DATE: April 15, 2025

SUBJECT: Approval for Travel Expenses Exceeding $500.00 per participation for Mayor Medina, Council Member Reyna , and City Manager M. Scott Hurlbert to attend the League of California Cities City Leaders Summit on April 23 – April 25, 2025, in Sacramento, California.

Recommendation:

Staff recommends the City Council:
1) Approval for Travel Expenses Exceeding $500.00 per participation for Mayor Medina, Council Member Reyna, and City Manager M. Scott Hurlbert to attend the League of California Cities City Leaders Summit on April 23 – April 25, 2025, in Sacramento, California; and

2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378; no environmental review is required.

Environmental Review:

The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA). It has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

Discussion:

The League of California Cities City Leaders Summit is an event where city officials can influence policy in the Capitol and gain leadership skills and offers city officials exceptional opportunities to meet with legislators to advocate for cities’ top priorities, as well as participate in peer -to-peer discussions and in -depth sessions covering topics ranging from leadership issues facing cities. The preliminary conference schedule for the League of California Cities City Leaders Summit is attached.

STAFF REPORT

Luis Villa, Public Works Director

DATE: April 15, 2025

SUBJECT: Adopt a Resolution Authorizing the City Manager or Designee to Sign a Letter Authorizing the County of Kern as the Lead Agency to Submit to the California Department of Resources Recycling and Recovery (CalRecycle) a Regional Application for the Used Oil Payment Program (OPP) Fiscal Year 2025-26 on its behalf.

Recommendation:

Staff recommends the City Council:
1) Adopt a resolution authorizing the City Manager or Designee to sign a letter authorizing the Count y of Kern as the lead agency to submit to CalRecycle a regional application for the used oil payment program fiscal year 202 5-26 on its behalf.

2) Find that the Project qualifies as categorically exempt pursuant to Section 15308 (actions by Regulatory Agencies for Protection of the Environment) of the CEQA Guidelines; no environmental review is required.

Environmental Review:

Staff has reviewed and find the Project for compliance with the California Environmental Quality Act (CEQA) qualifies for a Class 8 categorically exempt pursuant to Section 15308 (actions by Regulato ry Agencies for Protection of the Environment) of the CEQA Guidelines, which exempts actions taken regulatory agencies by state or local ordinance, to assure the maintenance, restoratiom, enhancement, or protection of the environment where the regulatory process involves procedures and protections of the environment. Thus, no environmental review is required.

Background:

The City has historically opted into the regional application for the used oil payment program with the County of Kern.

STAFF REPORT
City of Wasco

24 of 108
Discussion:

It is in the best interest of the City to authorize the County of Kern to be the lead agency and submit an application on the City of Wasco's behalf for funding to CalRecycle for the support and marketing of used oil recycling centers within the City limits. The City has authorized the County previously and is required to do so on an annual basis.

Public Resources Code 48600 et seq. describes the California Oil Recycling Enhancement Act (Act), which provides for, among other things, funding to assist local governments in developing and maintaining an ongoing used oil and used oil filter collection/recycling program for their communities. In 2009, Senate Bill 546 (Lowenthal, Chapter 353, Statutes of 2009) was enacted and made various changes to the Act, in cluding: changing the funding from a reimbursable grant program (formerly known as the Used Oil Block Grant Program [UBG]) to a payment program (referred to as the Used Oil Payment Program [OPP]). As the lead agency, the County manages and oversees the use d oil recycling program. This program consists of the operation and oversight of certified used oil collection centers in Kern Unincorporated areas and within the participating jurisdictions.

The County also provides advertisement and promotion of the program, submits required reporting to the State, and covers other administrative responsibilities. The County has larger staffing resources and capacity than the City to monitor and implement the used oil recycling program; therefore , staff recommends the Ci ty opt into the regional application as it has historically done.

Staff has reviewed the proposed Project for compliance with the California Environmental Quality Act (CEQA) and has determined that this Consultant Service Agreement is not a project under CEQA Section 15378 (b) as it is for grant writing activities that do not result in any physical changes to the environment. Thus, no environmental review is required.

Background:

The City is pursuing grant funding for several capital and construction projects in our adopted Capital Improvement Program. These projects include the construction of a new Civic Center, Police Station, Animal Control Facility, Public Works Yard, Transit Facility, and Water Wells.

City staff have successfully obtained grants and have recently implemented a few (i.e., Central Park, Phase I: 7th Street, Veterans Park, PAL Building), while still having several major grants/projects that require execution, such as the State Water Board Agreement for $37.9 million, CMAQ/RSTP (Fillburn/Central Project) for $ 3.1 million, and the Regional Early Action Program Grant for Alley Reconstructio n totaling $750,00.00. These will

demand significant staff time and project management to implement and secure reimbursements according to the guidelines. Due to limited staffing capacity, we propose bringing in Consulting, Inc. to assist with grant writing and securing competitive grants for these major projects that still need funding, ensuring they reach completion.

Discussion:

California Consulting, Inc., founded in 2004, is a full-service grant writing firm specializing in grant research and ident ification. The services provided include grant writing and submission on a per-task order basis for competitive grants focused on funding the major construction projects in the Adopted Capital Improvement Program. The agreement's term is month -to-month, a nd either party may terminate it with 30 days' prior written notice.

The attached draft Consultant Service Agreement is subject to final review by the City attorney and the Consultant.

Fiscal Impact:

Staff requests that the city council allocate $30,0 00 in the FY26 Budget for Professional Service Grant Writing to support this proposal.

TO: Honorable Mayor and Council Members

FROM: M. Scott Hurlbert, City Manager
Charlie Fivecoat, Chief of Police

DATE: April 15, 2025

SUBJECT: Adopt a Resolution Authorizing the City Manager or designee to finalize and endorse an agreement with Teeter Architects & Engineers Connected for Professional Architectural Services for the new Wasco Police Building Project.

Recommendation:

Staff recommends the City Council:
1) Adopt a Resolution Authorizing the City Manager or designee to finalize and endorse an agreement with Teeter Architects & Engineers Connected for Professional Architectural Services for the new Wasco Police Building Project; and

2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.

Environmental Review:

Staff has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA). It has been determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because it consists of a governmental fiscal/administrative activity that does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

Discussion:

Escrow closed in early March of 2025 for the purchase of property selected for the new City Hall and Police Department complex. The next phase of the project includes the creation of a basic site plan to be used for future design detail and construction process RFPs and is intended to also assist with additional grant funding opportunities as they arise.

Staff have discussed the need to move existing utilities at the project site and intend to use the basic site plan to help facilitate the utility relocation effort. Teeter Architectural & Engineers Connected has been highly recommended to assist with the basic site project

design and has a proven history within the City of Wasco for services provided to the elementary school district along with other municipalities in the San Joaquin Valley.

The proposed Professional Services Agreement would provide for specific work to be completed pursuant to Task Orders. Initially, the basic site plan design proposal, submitted by Teeter Architectural & Engineers Connected, includes stakeholder meetings used to generate two site plan sketches. One of the plans, based on the stakeholder feedback, will then be revised to complete and present a final master plan as a computer generated 2D graphic. This task order is estimated at a cost of $23,000 - $28,000.

There is also an optional service to create a 3D Graphic of the site master plan with a conceptual exterior design for each building. The 3D Graphic image may be important for various presentations and grant proposals. This work would be a separate Task Order at a cost of $12,000 – $14,000.

Staff recommends approval of the Professional Services Agreement and up to $45,000 in Task Order costs.

Fiscal Impact:

Engineering services will be paid based on time and materials from the adopted FY 2023/2024 CIP budget. No budget action is required with approval of this item.

R
ecommendation:

Staff recommends the City Council:
1) Adopt Resolution Approving the Amended Employment Agreement between Alberto Martinez Deputy Public Works Director, Water Operations, and the City of Wasco.
2) F
ind the subject activity is not a project within the meaning of CEQA Guidelines Section 15378 and is, therefore, not subject to review under CEQA.

E
nvironmental Review:

The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guide lines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

ackground:

At the time the Deputy Public Works Director classification was established and filled, the Administrative/Executive Leave benefit was set at fifty -six (56) hours per year. City of Wasco

Discussion:

The City proposes updating Section 9 Letter B No. 2 Letter C of the Employment Agreement identified as Administrative/Executive Leave to better match the terms and conditions provided to the City’s other executive employees.

The current language in the Employment Agreement reads:

“(c) Administrative/Executive Leave. Employee shall be entitled to fifty -six (56) hours of administrative leave per year which shall be provided on the same terms and conditions as provided to the City’s other executive employees. In the event of termination of this Agreement, Employee shall be entitled to payment for any unused Administrative Leave.”

The Amended paragraph is proposed to Read (emphasis added):

“(c) Administrative/Executive Leave. Employee shall be entitled to eighty (80) hours of administrative leave per year, which shall be provided on the same terms and conditions as provided to the City’s other executive employees. On each anniversary of this agreement, or in reasonable proximity to same as determin ed in the sole discretion of the City Manager but not to exc eed two weeks of each year, Employee shall be required to “cash out” any accrued but unused administrative leave at Employee’s then-current hourly rate of compensation. In the event of termination of this Agreement, Employee shall be entitled to payment for any unused Administrative Leave.”

No other changes to the Employment Agreement are proposed.

Fiscal Impact:

Sufficient funds exist in the adopted FY 2024/2025 Operating Budget to cover t he additional twenty-four (24) hours of Administrative / Executive Leave. No budget action is required with approval of this item.

Wasco Municipal Code states:
“2.04.130 Powers and duties--Appointment and removal.

It shall be the duty of the city manager to and he shall appoint, remove, promote and demote any and all officers and employees of the city excepting elected officers and the city attorney. TO: Honorable Mayor and Council Members

FROM: M. Scott Hurlbert, City Manager
Maria Lara, Assistant City Manager

DATE: April 15, 2025

SUBJECT: Adopt a Resolution Authorizing the City Manager or designee to develop, finalize and endorse all documents and agreements necessary to make full utilization of Rule 20A Power Line Undergrounding funds allocated to the City of Wasco.

Recommendation:

Staff Recommends the City Council:
1) Staff recommends adopting a resolution authorizing the City Manager or designee to develop, finalize and endorse all documents and agreements necessary to make full utilization of Rule 20A Power Line Undergrounding funds allocated to the City of Wasco.

2) Find that this Consultant Service Agreement is not a project pursuant to CEQA Section 15378 (b).

Environmental Review:

Staff has reviewed the proposed Project for compliance with the California Environmental Quality Act (CEQA) and has determined that this Consultant Service Agreement is not a project under CEQA Section 15378 (b) as it is for grant writing activities that do not result in any physical changes to the environment. Thus, no environmental review is required.

Background:

The California Public Utilities Commission (CPUC) and utility operators such as Pacific Gas and Electric (PG&E), through CPUC Rule 20A, established a surcharge to fund undergrounding of overhead power lines. For many years, the fees were collected and allocated to each jurisdiction for this purpose.

More recently, it was decided that the Rule 20A program would be wound down and eventually eliminated. Jurisdictions with any remaining allocation were prompted to submit qualifying projects to use the funds, or unused balances would be swept into a pool for reallocation to other, approved projects.

STAFF REPORT
City of Wasco

79 of 108
The City of Wasco submitted an undergrounding project in anticipation of our Police Department, City Hall, and Council Chambers project, just south of the existing City Hall building. This project is considered critical to the safety, efficiency, and aesthetic quality of our planned Municipal Services Campus. At the time, our project was rejected. An amended version of the application was submitted and reviewed but also was rejected for not fully meeting the requirements of the program. Subsequent to that rejection, the City closed escrow on the project property.

During the last 2 -3 months, the City filed a protest on the decision. With lobbying assistance and support from a number of elected officials, our revised project information was reconsidered. On April 8, 2025 PG&E provided a response to the City Protest. With full site control now in hand, the project has been accepted and reallocation of the City’s Rule 20A funds has been reversed. Below is a summary of the City’s Work Credit balance.

Discussion:

A number of time-sensitive steps must now be taken to ensure these funds are secured.

The steps include adoption of a resolution and potentially adoption of an ordinance. At the time of publication of this staff report and agenda, some of the requirements are still under discussion with PG&E and the CPUC. An updated version of the required Resolution may be presented at the meeting for review.

Fiscal Impact:

A fiscal impact has not been identified at this time. Expenses related to the engineering and design of the Rule 20A undergrounding project will be charged to the Police Department CIP Project. No immediate budget action is required with approval of this item.

Energy Division Tariff Unit:

P
ursuant to General Order 96- B, General Rule 7.4.3, PG&E submits these reply comments in support of Advice Letter 7533- E. The purpose of Advice 7533- E is to propose reallocations of Electric Rule 20A work credits.

B
ackground
O
n March 10, 2025, PG&E submitted Advice 7533- E to propose work credit reallocations to Active Rule 20A Projects in accordance with the reallocation prioritization requirements of D.23- 06-008 (the Decision). In Advice 7533- E, PG&E proposed reallocating 44.7M in work credits from 73 inactive communities within PG&E’s service territory to 22 projects in active communities meeting the prioritization criteria described in the Decision. PG&E provided a detailed breakdown of all the proposed reallocations and described the prioritization methodology it used to determine which projects should receive reallocation. Advice 7533-E fully complied with the Decision.

S
ummary of Protests and Res ponses
Four
parties submitted protests and responses to Advice 7533- E: the city of Marysville (Marysville), the city of Wasco (Wasco), the city of Novato (Novato), and the Public Advocates Office at the California Public Utilities Commission (Cal Advocates).

Below is a high-level summary of each of their protests and responses:

M
arysville
Marysville takes issue with the fact that Advice 7533-E does not show the existing work credits of each community that will be receiving reallocated work credits. Marysville notes that even if it receives the maximum reallocation proposed by PG&E in Advice 7533-E, it will still hav e a deficit of work credits for its existing Rule 20A project.

Accordingly, Marysville requests PG&E provide a “current work credit balance” column 83 of 108
PG&E Reply to Protest of
Advice Letter 7533-E
- 2 - April 8, 2025

and recalculate the funding gaps for the 14 communities that were not fully funded.

Marysville notes that “perhaps there is a chance that [a] project’s funding gap is such that it is infeasible to continue …[and an] agency would be willing to forgo their reallocation and let another agency who’s project is more feasible.” 1 Wasco

In its protest, Wasco provides information about a design for a new civic center and recently purchased land and asks PG&E to reconsider reallocating its work credits in Advice 7533- E. Wasco states that the new civic center will include a new police headquarters, city hall, and council chambers. According to Wasco, approximately 550 feet of current overhead electric facilities in the area could potentially cause back feed service issues and will negatively impact the efficiency of the new facilities as well as access by the public. To address these concerns, Wasco would like to use its current Rule 20A work credit balance to move the overhead electric facilities underground.

Wasco’s protest is supported by a letter from California State Senator Melissa Hurtado.

Novato

Novato argues that its proposed Novato Blvd Rule 20A project meets the prioritization criteria described in the Decision and, therefore, the city should receive work credit reallocation. According to Novato, the project is necessary to enable the city, the North Marin Water District, and the Novato Sanitary District to complete improvements on Novato Blvd. The city’s project proposes to widen Novato Blvd. to accommodate traffic safety improvements, storm drain and water quality improvements, and the addition of bike lanes and sidewalks. Novato provides a lengthy history of the Novato Blvd. project and the city’s interactions with PG&E relating to the scope and cost of that project.

Ultimately, Novato’s executed Work Progress Agreement (WPA) with PG&E for this project shows that $1,540,646.70 in reallocation credits, or independent funds, is needed for this project to be fully funded.
2 Cal Advocates

In response to Advice 7533- E, Cal Advocates urges the Commission to request additional information from PG&E or limit the reallocation amounts proposed. Cal Advocates opposes PG&E’s proposal to reallocate all remaining Rule 20A work credits , arguing that this approach would undermine the Commission’s intent to lower costs to ratepayers. Cal Advocates notes that neither San Diego Gas & Electric Company nor Southern California Edison reallocated all available work credits from inactive communities. Next, Cal Advocates criticizes PG&E’s decision to fully fund eight existing Rule 20A projects through reallocation rather than requesting funds directly from these communities. Finally, Cal Advocates recognizes that PG&E appropriately described its

methods for reallocation before requesting the following additional information: (1) the current work credit balance of communities receiving reallocation, (2) PG&E’s reallocation cap determination, (3) how PG&E determined which communities would receive the work credit allocation cap, (4) a description of PG&E’s communications with communities receiving proposed reallocations, and (5) information on whether communities receiving proposed reallocations intend to complete their Rule 20A projects.

Reply t
o Protests and Responses

PG&E’s responses to the protests and responses submitted by Marysville, Wasco, Novato, and Cal Advocates are set forth below.

Reply to Marysville

Although not required by the Decision, PG&E agrees with Marysville that providing the existing work credits for the proposed recipients of work credit reallocation would be beneficial and adds additional transparency. While Rule 20A community work credit balances are already publicly available in PG&E’s annual Rule 20 report, providing this information in the Advice Letter would provide better context for how PG&E determined reallocation amounts. PG&E will provide a supplemental to Advice Letter 7533-E, which will include the existing work credit balances for all the proposed recipients.

Reply to Wasco

Wasco first approached PG&E regarding the project discussed in its protest in approximately 2023. At that time, the civic center was in concept only with no city funds committed towards this effort. The request from Wasco was to remove the poles to facilitate easier ingress/egress for first response vehicles such as police. For overhead to underground requests to qualify for Rule 20A, the project must meet one of five public interest criteria. Because the civic center was only in concept , and ingress/egress considerations were not a Rule 20A public interest criterion, this project was denied for Rule 20A treatment.

Wasco’s protest provides new information that was not previously disclosed to PG&E, specifically the designing of the new civic center and a recent purchase of land towards these efforts. With this new information, PG&E agrees that this project now meets the Rule 20A public interest criteria four: “The street or road or right -of-way adjoins or passes through a civic area or public recreation area or an area of significant scenic, cultural, and/or historic interest to the general public.”

Accordingly, PG&E will provide a supplemental to Advice Letter 7533-E, removing Wasco’s work credits for reallocation purposes. However, Wasco will remain inactive until an ordinance is adopted per Rule 20 Tariff Section A. 1.b to “creat[e] an underground district in the area in which both the existing and new facilities are and will be located…” Failure to follow the ordinance adoption procedures listed in the Rule 20 Tariff will result 85 of 108

in Wasco’s status remaining inactive and work credits subject to expiration on June 8, 2025.

Reply to Novato

PG&E does not dispute the City of Novato’s argument that its proposed Novato Blvd Rule 20A project meets the prioritization criteria described in the Decision. Novato does meet the definition of underserved as their last completed project occurred prior to 2004. However, the location of the project is not considered disadvantaged by the definition set by the CPUC.
3 PG&E considered many different approaches to reallocation and ultimately chose to propose reallocating work credits to all communities who met both priorities as we felt that this approach was the best aligned with the Commission’s stated goals in the Decision.

Reply to Cal Advocates

PG&E believes that the protest from Cal Advocates is without merit. PG&E’s reallocation proposal is within the scope of the Commission order and aligns with the purpose of reallocation to “ counteract the historical inequitable distribution of Rule 20A funds.”4 PG&E ’s proposal is to reallocate work credits to communities that meet both priority community definitions set in D.23-06-008.

Cal Advocates’ argument that PG&E’s proposed reallocation of $44.3 million of available work credits undermine s the Commission’s intent to lower costs to ratepayers is inaccurate. Cal Advocates ’ opposition to reallocation and recommendation for the immediate sunset of the Rule 20A program was previously acknowledged by the Commission in D.23-06-008. After this acknowledgement, the Commission ordered the utilities to propose reallocation through a Tier 2 Advice Letter or inform the Commission that a reallocation will not be proposed through a Tier 1 Advice Letter. The Commission stated in D.23-06-008 that “[t]his decision does not increase the number of Rule 20A work credits available for reallocation or otherwise increase the ratepayer funding available for Rule 20A projects.”

Second, Cal Advocates recommends that PG&E’s reallocation proposal align with other utilities, while failing to recognize that the utilities face different circumstances. San Diego Gas & Electric chose not to propose reallocation of work credits, “given that any remaining work credits are minimal and would not be enough to fully fund a project.” 5 SCE’s reallocation proposal fully funded all Rule 20A projects that need additional work

credits including communities that are not considered priority communities. 6 In PG&E’s case, there are more communities with work credit needs than work credits available for reallocation. PG&E’s proposal fully fund ed 8 communities and partially funded the remaining 14. For those 14 communities, further discussions need to take place to determine how they want to address work credit shortfall s. Options include scope reduction, exercising their option to contribute financially to any Rule 20A project that has insufficient work credits for completion7, or cancelling the project.

Cal Advocates ’ contention that communities having the option to contribute financially to any Rule 20A project fails to acknowledge that reallocation was meant to address the existing barrier to entry for smaller and disadvantaged communities. Both reallocation of work credits and contributing financially to a Rule 20A Project are options in D.23-06-008.

Specific to Cal Advocates request for additional information, PG&E will be providing a supplemental Advice Letter 7533-E, which will include the existing work credit balances for all the proposed recipients and remaining work credit need after reallocation.

Regarding the method utilized for establishing the cap, because there were insufficient work credits to fully fund all the communities that met both priorities, a process needed to be established to determine how the work credits would be distributed. First, the communities are sorted with smallest need to largest need for reallocation. Second, a cap alternative is established for each row. The cap alternative is the remaining work credits available for reallocation divided by the number of remaining communities to be funded. The full reallocation need is funded if the relocation need is smaller than the cap alternative. Once the cap alternative is the smaller of the two, the cap is established for the remaining communities.

To illustrate this, 8 million work credits are available for reallocation in the example below. Communities A, B, and C receive full reallocation need because their need is smaller than the cap alternative. However, with Community D, because the cap of 1.6 million is smaller than the need of 2 million, the cap is set to 1.6 million for Community D, E, and F.

On the topic of communication, PG&E has had multiple communication with all 266 participating communities regarding reallocation. PG&E provides email updates to a list of approximately 800 email addresses regarding any major regulatory activity and has hosted two webinars specific to sunsetting of the Rule 20A Program and reallocation.

PG&E can confirm that proposed recipients for reallocation do not have the means to self- fund the gap between current estimate and their work credit balance.

Conclusion

PG&E appreciates the community engagement and the Commission’s consideration of Advice 7533-E . As noted above, while the original Advice 7533- E met the requirements of D.23 -06-008, PG&E will submit a supplemental Advice Letter that removes Wasco's work credits from reallocation in response to the additional information provided by that city. As a result, PG&E will propose the reallocation of 43.4M work credits from 72 inactive communities. The proposed reallocation cap will be 2,132,527.54 work credits, which will allow seven projects to be fully funded and 15 additional projects will either require a scope reduction and/or financial contribution to close the gap between the projects’ expected costs and available work credits.

Advice 7533-E-A
(Pacific Gas and Electric Company ID U 39 E)
Public Utilities Commission of the State of California
Subject: Supplemental: Proposal of Reallocations of Electric Rule 20A Work Credits
Purpose

Pursuant to Ordering Paragraph (OP) 5 of Decision (D.) 23-06-008 (the Decision), Pacific Gas and Electric Company (PG&E) hereby submits to the California Public Utilities Commission (Commission or CPUC) this Tier 2 Advice Letter (AL) as a supplemental to replace the original Advice 7533-E in its entirety. The purpose of this supplemental AL is to update the proposed reallocations of Electric Rule 20A work credits1 in the original AL to withhold the city of Wasco’s Rule 20A work credits for a proposed project that meets the public Interest criteria . While the reallocation figures have been updated in this supplemental AL , PG&E’s reallocation approach and prioritization methodology , as described in the original Advice 7533-E, have not been altered.

Background

As required by D.23-06-008, each utility is to file a Tier 2 advice letter within 18 months of the effective date of the Decision to propose work credit reallocations to Active Rule 20A Projects in accordance with the reallocation prioritization requiremen ts of the Decision. On November 19, 2024, PG&E requested a 90 -day extension to give certain communities an opportunity to propose new Rule 20A Projects to avoid having their Rule 20A work credits reallocated. On November 27, 2024, the CPUC informed PG&E that the 90-day extension request was granted.

1 The advice letter has been updated to include the existing work credit balances and to reflect the total proposed reallocation amount of 43.4 million for 72 inactive communities, including the removal of work credits for Wasco, resulting in a decrease for the reallocation cap from 2,222,333.59 to 2,132,527.54. The number of fully funded projects has decreased by one (new total is 7), while the number of projects requiring additional funding has increased by one (new total is 15). Updates to attachments A an d B have also been made. In Attachment A, the total number of work credits proposed for reallocation for 15 projects that will require a scope reduction and/or additional financial contribution has been updated, along with two typographical error corrections. In Attachment B, the total number of credits proposed for reallocation from inactive communities has been updated.

Advice 7533-E-A - 2 - April 8, 2025

On March 10, 2025, PG&E submitted the original Advice 7533-E proposing Rule 20A work credit reallocations, and four parties submitted protests in response. The city of Novato (Novato) argued that it should be prioritized for work credit reallocations for its Novato Blvd. project.2 The city of Marysville (Marysville) requested additional information about work credit balance s of communities to receive reallocated work credits .3 The Public Advocates Office at the California Public Utilities Commission (Cal Advocates) criticized PG&E’s choice to reallocate all remaining Rule 20A work credits from inactive communities and asked for additional information .4 And the city of Wasco protested the original Advice 7533-E by providing information about a design for a new civic center and recently purchased land and asked PG&E to reconsider reallocating its work credits.

On April 8, 2025, PG&E responded to the protests with additional information5 and agreed not to reallocate Wasco’s Rule 20A work credits, as originally indicated. PG&E recognized that additional consideration was appropriat e due to the new information that the city provided, more specifically the designing of the multi-facility Civic Center and the recent purchase of land supporting these efforts. With this new information, the proposed project now aligned with Rule 20A public interest criteria four—the street adjoins or passes through a civic area or public recreation area or significant scenic, cultural and/or historic interest to the general public.

With Wasco’s original project now qualifying for Rule 20A treatment, PG&E had to adjust the Rule 20A work credit reallocations proposed in the original Advice 7533 -E. The new calculations are presented in this supplemental AL and in the attachments included with this submission.

Discussion

PG&E proposes the reallocation of 43.4M in work credits from 72 inactive communities within PG&E’s service territory to 22 projects in active communities meeting the prioritization criteria described in the Decision, as shown in the summary table below. For additional details, please see Attachments A and B to this AL. Attachment A contains the required information listed in Attachment A of the Decision, and Attachment B provides an accounting of all inactive communities and final work credit balances to be reallocated with totals, as required by OP 5(b) of the Decision.

* All project costs have been escalated to expected project start year. ** Project delineating ESJ and non-ESJ communities has been included for reallocation. *** Work credit balance includes 1.5 million work credit donation from Nevada County.

In making this reallocation, PG&E recognizes that there are more proposed projects needing additional work credits than work credits available for reallocation. More specifically, municipalities within PG&E’s service territory have passed resolutions for 154 projects that will not move forward unless the work credit gap is addressed.

Accordingly, to determine which projects should receive reallocation pursuant to the Decision, PG&E followed the prioritization methodology described in detail below.

A. Updating Project Costs
To identify potential Rule 20A projects to receive work credit reallocation, PG&E first needed to update project cost estimates for the full queue of proposed projects in the service territory. Prior to this reallocation effort, proposed Rule 20A projects in the queue were at different phases of the design and scoping process. Also, some of the proposed 92 of 108
Advice 7533-E-A - 4 - April 8, 2025

Rule 20A projects in PG&E’s queue were proposed by municipalities m any years ago , and costs for labor and materials have changed . Accordingly, not all PG&E’s cost estimates for these proposed Rule 20A projects were still accurate.

To update the proposed project cost estimates, PG&E developed a project cost calculator tool. The tool perform ed linear regression analyses on quantitative characteristics (e.g. trench length ) and qualitative variables (e.g. geographic settings ) from 37 Rule 20A projects completed from 2019 to 2023 to identify which combinations yield ed the least uncertainty in predicted cost estimate s for each project. The tool then used this data to obtain m ore accurate cost estimates by seeking out combinations that minimize d the magnitude of potential variances . Recalculating project costs using this tool was more efficient than individually designing all projects for estimating purposes.

After identifying the updated project costs, PG&E developed a multiyear , Rule 20A workplan for proposed future work. The workplan was informed by the expected Rule 20A program budget in future years, project queue, project financial forecast by month, and forecasted project durations. Creating the workplan also allowed PG&E to forecast what year(s) project costs would be incurred so that the appropriate cost escalation factors could be applied.

B. Reviewing the Priority Criteria
After recalculating the Rule 20A project costs in the queue, PG&E reviewed which projects require additional work credits to see if the projects meet one or both priority criteria outlined in OP 4 of the Decision. The priority criteria were defined in the Decision as (1) active Rule 20A Projects located in a city, unincorporated county, or tribal jurisdiction that has not completed a Rule 20A project since 2004 or (2) Active Rule 20A Project where at least 50 percent of the main line trench distance will be located within Environmental and Social Justice Community census tract(s).

PG&E sorted the projects into three groups based on the number of priority criteria met by the project scope—i.e., no priority criteria, one priority criteria, or both priority criteria.

Upon sorting the proposed projects, PG&E discovered that the total reallocation need for projects meeting both priority criteria was greater than the total work credits available for reallocation.

Ultimately, PG&E chose to propose reallocation only to the group of projects meeting both priority criteria outlined in the Decision and not to projects meet ing one or no priority criteria.

C. Reallocation Cap
Among the Rule 20A projects meeting both priority criteria, there was a wide range in the number of work credits needed to complete the project scope of work. For example, the smallest need for reallocation to cover additional costs was 646K in work credits while the largest need was 11.2M in work credits.

93 of 108
Advice 7533-E-A - 5 - April 8, 2025

Given this disparity, PG&E set a reallocation cap so that all proposed projects within the group of projects meeting both criteria would receive some reallocation. PG&E determined that this cap should be up to 2,132,527.54 in work credits. This reallocation cap will allow 7 projects to be fully funded. 15 additional projects will either require a scope reduction and/or additional financial contribution to close the gap between the projects’ expected costs and available work credits.

Protests

Pursuant to GO 96 -B, General Rule 7.5.1, PG&E respectfully requests that the original protest and comment period designated in Advice 7533-E be maintained and that the protest period not be reopened. The rationale for this request is that the reallocation approach and prioritization methodology, as described in the original Advice 7533-E, have not been altered.

Effective Date

Pursuant to General Order (GO) 96 -B, Rule 5.2, and OP 5 of D.23-06-008, this advice letter is submitted with a Tier 2 designation. PG&E requests that this Tier 2 advice submittal become effective on, April 9, 2025, which is the original requested effective date in AL 7533-E.
