FROM: M. Scott Hurlbert, City Manager

DATE: June 17, 2025
SUBJECT: Approval of Travel and Training Expenses Exceeding $500.00 per trip for one-half of City Attorney Thomas F. Schroeter's registration fee s and one night's hotel stay to attend the League of California Cities Annual Conference and Expo held o n October 8- 10, 202 5, in Long Beach , California, not to exceed $596.50.
Recommendation:
Staff recommends the City Council:
1) Approve the travel expenses exceeding $500.00 per trip, one-half of the City Attorney's travel expenses for the registration, and one night's hotel stay to attend the League of California Cities Annual Conference and Expo held on October 8 - 10, 2025, in Long Beach, California, not to exceed $596.50; and
2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.
Environmental Review:
The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.
Discussion:
The City Attorney requests approval to attend the League of California Cities A nnual Conference and Expo on October 8-10, 2025, in Long Beach, California. The registration fee is $675.00, and a two-night stay in the hotel is $ 259.00 per night. The conference will feature three days of presentations focused on legal issues affecting cities, as well as updates on recent cases decided during the event . This is a critical learning session for the City Attorney, reducing the time and effort required to research these matters

independently. The city contributes equally to these costs with the City of Tehachapi, resulting in the City of Wasco's proportional share being $596.50.
The cost of training and hotel fees will exceed the Expense and Use of Public Resources Policy limits established by City of Wasco Resolution No. 2006-2327, which limits expenses to $500.00 per trip.
As a result, the City Council will need to approve the travel request submitted by City Attorney Schroeter, as the expenses for the trip will exceed $500.00.
Fiscal Impact:
The City of Wasco's portion for the City Attorney to attend the League of California Cities Annual Conference and Expo is $ 596.50. The adopted FY 2024-25 Budget contains sufficient funding in the City Attorney account to cover this expense.

Memorandum : CITY OF WASCO
TO : City Council, City Manager DATE: JUNE 4, 2025
FROM : Thomas F. Schroeter, City Attorney
SUBJECT: League of California Cities Annual Conference
The League of California Cities Annual Conference will be held on October 8-10, 2025 in Long Beach. The registration fee is $675.00 and a two-night stay in the hotel is $259.00 per night. During the conference, there will be three days of presentations devoted solely to legal issues facing cities and updates on cases recently decided. This is a critical learning session for city attorneys and reduces the time and effort needed by the City Attorney to research these matters on his or her own.
My other city is being asked to contribute equally to the cost for the registration fee and one night's lodging. The City's share of the expenses would be $596.50. I would request permission to represent the City of Wasco at the Annual League Conference and for the City to pay up to $596.50 for my expenses.

Environmental Review:
The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

Government Code Section 53646(a) requires that the Chief Financial Officer or City Treasurer must present a Statement of investment policy annually to the governing body or an investment commi ttee. All funds will be invested in accordance with the City’s Investment Policy and California Government Codes which regulate municipal governments. An investment policy should identify the parameters of the investment function, with the primary objectives being safety, liquidity, and yield, in that order.
(1) Safety – safety of principal is the foremost objective of the investment program; (2) Liquidity – the investment portfolio will remain liquid to enable the City to meet cash flow needs;
(3) Yield – the portfolio shall be designed with the objective of making a rate of return consistent with the safety and liquidity objectives. The ultimate goal is to maximize return of investment income and simultaneously ensure the safety of the funds being invested.
34 of 144
The three features above (safety, liquidity , and yield) are satisfied by the City’s present policy, including a section on periodic reporting of portfolio performance.

CITY OF WASCO
INVESTMENT POLICY Revised 6/2023
I. Introduction
The purpose of this document is to identify various policies and procedures that enhance opportunities for a prudent and systematic investment process and to organize and formalize investment-related activities. Related activities, which comprise sound cash management, include accurate cash flow projections, control of disbursements, expedient collection of revenues, cost effective banking relations and a short-term borrowing program, which coordinates investment opportunity with working capital requirements. The ultimate goal is to enhance the economic status of the City of Wasco while protecting its pooled cash resources.
The investment policies and practices of the City of Wasco are based on state law and prudent money management. All funds will be invested in accordance with the City's Investment Policy and the authority governing investments for municipal governments as set forth in the California Government Code, Sections 53601 through 53659. Any investment s of bond proceeds are to be restricted by the provisions of the relevant bond documents.
II. Scope
It is intended that this policy cover all funds and investment activities of the City. These funds are accounted for in the annual audited financial statements, and include:
O General Fund
O Special Revenue Funds
O Debt Service Funds
O Capital Projects Funds
O Enterprise Funds
O Internal Service Funds
O Fiduciary Funds
This investment policy applies to all City transactions involving the financial assets and related activity of the above-mentioned funds. Any additional funds that may be created from time to time shall also be administered with the provisions of this policy and comply with the current State Government Code.
III. Prudence (Standard of Care)
The City of Wasco operates its pooled idle cash investments under the prudent man rule (Civil Code Section 2261, et. seq.). In addition, Government Code Section 53600.3 provides that those persons to whom investment decisions have been delegated are trustees with a fiduciary responsibility to act as a prudent investor.
Investments shall be made with judgment and care - under circumstances then prevailing - which persons of prudence, discretion and intelligence exercise in the management of their own affairs, not for speculation, but for investment, considering the probable safety of their capital 38 of 144
EXHIBIT “A”
CITY OF WASCO
INVESTMENT POLICY Revised 6/2023
as well as the probable income to be derived. This affords a broad spectrum of investment opportunities as long as the investment is deeded prudent under current law.
The standard of prudence to be used by investment officials shall be the "prudent person" standard and shall be applied in the context of managing an overall portfolio. All persons investing, reinvesting, purchasing, acquiring, exchanging, selling and managing public funds shall act with care, skill, prudence and diligence under the circumstances then prevailing that a prudent person acting in a like capacity and familiarity with those matters would use in the conduct of funds of a like character and with like aims, to safeguard the principal and maintain the liquidity needs of the City.
It is the City's intent at the time of purchase to hold all investments until maturity to ensure the return of all invested principal dollars but sales prior to maturity are permitted.
IV. Objectives
A. Investment Criteria:
Government Code Section 53600.5 states: “When investing, reinvesting, purchasing, acqui
ring, exchanging, selling and managing public funds, the primary objective of the trustee shall be to safeguard the principal of funds under its control. The secondary objective shall be to meet the liquidity needs of the depositor. The third objective shall be to achieve a return on the funds under its control”.
Simply stated, safety of principal is the foremost objective, followed by liquidity and return on investment (known as yield). Each investment transaction shall seek to first ensure the capital losses are avoided, whether they are from market erosion or security defaults.
The primary objectives, in priority order, of the City's investment activities shall be:
1. Safety - S
afety of principal is the foremost objective of the investment program.
The City's investments shall be undertaken in a manner that seeks to ensure preservation of capital in the portfolio. The City shall seek to preserve principal by mitigating the two types of risk: credit risk and market risk. Investment decisions should not incur unreasonable credit or market risks in order to obtain current investment income.
a. Credit Risk: Defined as the risk of loss due to failure by the issuer of a se
curity
b. Market Risk: Defined as the risk of market value fluctuations due to overall changes in the general level of interest rates.
2. Liquidity - The City's investment portfolio will remain sufficiently liquid to enable the City to meet its cash flow requirements. An adequate portion of the portfolio 39 of 144
EXHIBIT “A”
CITY OF WASCO
INVESTMENT POLICY Revised 6/2023
should be maintained in liquid short-term securities which can be converted to cash and guarantee the City’s ability to meet operating expenditures.
3. Return on Investment (Yield) - The City's invest ment portfolio shall be designed with the objective of attaining a market rate of return on its’ investments consistent with the constraints imposed by its safety objective and cash flow considerations. Yield is to be a consideration only after the basic requirements of adequate safety and liquidity have been met.
B. Market Rate of Return
The investment portfolio shall be managed to attain a market average rate of return throughout budgetary and economic cycles. This takes into account the City’s cash flow requirements and investment risk constraints, state and local laws and ordinances or resolutions that restrict the placement of short-term funds.
C. Performance Standards
The investment portfolio shall be managed with the objective of producing a yield meeting or exceeding the average return on the one- year U.S. Treasury. This index is considered a benchmark for low to moderate risk investment transactions. Therefore, they comprise a minimum standard for the portfolio’s rate of return. The investment program shall seek to augment returns above this threshold, consistent with risk limitations identified herein and prudent investment principles. This benchmark will be reviewed thoroughly and may be adjusted as required by market conditions to prevent incurring unreasonable risks to attain yield.
D. Diversification
The investment portfolio shall be diversified to prevent incurring unreasonable and avoidable risks regarding specific security types, individual financial institutions or maturity segments.
E. Public Trust
All participants in the investment process shall act responsibly as custodians of the public trust. Investment officials shall recognize that the investment portfolio is subject to public review and evaluation. The overall program shall be designed and managed with a degree of professionalism that is worthy of the public trust.
V. Delegation of Authority
The management and oversight responsibility for the investment program in hereby delegated to the Chief Financial Officer or Treasurer who shall monitor and review all investments for consistency with this investment policy. The Finance Director and Treasurer are authorized to transfer City funds within the accounts established by the City that are held by financial institutions and depositories in order to ensure the daily cash flow needs of City operations. The Chief Financial Officer or Treasurer shall establish procedures to implement and monitor this 40 of 144

INVESTMENT POLICY Revised 6/2023
investment policy. Such procedures shall include explicit delegation of persons responsible for investment transactions. No person may engage in an investment transaction except as provided under the limits of this policy.
VI. Ethics and Conflict of Interest
Officers and employees involved in the investment process shall refrain from personal business activities that could conflict with proper execution of the investment program, or that could impair their ability to make impartial decisions.
VII. Selection of Financial Institutions and Broker/Dealers To provide for the optimum yield in the City's portfolio, the City's procedures shall be designed to encourage multiple bids and offers on investment transactions from an approved list of broker/dealers. The Chief Financial Officer or Treasurer shall maintain a list of authorized broker/dealers and financial institutions, which are approved for investment purposes, in the State of California, and it shall be the policy of the City to purchase securities only form authorized institutions or firms. The investment guidelines and procedures shall identify the criteria under which brokers and dealers may qualify to conduct business with the City.
In order to assist in identifying qualified financial institutions, the Chief Financial Officer or Treasurer shall forward copies of the City’s investment policy to those financial institutions with which the City is interested in doing business and will require written acknowledgment of the policy. In addition, all dealers approved to do business with the City shall receive a copy of the Investment Policy annually. Confirmation of receipt of this policy shall signify that the dealer understands the Investment Policy and intends to present only appropriate investments.
VIII. Permitted Investment Instruments
Allowable investment instruments are defined in the California Government Code Section 53600 et. seq., as amended. If the Code is further revised to allow additional investments or is changed regarding the limits on certain categories of investments, the City is authorized to conform to these changes, excluding those changes that may be prohibited by this policy.
Where Government Code Section specifies a percentage limitation for a particular category of investments, that percentage is only applicable at the date of purchase.
Investments may be made in the following instruments:
1. Government obligations pledged by the full faith and credit of the United States for the payment of principal and interest.
2. Obligations issued by Agencies or Instrumentalities of the U.S. Government.

Securities held in custody for the City shall be independently audited on an annual basis to verify investment holdings.
X Maximum Maturity
Investment maturities shall be based on a review of cash flow forecasts. Maturities will be scheduled so as to permit the City to meet all projected obligations.

As defined in Government Code Section 53601, “no investment shall be made in any security... that at the time of investment has a term remaining to maturity in excess of five years, unless the legislative body has granted express authority to make that investment either specifically or as a part of an investment approved by the legislative body no less than three months prior to the investment.” XI Ineligible Investments
Certain investments are prohibited under Government Code Sections 53601.6 and 53631.5.
Security types, which are prohibited, include, but are not limited to:
(a) "Complex" derivative structures such as range notes, dual index notes, inverse floaters, leveraged or deleveraged floating rate notes, or any other complex variable rate or structured note.
(b) Interest only strips that are derived from a pool of mortgages or any security that could result in zero interest accrual if held to maturity.
(c) Reverse Repurchase Agreements.
Purchasing these types of instruments does not coincide with this Policy’s objectives and would require a thorough review and monitoring of the underlying security.
Although some of these transactions are legal under Government Code, they do not meet the objectives contained herein.
By virtue of the allowable investment in the State or CLASS Pools, the City is investing idle cash with a large number of government agencies. The Pools are managed by outside administrators and are subject of the Government Codes as well as polices put in place by their governing boards. Either Pool’s investment policy may allow for investment in some of the prohibitions noted above for Wasco. Investment in the State and County Pools is permitted, assuming a diminutive portion of their portfolio (10% 44 of 144

GLOSSARY OF TERMS
Bankers' Acceptances - negotiable time drafts or bills of exchange drawn on and accepted by a commercial bank. Acceptance of the draft obligates the bank to pay the bearer the face amount of the draft at maturity. In addition to the guarantee by the accepting bank, the transaction is identified with a specific commodity. The sale of the underlying goods will generate the funds necessary to liquidate the indebtedness. Banker's Acceptances are usually created to finance the import and export of goods, the shipment of goods within the United States and the storage of readily marketable staple commodities. Banker's Acceptances are sold at a discount from par and the amount and maturity dates are fixed. Bankers' Acceptances have the backing of both the bank and the pledged commodities with no known principal loss in over 70 years. State law permits cities to invest up to 40% in bankers' acceptances.
Certificate of Deposit - A deposit insured up to $250,000 by the FDIC at a set rate for a specified period of time.
Collateral - Securities, evidences of deposit or pledges to secure repayment of a loan. Also refers to securities pledged by a bank to secure deposit of public moneys.
Corporate Medium-Term Notes - Unsecured promissory notes issued by corporations operating within the United States. The notes mature in one to five year periods. Purchase of these notes may not exceed 30% of the City's portfolio and the notes must have at least an "A" rating by a nationally recognized rating service.
Commercial Paper - An unsecured promissory note of industrial corporations, utilities and bank holding companies having assets in excess of $500 million and an "A" or higher rating for the issuer's debentures. Interest is discounted from par and calculated using the actual number of days on a 360- day year. The notes are in bearer form, mature from one to 270 days and generally start at $100,000. There is a secondary market for commercial paper and an investor may sell them prior to maturity. Unused lines of credit back commercial paper from major banks.
State law permits cities to invest up to 30% in commercial paper.
Credit Risk - Defined as the risk of loss due to failure of the issuer of a security. This loss shall be mitigated by investing in investment grade securities and by diversifying the investment portfolio so that the failure of any one issuer does not unduly harm the City's capital base and cash flow.
Current Yield - The interest paid on an investment expressed as a percentage of the current price of the security.
Custody - A banking service that provides safekeeping for the individual securities in a customer's investment portfolio under a written agreement which also calls for the bank to collect and pay out income, to buy, sell, receive and deliver securities when ordered to do so by the principal.

TO: Honorable Mayor and Council Members
FROM: M. Scott Hurlbert, City Manager
Maria Lara, Assistant City Manager
DATE: June 17, 2025
SUBJECT: Adopt a Resolution Approving an Application for Funding and Authorizing the City Manager or Designee to E xecute a Grant Agreement and any Amendments Thereto for Fiscal Year 2025 Regional Surface Transportation Program (RSTP) F unding, Committing the N ecessary Local Match, and Stating the Assurance to Complete the Griffith Avenue Project.
Recommendation:
Staff recommends the City Council:
1) Adopt a Resolution approving an application for funding and authorizing the City Manager or designee to execute a grant agreement and any amendments thereto for the Fiscal Year 2025 Regional Surface Transportation Program (RSTP) funding, committing the necessary local match, and stating the assurance to complete the Griffith Avenue Project; and
2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.
Environmental Review:
The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.
Discussion:
On March 20, 2025, the Kern Council of Governments’ (Kern COG) Board of Directors approved a Regional Surface Transportation Program (RSTP) call for projects. The Regional Surface Transportation Program (RSTP) was established by the Intermodal Surface Transportation Act of 1991 (1991 ISTEA, Public Law 102 -240). The RSTP program

can be used to maintain and improve the existing transportation system, expand the system to reduce congestion, and establish programs and projects that help the region reduce mobile emissions and meet federal air quality standards.
RSTP funds are reimbursable federal aid funds, subject to all the requirements of Title 23, United States Code. Eligible costs for funds under these programs include preliminary engineering, right -of-way acquisition, capital costs, and construction costs associated with an eligible activity.
The City of Wasco is requesting ($771,500.00) in RSTP funds for Griffith Avenue from Jackson to Margalo for the following:
• ADA Improvements, stripping, sidewalks, curb and gutter, signage, and asphalt rehabilitation along Griffith Avenue in various locations between Jackson Avenue and Margalo Street.
Griffith Avenue meets the minimum eligibility requirements for functional classification; it is a Major Collector Street and qualifies for the RSTP Federal funding program.
RSTP Program project applications are due by 5:00 PM on Thursday, July 17, 2025.
Fiscal Impact:
A minimum match of $88,492.00 (11.47%) is required and will be funded by Transportation Development Act (TDA) Local Transportation Funds (LTF).

expand the system to reduce congestion, and establish programs and projects that will assist the region in reducing mobile emissions and help meet federal air quality standards.
The purpose of the CMAQ program is to fund transportation projects or programs that will contribute to attainment of national ambient air quality standards with a focus on ozone, PM10, and their precursors, and precursors of carbon dioxide (CO2); PM2.5; volatile organic compounds (VOC); nitrogen oxides (NOx); and carbon monoxide.
The City of Wasco will request approximately $934,725.00 in CMAQ funds for Griffith Avenue East Shoulder Improvement Project from the Wasco Union Elementary School District, Maintenance, Operations, and Transportation (MO&T) Facility to Filburn Avenue (2201 Griffith Avenue to Filburn Avenue).
• This project will pave the dirt shoulder of the northbound lane on Griffith Avenue between the MO&T Facility and Filburn Avenue in the City of Wasco. Paving over existing dirt reduces PM -10 emis sions. Additionally, this project will install approximately 1,200 feet of curbs, gutters, ADA ramps, and sidewalks, as well as relocate PG&E power lines. Currently, there are no pedestrian or bicycle facilities along this segment of the northbound lane.
CMAQ Program project applications are due by 5:00 PM on Thursday, July 17, 2025.
Fiscal Impact:
A minimum match of $107,213.00 ( 11.47%) is required and will be funded by the Transportation Development Act (TDA) Local Transportation Funds (LTF).

TO: Honorable Mayor and Council Members
FROM: M. Scott Hurlbert, City Manager
Maria Lara, Assistant City Manager
DATE: June 17, 2025
SUBJECT: Adopt a Resolution Approving an Application for Funding and Authorizing the City Manager or Designee to E xecute a Grant Agreement and any Amendments thereto for F iscal Year 2025 Congestion Mitigation and Air Quality Program and/or Carbon Reduction Program (CMAQ) F unding, Committing the N ecessary Local Match, and S tating the A ssurance to Complete the Wasco Avenue East Shoulder Improvement Project.
Recommendation:
Staff recommends the City Council:
1) Adopt a Resolution approving an application for funding and authorizing the City Manager o r designee to execute a grant agreement and any amendments thereto for Fiscal Year 2025 Congestion Mitigation and Air Quality and/or Carbon Reduction Program (CMAQ) funding, committing the necessary local match, and stating the assurance to complete the Wasco Avenue East Should Improvement Project; and
2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.
Discussion:
On March 20, 2025, the Kern Council of Governments’ (Kern COG) Board of Directors approved a Congestion Mitigation and Air Quality (CMAQ) Program call for projects.
STAFF REPORT
City of Wasco
72 of 144
CMAQ funding can be used to maintain and improve the existing transportation system, expand the system to reduce congestion, and to establish programs and projects that will assist the region in reducing mobile emissions and help meet federal air quality standards. The purpose of the CMAQ program is to fund transportation projects or programs that will contribute to attainment of national ambient air quality standards with a focus on ozone, PM10, and their precursors, and precursors of carbon dioxide (CO2); PM2.5; volatile organic com pounds (VOC); nitrogen oxides (NOx); and carbon monoxide.
The City of Wasco is requesting $291,844.00 in CMAQ funds for improvements to the east shoulder of Wasco Avenue from the city limits to Poso Avenue. This includes, but is not limited to, asphalt pa ving, grinding, saw cutting, concrete, ADA improvements, and striping. Paving over existing dirt reduces PM-10 emissions.
CMAQ Program project applications are due by 5:00 PM on Thursday, July 17, 2025.
Fiscal Impact:
A minimum match of $33,475.00 (11.47%) is required and will be funded by Transportation Development Act (TDA) Local Transportation Funds (LTF).

TO: Honorable Mayor and Council Members
FROM: M. Scott Hurlbert, City Manager
Luis Villa, Public Works Director
DATE: June 17, 2025
SUBJECT: A dopt a Resolution Approving a List of Projects for Fiscal Year 202 5-26 Funded by SB 1: The Road Repair and Accountability Act of 2017
Recommendation:
Staff recommends the City Council:
1) Adopt a Resolution Approving a List of Projects for Fiscal Year 2025-26 Funded by SB 1: The Road Repair and Accountability Act of 2017; and 2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c) (3), no environmental review is required.
Environmental Review:
Staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.
Discussion:
SB 1 (Beall) was filed with the Secretary of State on April 28, 2017 and is now going to be entering into its eighth year. This bill establishes a Road Maintenance and Rehabilitation Account (RMRA) in the State Transportation Fund, intended to address deferred maintenance on the state highway system and local street and road systems. The bill also requires the California Transportation Commission (CTC) to adopt criteria to ensure efficient use of these funds.
After reviewing the City's current Pavement Condition Index (PCI) map, along with the current outlook for Street Projects funded by other sources and the budget outlook for SB1 Funds, it was determined that Gromer Avenue from Poplar to Annin and Beckes from
STAFF REPORT
City of Wasco
78 of 144
HWY 46 to 5 th Street would be good locations for full road rehabilitation Projects. Along with these two Projects, Staff would also like to include the various roadways in the Northeastern Zone (Project #23019) for miscellaneous pavement treatments in our 2025- 26 SB1 Project List.
It is worth noting that these are the same Projects submitted last Fiscal Year, but Staff is allowing the account balances to increase to an amount that will allow the Projects to be executed.
The reason for recommending approval of the attached resolution is to satisfy the requirements of SB 1 relative to holding local governments accountable for the efficient investment of public funds to maintain p ublic streets and roads, and especially the following addition to the Streets & Highways Code: (a) (1) Prior to receiving an apportionment of funds under the program pursuant to paragraph (2) of subdivision (h) of Section 2032 from the Controller in a fiscal year, an eligible city or county shall submit to the commission a list of projects proposed to be funded with these funds. All projects proposed to receive funding shall be adopted by resolution by the applicable city council or county board of supervisors at a regular public meeting. The list of projects proposed to be funded with these funds shall include a description and the location of each proposed project, a proposed schedule for the project’s completion, and the estimated useful life of the improvement. The project list shall not limit the flexibility of an eligible city or county to fund projects in accordance with local needs and priorities , provided that the projects are consistent with subdivision (b) of Section 2030.
Fiscal Impact:
Currently, the City holds $993,197.48 in our SB1 account and is estimated by the State Department of Finance to receive an additional $ 734,312.00 in FY 25-26, which should cover the completion of these Projects.

WHEREAS, Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and signed into law by the Governor in April 2017 to address the significant multimodal transportation funding shortfalls statewide; and
WHEREAS, SB 1 includes accountability and transparency provisions that will ensure the residents of our City of Wasco are aware of the projects proposed for funding in our community and which projects have been completed each fiscal year; and

WHEREAS, the SB 1 project list and overall investment in our local streets and roads infrastructure with a focus on basic maintenance and safety, investing in complete streets infrastructure, and using cutti ng-edge technology, materials and practices, will allow the City to provide meaningful funding to local streets which are not funded by most other road rehabilitation grant monies.

STAFF REPORT
CITY OF WASCO
TO: Honorable Mayor and Council Members
FROM: M. Scott Hurlbert, City Manager
Isarel Perez-Hernandez, Finance Director
DATE: June 17, 2025
SUBJECT: Adopt a Resolution approving the City’s Appropriations Limit for the Fiscal Year 2025-2026.
_____________________________________________________________________________________ Recommendation:
Staff recommends that the City Council:
1) Adopt a Resolution approving the City’s Appropriations Limit for the Fiscal Year 2025-2026, and
2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c) (3), no environmental review is required.
Environmental Review:
The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA g uidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not su bject to CEQA. Thus, no environmental review is required.
Discussion:
Overview
Under the Gann Spending -Limitation Initiative (Article XIII B of the State Constitution) adopted as Proposition 4 in June 1979 and subsequently modified by Proposition 111 in June 1990), the City is required to annually adopt a resolution setting the A ppropriations Limit for the upcoming fiscal year. For 2025-26, the City’s Appropriations Limit is $34.4 million.
For comparison, 2025-26 appropriations subject to the limit are $7.4 million, which is far less than the calculated Limit by $26.9 million.
Background and Key Concepts
The Gann Spending- Limitation Initiative provides for the limitation of state and local government appropriations. As discussed in the following summary of the major provisions of the Gann Initiative and subsequent Proposition 111 modifications, the Gann Initiative is actually a limitation on tax revenues rather than a direct limitation on appropriations.
84 of 144
Key concepts include:
1. Appropriations subject to limitation may not exceed appropriations made in 1978 -79 except as adjusted for increases in the cost of living, population, and service responsibility transfers.
2. Appropriations financed through service fees (to the degree that they do not exceed th
e cost of performing the service), franchise fees, grant programs, fines, and forfeitures and other specified “non- tax” sources are not subject to the A ppropriations Limit.
Additionally, appropriations for long-term indebtedness incurred prior to 1978-79, debt service on qualified capital outlays beginning in 1990 -91, qualified capital outlays in excess of $100,000 and increased costs as a result of federally mandated programs, are also excluded from the Limit. With the exceptions noted above, only appropriations funded through tax revenues are subject to limitation.
3. For the purpose of identifying “proceeds from taxes” under the Gann Initiative, state subventions that are unrestricted as to their use are considered to be tax sources. On the other hand, the use of subventions like gas tax and transportation development act funds are restricted by the State, and as such, are classified as non-tax sources.
4. Under the original Gann Initiative, all proceeds from taxes received in excess of the appropriations limit were required to be returned through refunds or revisions in tax rates and fee schedules within the next two fiscal years; or voter approval to increase the appropriations limit was required. Proposition 111 provides a one -year carryover feature to determine excess revenues under which refunds can be avoided if in the subsequent year the City is below the limit by the amount of the prior year excess. Any voter-approved increase to the appropriations limit cannot exceed four years.
5. Originally, the Gann Initiative was self-executing, requiring no formal review. However, Proposition 111 requires that the annual calculation be reviewed as part of the annual financial audit.
6. Other key c
oncepts in implementing the Gann Initiative include: appropriations funded through tax sources are subject to the limit, not total expenditu res; and any excess of actual tax revenues over the A ppropriations Limit, not actual expenditures or appropriations, are subject to refund.
Ann
ual Adjustment Factors
The necessary statistical information to calculate the Limit is provided by the Californi a Department of Finance. The annual adjustment factors for changes in population and cost of living for the appropriations limit calculation must be selected by a recorded vote of the Council, and include the following:
1. Population. Based on data provided annually by the State Department of Finance, cities may annually choose either the growth in their City’s or their County’s population.
Historically, the City has elected the City growth rate which came in at decrease in population by -2.55%.
85 of 144
2. Cost of Living. Local governments may annually choose either the percentage change in California per capita personal income or the percentage change in their jurisdiction's assessed valuation that is attributable to non-residential new construction.
For this year’s calculation (as in past years), the percentage increase in California per capita personal income is the recommended adjustment factor.
Note: The City’s percentage change in assessed valuation attributable to non - residential new construction is not readily available. If at such time that this becomes available and results in a significantly higher Limit, it can be adjusted at that time.
However, because the difference between the City’s Limit and appropriations subject to the limit is so large, this is unlikely to ever be necessary.
Calculation Summary
The City’s Appropriation Limit for 2025-26 is $34,401,982, calculated as follows:
86 of 144
The options highlighted in bold print are the recommended adjustment factors in determining the City’s Appropriations Limit for 2025-26.
Appropriations Subject to the Limit
The attached spreadsheet identifies proceeds from taxes in the 2025-26 Budget under the Gann initiative definitions, which total $9,820,000. This is the base that determines proceeds from taxes (and thus appropriations subject to the limit), with two adjustments:
1. Allocated Interest Earnings. Generally accepted accounting principles in this case are to allocate interest earnings based on the ratio between tax and non -tax proceeds.
Tax proceeds account for 62 .15% of total General Fund revenues (excluding interest earnings); and accordingly, 62 .15% of projected interest earnings ($ 901,200 of $1,450,000) are allocated to tax proceeds.
2. Exclusion of Capital Outlay in Excess of $100,000. As discussed above, Proposition 111 adopted in June 1990, made several administrative changes in the Appropriations Limit. Among these was the exclusion from the Limit of capital outlays in excess of $100,000. These total $3,265,539.
Accordingly, net tax proceeds subject to the Limit are $7,455,661 which is $26,946,321 less than the Limit of $34,401,982.
The following is a ten-year summary of the City’s Appropriations Limit compared with appropriations subject to the Limit.

Isarel Perez-Hernandez, Finance Director
DATE: June 17, 2025
SUBJECT: Receive and File the Investment Report for the month ending April 2025. _____________________________________________________________________________________ Recommendation:
Staff recommends that the City Council:
1) Receive and file the Investment Report for the month ending April 30, 2025, and
2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3), no environmental review is required.
Background:
This report is prepared and presented to the City Manager and City Council pursuant to the City’s Investment Policy requirements and the California Government Code. The City’s investment policy requires the Treasurer or Chief Fiscal Officer to render monthly investment reports to the City Manager and the City Council, and requires certain information about the City’s investments to be presented in the report , and that the report contains statements that:
1) The City is in compliance with its investment policy; and 2) The City is able to meet its expenditure requirements for the following six (6) months or provide an explanation of why sufficient funds will or may not be available.
The City’s investment strategy continues to prioritize its investment opportu nities on the following, in order of importance:
1) Safety;
2) Liquidity; and
3) Yield
90 of 144
This strategy is consistent with the Government Code and stresses keeping the citizens’ funds safe and available for operations rather than attempting to maximize returns by making riskier investments.
The Finance Department has prepared the Investment Report for the month ending April 30, 2025. This report meets the latest requirements of the City’s Investment Policy as presented to the City Council on June 18, 2024, monthly report, as well as Government Code Section 53646.
Discussion:
The market value of the City’s total cash and Investments on March 31, 2025 , was $77,535,900 compared to $78,028,184 on April 30, 2025. This is a $492,285 increase from the previous month ($408,302 increase on the cost basis).

SUBJECT: Adopt a Resolution to Authorize the City Manager or Designee to Finalize and Enter into a Software Services Agreement with Placer.ai. _____________________________________________________________________________________ Recommendation:
Staff recommends the City Council:
1) Adopt a resolution authorizing the City Manager or designee to finalize and enter into a software services agreement with Placer.ai.; and 2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.
Discussion:
Placer.ai is a real -world location intelligence platform that the City proposes to use for economic development and other location analysis purposes. Staff has participated in a number of demonstrations and has discussed the merits of the product with other Kern County municipal customers. Additionally, Staff and Councilmembers were able to further review the features during a demonst ration of this software at the recent ICSC conference.
Staff proposes to use this software in place of the current contract with Retail Strategies, which is set to expire on August 2, 2025 . Staff believes that Placer.ai provides a more flexible and cost -effective way of doing location and placed based analysis to aid economic development a nd other location-based analysis projects. The software will allow staff the flexibility to customize searches based on a wide range of criteria and variables, including foot traffic, vehicle traffic, shopping trends, trip origin, etc. The system will also identify gaps in current retail categories, offering real-time data for prospective retailers interested in the Wasco market.
The attached Agreement (Order Form) shown in Exhibit A of the attached resolution is in draft form and will be subject to finalization and execution by the City Manager or designee.
