SUBJECT: Adopt a Resolution Authorizing the City Manager or Designee to Sign and Execute a Purchase Order with Bakersfield Well and Pump for Emergency Repairs to Well #8 in an Amount not to Exceed $15,000.00.
Recommendation:
Staff recommends the City Council:
1) Adopt a Resolution Authorizing the City Manager or designee to sign and execute a purchase order with Bakersfield Well and Pump for emergency repairs to Well #8 in the amount not to exceed $15,000.00; and
2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3), no environmental review is required.
Environmental Review:
The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not resul t in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.
Background:
The city of Wasco has six drinking water wells that supply the community's water needs.
With summer here, it is essential to keep all six wells operational, even with the addition of Water Well #13. On July 3rd, 2025, the variable frequency drive for Water Well #8 failed, requiring staff to shut down the entire well.
Discussion:
While Well #8 is part of the state revolving fund project and is scheduled for abandonment once the replacement wells are drilled and equipped, staff finds it cost - prohibitive to replace the entire drive because the drives a re not interchangeable for

future use. As staff work to find spare parts or a bypass to repair the drive and restore the well to normal operation, it will take some time to troubleshoot the controller. In the meantime, city staff contacted Bakersfield Well and Pump to arrange for a temporary controller at the well, ensuring it remains operational in the event of an emergency. The installation and rental for the drive for 1-month costs $8,600.00, with the potential for the rental to extend up to two months while troubleshooting the older drive. Staff is requesting authorization to pay an amount not to exceed $15,000.00 to Bakersfield Well and Pump for emergency work on well #8.
Fiscal Impact:
As part of the adopted budget for FY 25/26, funds were allocated for repairs to well pumps and equipment. This request falls within this appropriation.

FROM: M. Scott Hurlbert, City Manager
DATE: July 15, 2025
SUBJECT: Adopt a Resolution to Remove Isarel Perez -Hernandez as an Authorized Signer for all City Bank Accounts.
Recommendation:
Staff recommends the City Council:
1) Adopt a Resolution authorizing the signing authority for all City Bank Accounts; and
2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.
Environmental Review:
The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/ administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.
Discussion:
The City’s bank accounts require a formal Resolution by the governing body to authorize representatives on their behalf to establish new accounts and /or modify existing accounts and to make deposits or withdrawals into the bank accounts . Environmental Review:
The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which do es not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

Discussion:
The proposed amendment to Title 10 (Vehicles and Traffic) of the City’s Municipal Code clarifies and brings internal consistency to the City’s Municipal Code with respect to the City’s prohibition on human powered vending from streets, roads, and bicycle lanes .
Vending from human-powered devices is prohibited in public streets and alleys in Section
5.16.220 (Food Vending Vehicles). Vending from sidewalks from human powered vehicles is permitted pursuant to state law and Chapter 5.40 of the City’s Municipal Code.
The proposed amendment to Chapter 10 .36 (Stopping, Standing and Parking) further clarifies the prohibition of human powered vending in public traveled ways including streets, roads, alleys, and bicycle lanes.
Direct human powered vending from roadways which were designed for vehic le circulation and parking is a hazardous practice and causes dangerous conflict between vehicles, vendors, and pedestrian customers.
In a recent informational report to the City Council, staff provided general information on the City’s enforcement and educational practices around street vending . Staff will continue to educate and enforce these laws with vendors using human powered vehicles to vend from the City’s streets.

B. Sidewalk vendors, as defined by Government Code Section 51036, refers to persons who sell food or merchandise from a pushcart, stand, display, pedal - driven cart, wagon, showcase, rack or other nonmotorized conveyance, or from one’s person upon a public sidewalk or other pedestrian path.
C. Chapter 5.40 of the Wasco Municipal Code implements the provisions of the Act.
D. Vehicle Code Section 22455 regulates vending from commercial vehicles throughout the State. Commercial vehicles refer to vehicles that can move on their own power or are “self-propelled”. Vehicle Code Section 22455 allows cities to adopt reasonable time, place and manner restrictions for vending from vehicles upon streets.
E. Chapter 5.16 of the Wasco Municipal Code regulates food vending vehicles and in the City in accordance with Vehicle Code Section 22455.
F. Vendors in the City have been operating human-powered conveyances within vehicle travel lanes and parking lanes , as opposed to sidewalks, thereby falling outside the purview of both the Act and Vehicle Code Section 22455, as well as the City’s laws implementing the same.
G. Such vendors disrupt vehicle circulation networks and pose a danger to themselves and their patrons by operating in locations designated for vehicle travel.
H. The City Council of the City of Wasco finds and determines that v ending from human-powered conveyances upon vehicle travel lanes and parking lanes endangers the health, safety and welfare of vendors, their patrons, and persons operating vehicles and bicycles on Ci ty streets and desires to prohibit such behavior.
