9 -12, 2025, in Riverside, California, and

2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.

Environmental Review:

The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. The symposium provides up to 13 hours of POST Training from the 9 workshops offered during the program. Attendees get caught up on the latest in innovations in tra ining, officer wellness , and legislative and legal issues. The event also includes an expo hall where attendees can see the latest in public safety technology and other products and services.

STAFF REPORT
City of Wasco

17 of 59
The cost of the conference, hotel fees, and food per diems will exceed the Expense and Use of Public Resources Policy limits established by City of Wasco Resolution No. 2024, which limits expenses to $500.00 per trip. As a result, the City Council will need to approve the travel requested by the Community Development Director as the trip expenses will exceed $500.00.

Fiscal Impact:

It is estimated that the cost of travel and training for the California Police Chief’s Association Annual Training Symposium will not exceed $3,250.00. The adopted FY 2024-2025 Operating Budget contains sufficient funding to cover this expense, no budget action is required.

STAFF REPORT

CITY OF WASCO

TO: Honorable Mayor and Council Members

FROM: M. Scott Hurlbert, City Manager
Isarel Perez-Hernandez, Finance Director

DATE: November 05, 2024

SUBJECT: Receive and File the Investment Report for the quarter ended September 30, 2024.
_____________________________________________________________________________________

Recommendation:

Staff recommends that the City Council:
1) Receive and file the Investment Report for the quarter ended September 30, 2024; and

Thus, no environmental review is required.

Background:

This report is prepared and presented to the City Manager and City Council pursuant to the City’s Investment Policy requirements and the California Government Code. The City’s investment policy requires the Treasurer or Chief Fiscal Officer to render monthly investment reports to the City Manager and the City Council and requires certain information about the City’s investments to be presented in the report and that the report contains statements that:

1) The City is in compliance with its investment policy; and 2) The City is able to meet its expenditure requirements for the following six (6) months or provide an explanation of why sufficient funds will or may not be available.

The City’s investment strategy continues to prioritize its investment o pportunities on the following, in order of importance:
24 of 59
1) Safety;
2) Liquidity; and
3) Yield

This strategy is consistent with the Government Code and stresses keeping the citizens’ funds safe and available for operations rather than attempting to maximize returns by making riskier investments.

The Finance Department has prepared the Investment Report for the quarter ending September 30, 2024. This report meets the latest requirements of the City’s Investment Policy as presented to the City Council on June 18, 20 24, as well as Government Code Section 53646.

Discussion:

The market value of the City’s total cash and Investments on June 30 , 2024, was $71,695,669, compared to $72,315,557 on September 2024. This is a $619,888 increase from the previous quarter (a $586,100 increase on the cost basis).

The increase is linked to certificates of deposit maturing during the quarter.

As of September 30 , 2024, the City ha d $3.8 million (5.30%) of its Cash and Investment Portfolio held in the State of California Local Agency Investment Fund (“LAIF”), which earned 4.33 % during the quarter (ended September 30, 2024). As of September 30, 2024, the City had $43.4 million (60.06%) of its Cash and Investment Portfolio held in the California Cooperative Liquid Assets Securities System (“CACLASS”), which earned 5.36 % during the quarter (ended September 30 , 2024). This earnings rate exceeded the short-term benchmark. Other cash pools held a combined $7.5 million (10.46%) of the City’s Cash and Investment Portfolio. The City also has $14.2 million (19.66% of its Portfolio) held by USBank Investment Services and invested, pursuant to City instructions, in Certificates of Deposit and Governmental Securities with a Money Market account being used to maximize returns on otherwise idle cash.

The metrics used in the attached report are based on Securities issued by the United States Government. The short -term benchmark of 4.73% is the average earned by a 3- month Treasury Bill during the quarter ended September 30, 2024, and the long and medium-term benchmark of 3.95 % is the average earnings of 2- year and 3-year treasury notes during that time frame. Lastly, the one- year U.S. Treasury benchmark for the quarter ended September 30, 2024, was 4.45%.

Fiscal Impact:

There is no fiscal impact to this action.

SUBJECT: Adopt a Resolution declaring 1041 G St. (APN 030-421-06), a public nuisance and a threat to public health and safety, ordering the demolition and cleaning of the property pursuant to City of Wasco Municipal Code Chapter 17.80 and Authorizing the City Manager or Designee to approve expenditures for demolition and clearing of the property in an amount not to exceed $15,000.00

Recommendation:

Staff recommends that the City Council:
1) Adopt a Resolution declaring 1041 G St. (APN 030- 421-06) a public nuisance and a threat to public health and safety. The resolution would order the demolition and cleaning of the property pursuant to the City of Wasco Municipal Code Chapter 17.80 and authorize the City Manager or Designee to approve expenditures for demolition and clearing of the property in an amount not to exceed $15,000.00; and

Thus, no environmental review is required.

Background:

On August 15, 2024, the Wasco Police Department contacted Wasco Code Enforcement to inspect 1041 G Street for possible substandard conditions. Code enforcement inspected the main hou se, an attached room, and a detached structure, all being

occupied. C ode enforcement officer Gonzalez confirmed with the Wasco Finance Department that the property did not have an active water service. Officer Gonzalez conducted a thorough inspection and found multiple substandard conditions. T he property has been neglected for a long period of time and is extremely dilapidated. Lack of water service leaves the property unsanitary and uninhabitable. The exterior of the main house and detached structure was severely deteriorated, having major issues with weatherproofing, exposure to outside elements, broken windows, damage to walls, missing or dilapidated roofing, siding missing or deteriorated, illegal separation of single- family to duplex, and overall lack of general maintenance. The interior was extremely dilapidated from lack of maintenance. The main house had an accumulation of waste, causing egress concerns; the interior had missing electrical switches, broken receptacles, major damage to floors/walls/ceilings, exposed electrical, inadequate electrical and plumbing, and indicators of infestation from insects/rodents. T he detached structure appeared to be a small garage or storage converted to living space with out plumbing and adequate electrical. The detached structure has all the same substandard conditions as the main structure, including illegal use as living space. Due to the dangers posed to the occupant from all structures and surrounding property, code enforcement red-tagged the property removing all occupants.

Discussion:

On August 18, 2024, the Kern County Fire Department was called to the property for a large fire. All structures on the property are a complete loss, including a substantial loss to the neighboring properties. After August 18 th, the property experienced 2 -3 small fires , which Code Enforcement believes to be transient trespassing. The property is covered in burnt ruins and currently exhibiting dangerous conditions. The property is an a ttractive nuisance. A report from the Wasco Police Dept. shows that from June 2024 to the present, this property has had multiple calls for service , including multiple arrests, warnings, and contacts with trespassers.

Fiscal Impact:

Staff received a demo quote on September 24, 2024, from American Refuse of $9,800.00

The City Council approved $15,000 in the FY 2024- 2025 Code Enforcement budget for abatement costs.

Staff will attempt to get additional informal quotes for this project and if we do not receive any quotes additional quotes or quotes lower than the $9,800, staff will engage American Refuse. Once the contractor is secured, Code Enforcement will submit the required warrant documents and obtain a warrant from the courts. Once we receive the warrant, the City has 14 days to complete the work.

This item authorizes the City Manager or designee to approve expenditures for demolition and cleaning of 1041 G St. in an amount not to exceed $15,000.00.

It is estimated that the cost of this training will not exceed $2, 500, including the conference and travel expenses. The training cost is contained in the adopted FY 2024 – 2025 Budget; no budget action is required.

DATE: November 5, 2024

SUBJECT: Informational Only Regarding the Sustainable Groundwater Management Act (SGMA) Update.

Recommendation:
1) Update for the Council regarding the Sustainable Groundwater Management Act (SGMA); and

2) Find that this action is not a project as defined under the California Environmental Quality Ac t State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.

Thus, no environmental review is required.

Background:

The Sustainable Groundwater Management Act (SGMA), passed in 2014, created a framework to protect groundwater resources. It emphasizes local control, the use of the best available science, and active engagement with all groundwater users.

Under the Sustainable Groundwater Management Act (SGMA), local agencies must create Groundwater Sustainability Agencies (GSAs) to manage groundwater basins sustainably through Groundwater Sustainability Plans (GSPs), which must include key components such as:
- A Sustainability Goal
- A description of the area covered by the GSP (referred to as the "Plan Area") - A description of the Basin Setting, which includes the hydrogeologic conceptual model (HCM), historical and current groundwater conditions, and a water budget - Locally defined Sustainable Management Criteria (SMCs)

STAFF REPORT
City of Wasco

50 of 59
- Monitoring networks and protocols for each applicable sustainability indicator - A description of projects and/or management actions (P/MAs) that will be implemented to achieve or maintain sustainability

The Kern County Subbasin, part of the San Joaquin Valley Groundwater Basin , is one of 21 critically overdrafted areas identified by the California Department of Water Resources. This s tatus has l ed to an accelerated requirement for a Groundwater Sustainability Plan (GSP) by 2020, aim ing for long-term sustainability by 2040. Located entirely within Kern County, the Subbasin includes eight cities: Wasco, Arvin, Bakersfield, Delano, Maricopa, McFarland, Shafter, and Taft, along w ith sever al unincorporated communities like Buttonwillow and Lamont.

On June 20, 2018, the City of Wasco entered into a “Cooperative Agreement Between City of Shafter, City of Wasco, North Kern Water Storage District, and Shafter- Wasco Irrigation District”. Subsequently, this Cooperative group has formed its own GSA for the purpose of coordinati ng compliance with and implementation of the Sustainable Groundwater Management Act (Water Code §§ 10720 et seq.) (“SGMA”) within each of the Party’s boundaries

Discussion:

In January 2020, the Subbasin G roundwater Sustainability Agencies submitted five Groundwater Sustainability Plans (GSPs) to the Department of Water Resources (DWR). In January 2022, DWR designated the p lans as "incomplete," c iting three significant deficiencies. The GSAs amended and resubmitted six GSPs in July 2022, but in March 2023, DWR deemed them "inadequate."

As a resu lt, the Subbasin is now subject to state intervention un der the Sustainable Groundwater Management Act (SGMA). The first step in this process is a public hearing by the State Water Resources Control Board (SWRCB) , which wi ll de termine if the Subbasin should be designated as probationary due to any unresolved deficiencies.

Probation indicates a potential state intervention, which could result in water extraction fees and reduced water allocations for the surrounding region if the plan does not meet state requirements. Groundwater Sustainability Agencies (GSAs) are working diligently and hope to receive more detailed feedback on any deficiencies to make necessary corrections and develop a plan that achi eves state approval. Since Wasco is classified as a disadvantaged community, staff have requested an exemption from the extraction fees if the water boards find the plan inadequate.

The public hearing to consider designating the Kern County subbasin as a probationary basin under SGMA is set for February 20, 2025.

SUBJECT: Informational Only Regarding the State Revolving Fund Grant status and recent changes.

Recommendation:
1) Informational Only Regarding the State Revolving Fund Grant status recent changes; and

Thus, no environmental review is required.

Background:

In 2020, the City of Wasco submitted a comprehensive General, Financial, and Technical Package to the State Water Resources Control Board's Division of Financial Assistance. This initiative was designed to address critical infrastructure needs by replacing four aging water wells, rehabilitating and treating an existing well, constructing two new water storage tanks, implementing Advanced Meter Infrastructure, and upgrading the City's SCADA system.

During the four-year application process with the SWRCB staff, the city faced numerous hurdles and delays due to factors on the state's end, such as staff changes, adjustments in funding sources, and additional environmental work and reviews. On September 26, 2024, city staff met with SWRCB staff at the city's request to seek clarification and gather more information about the current status of the grant. At this meeting, staff learned that several critical components of the City’s initiative would no longer be funded through the state revolving fund grant.

STAFF REPORT

Discussion:

Staff were informed that funding will still cover the four replacement wells and the treatment system for Well 12. However, we learned that the two water storage tanks and the advanced meter infrastructure will no longer receive state funding, as the state does not consider these projects to be related to water quality. While these projects may not directly address water quality, they are essential infrastructure needs for supporting the community. If staff had known four years ago that these projects would remain unfunded, they would have actively sought alternative funding sources or viable options to finance them.

Given this news, staff is actively exploring alternative methods to implement these essential infrastructure improvement projects. R ising costs and the po ssibility of further increases mean delaying these projects could le ad to even higher expenses. We will continue to seek grant funding to address our water infrastructure needs.

Below are some projects that staff is currently prioritizing, al ong with potential initial solutions for each.

Advanced Metering Infrastructure Project
The city currently relies on a third-party service to access and read all 5,500 water meters for customer billing. While this process has generally been effective thus far, it comes with numerous inefficiencies and vulnerabilities. The Advanced Metering Infrastructure (AMI) project, which was part of a grant, aims to replace all of the city's current meters and provide remote reading capabilities. This upgrade will include leak detection and customer portal features that would significantly reduce water loss and high bills, allowing our customers to have real-time access to their usage data.

Initial discussions and assessments of our current process have led us to explore financing options for a potential long -term solution. The initial belief is that there would be a net cost benefit by the end of the project, which would be a significant advantage for our ratepayers. If the council wishes to continue, a detailed report with the cost and savings breakdown will be presented for further discussion.

Water Tank Storage Project
The city currently lacks above -ground water storage and any surface water supply , which makes the system vulnerable during emergencies or times of high demand. While we have six active wells that supply booster pumps to increase water pressure, this setup is not ideal for maintaining an effective water system pressure.

Water storage has numerous advantages. It enhances system reliability, maintains consistent water pressure, and provides fire protection in the event of a natural disaster when access to groundwater may be limited. Additionally, it can lead to sign ificant savings by minimizing wear and tear on well pumps and motors. It also reduces electrical costs by allowing us to pump water from ground level during peak pricing periods rather than 600 feet underground, where our well pumps are installed.

As the development o f th e Well 13 si te a pproaches completion, staff is exploring alternative funding options for one of the tank storage projects at this site , which was initially part of the SRF grant scope.

SUBJECT: Adopt a Resolution Authorizing the City Manager or D esignee to Approve a Change Order for Well 13 Site Development Project to Procure and Install an Additional Water Storage Tank in an Amount not to Exceed $4.2 million.

Recommendation:

Staff recommends that the City Council:
1) Adopt a resolution authorizing the City Manager or his designee to Approve a Change Order for Well 13 Site Development Project to Procure and Install an Additional Water Storage Tank, and

2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.

Thus, no environmental review is required.

Background:

Following the previous staff report, this furthers t he discussion on a potential solution for the construction of a water storage tank at the Boothe property or “Well 13.”

Due to the current lack of water tank storage in Wasco, staff recommends proceeding with a water tank storage project at our newest well, Well #13 , since the state revolving fund will no longer fund it. The addition of water tank storage would significantly benefit the city by prov iding a buffer for the water system and improving our preparedness for emergencies, such as extended power outages or natural disasters. With increased tank storage, staff would be able to pump water from the tank throughout most of the day.

This tank addi tion will help reduce electrical costs by enabling us to pump water from above ground during peak pricing hours, rather than drawing it from 600 feet underground, where our effective pumps are located.

Discussion:

While the site development project at We ll 13 is still ongoing, staff recommends proceeding with a change order for Hartzell to procure and install the water tank during their time on -site. Given the rising costs and long lead times associated with water infrastructure projects, it is crucial to initiate this phase of the project. We have already lost significant time waiting for the approval of SRF funding. Delays in constructing the water tank could incur additional costs, particularly due to potential increases in the prices of steel and other related materials.

The proposed change order would allow for the construction of a 1.5-million-gallon tank at the City's Boothe property. Well 13 would feature a welded steel tank, and the project would also involve the installation of booster pumps to improve system reliability and stability. Staff w ould collaborate with Hartzell to gather bids from various tank manufacturers and determine the most cost-effective method for procuring the tank and other necessary components.

The city’s finance director conducted a thorough analysis to evaluate the feasibility of the project. Although building the tank will be expensive, the city has sufficient water enterprise reserves to complete the project while maintaining a healthy reserve for emergencies or unforeseen expenses. This also accounts for the rate subsidy approved by the council. Once a firm price for the change order is obtained, the staff will present the item back to the council for authorization to endorse the agreement.

Fiscal Impact:

This change order would be financed by the W ater Enterprise reserve fund. As outlined in attachment #2, its estimated cost is between $3.7 million and $4.2 million.
