R
ecommendation:
Staff recommends that the City Council:
1. Hold a Public Hearing, Introduce and waive the first reading of a n Ordinance of the City Council of the City of Wasco amending Title 10 of the City of Wasc o M
unicipal Code, adding Chapter 10.54, Rotational Towing.

The proposed amendment to Title 10, Vehicles and Traffic, of the City’s Municipal Code adds Chapter 10 .54, Rotational Towing. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WASCO AMENDING TITLE 10 OF THE CITY OF WASCO MUNICIPAL CODE ADDING CHAPTER 10.54 TOWING OF VEHICLES
AND FINDING THE ORDINANCE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT PURSUANT TO CEQA GUIDELINES SECTIONS 15060(B)(2) AND (B)(3) AND SECTION 15061
THE CITY COUNCIL OF THE CITY OF WASCO DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1: Amendment
Ti tle 10 of the City of Wasco Municipal Code is hereby amended by adding Chapter 10.54 that reads as follows:
Chapter 10.54 T OWING OF VEHICLES
10.54.010 Definitions.

"Business license" means a license issued by the city according to Chapter 5.04 of the municipal code.
"City" means the city of Wasco.
"City manager" means the city manager of the city of Wasco or his or her designee. "Nonconsensual towing service" means towing services provided to the city's police department in situations where vehicle owners are unable to consent to having their vehicle towed, such as in cases of severe accident, where a vehicle is being towed for being illegally parked on public property or towed as a result of a police order. 10.54.020 Purpose and intent.
It is the purpose and intent of this chapter to establish towing regulations to govern the provision of nonconsensual towing services to the city's police department, consistent with state and federal laws , as well as the public health, safety and welfare. A further purpose is to provide a fair and impartial means of distributing police requests for towing services among qualified tow services; and that all tow services provided for the citizens of the city of Wasco are thoroughly checked for safety and cleared of felonious or other problematic criminal backgrounds thus operating in the best interest of the public as well as the interest of the police department.
These regulations are not intended to govern situations where towing has been requested by vehicle owners or private property owners, except as may be permitted by law. Instead, these regulations, along with the rules and specifications to be promulgated by the police chief in conjunction with this chapter, are intended to provide a fair and objective method of selecting towing service providers from among qualified firms to insure that towing providers and drivers selected provide the police department and the public with prompt, safe and comprehens ive towing services using the latest in towing technology and vehicle towing and storage safety.
10.54.030 Letter of authorization required.
In order to operate a tow service with referrals from the Wasco police department, a letter of authorization from the chief of police is required. Such letter of authorization is in addition to a city business license. In order to operate any independent tow service in the city of Wasco for personal tow requests, tow companies are required to obtain a Wasco City permit which includes the same standard tow company and driver checks as agencies placed on the tow rotation. This regulation applies onl y to the operation of tow truck service or tow truck drivers whose principle place of business or employment is within the jurisdiction of the city of Wasco.
10.54.040 Business application process.
Every tow company business intending to provide service within the city of Wasco shall apply and complete a Wasco police department tow service application. Each application for a letter of authorization shall contain the following:

Tow drivers must be able to obtain Department of Motor Vehicle "pull notices" which verify the driver's record and license classification for operation of a tow vehicle.

I. As the laws concerning tow companies adapts and changes due to advances and public expectations, the application process must be understood to be a fluid process. New laws or expectations may be required of agencies operating within the city of Wasco . Any new changes will be sent out to agencies via certified letter containing the change or requirement with a completion date of when the change is expected to be completed by the tow service.

anticipated time of arrival of the tow service exceeds twenty minutes. The police department contact will make the determination, based on the facts of the incident, on whether or not a different tow service will be contacted and assigned to perform the tow. If a different tow service is requested, the tow service first contacted will be notified of the change. No charge will be accepted from the tow service first notified.
10.54.070 Transferability.
Each letter of authorization issued pursuant to this chapter is nontransferable. All tow operator identification cards must be returned to the police department.
10.54.080 Fees.
A processing fee of two hundred fifty dollars will be assessed to cover the expense of the police dep artment's inspections, processes, records check and issuance of the letter of authorization. This fee is nonrefundable. The letter of authorization shall remain in full force and effect until it is revoked, suspended or the owner conducts a business transaction as delineated in Section 10.54.070.
10.54.090 Solicitation prohibited.
No tow service member or employee shall solicit any tow job at the scene of an incident without first being contacted by the owner, operator or person in control of a vehicle, or by a member of the Wasco police department.
10.54.100 Revocation or suspension of the letter of authorization.
The chief of police may revoke or suspend the letter of authorization issued pursuant to this chapter if he or she determines the tow service is in violation of any provision of this chapter. Revocation or suspension of the letter of authorization may also be invoked for any action or omission on the part of the tow service or parties thereof, which would tend to create a negative image of the tow service or the city. If the action is deemed insufficient for permanent revocation, the chief of police may opt to suspend the tow company from performing any tow service in the city of Wasco for up to thirty days.
Delays in service requests, or continued unavailability of a tow company on the police rotation log may result in suspensions as well.
10.54.110 Appeal.
Any person aggrieved by any decision of the chief of police with respect to the issuance, refusal, rejection or revocation of a letter of authorization required by this chapter, may appeal to the city council within ten days after receipt of notification o f such decision by filing a notice of appeal with the city clerk. 10 of 22
10.54.120 Council to set time, place of hearing.

The city clerk shall give notice to the person making an appeal in accordance with Section 10.54.100, of the time and place of hearing by having served it personally, or by depositing it in the United States mail.
SECTION 2: Severability
Each of the provisions of this ordinance is severable. If any provision shall be declared to be invalid, the remaining provisions shall not be affected thereby but shall remain in full force and effect.
SECTION 3: California Environmental Quality Act
The City Counci l of the City of Wasco find that this Ordinance is not subject to the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines (Chapter 3 of Title 14 of the California Code of Regulations) Sections 15060(c)(2) and 15060(c)(3).
The Ordinanc e will not result in direct or reasonably foreseeable indirect physical changes to the environment. In addition, the Ordinance is not a project as defined in CEQA Guidelines Section 15378 because it has no potential to result in physical changes to the environment, directly or indirectly. Further, if the activity is deemed a project, the City Council finds that this Ordinance is exempt pursuant to CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no possibility that the Ordinance may have a significant effect on the environment.
SECTION 4: Effective Date
The City Clerk is hereby ordered to publish this Ordinance in summary form in accordance with the law, in a newspaper of general circulation in the City. This ordinance shall become effective 30 days from the date of its adoption.

SUBJECT: Adopt a Resolution Approving an Application for Funding and Authorizing the City Manager or Designee to E xecute a Grant Agreement, budget appropriations, and any Amendments Thereto for Fiscal Year 2025 Regional Surface Transportation Program (RSTP) Funding, committing the Necessary Local Match, and stating the Assurance to complete the Griffith Avenue Project.
Recommendation:
Staff recommends the City Council:
1) Adopt a Resolution approving an application for funding and authorizing the City Manager or designee to execute a grant agreement, budget appropriations, and any amendments thereto for the Fiscal Year 2025 Regional Surface Transportation Program (RSTP) funding, committing the necessary local match, and stating the assurance to complete the Griffith Avenue Project; and
2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.
Environmental Review:
The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.
Discussion:
On March 20, 2025, the Kern Council of Governments’ (Kern COG) Board of Directors approved a Regional Surface Transportation Program (RSTP) call for projects. The Regional Surface Transportation Program (RSTP) was established by the Intermodal
STAFF REPORT
City of Wasco
13 of 22
Surface Transportation Act of 1991 (1991 ISTEA, Public Law 102 -240). The RSTP program can be used to maintain and improve the existing transportation system, expand the system to reduce congestion, and establish programs and projects that help the region reduce mobile emissions and meet federal air quality standards.
RSTP funds are reimbursable federal aid funds, subject to all the requirements of Title 23, United States Code. Eligible costs for funds under these programs include preliminary engineering, right -of-way acquisition, capital costs, and construction costs associated with an eligible activity.
Background:
On June 17, 2025, the City Council approved Resolution No. 2025-4216, which authorized this application and requested $771,500.00 in RSTP funds for Griffith Avenue from Jackson to Margalo for the following:
· ADA Improvements, stripping, sidewalks, curb and gutter, signage, and asphalt rehabilitation along Griffith Avenue in various locations between Jackson Avenue and Margalo Street.
Discussion:
The City of Wasco's allocation for FY2025 RSTP was $925,000.00. The city was attempting to collaborate with the County on a project for Kimberlina, and we had tentatively reserved $241,992.00 of RSTP funding for this collaboration. However, the County requested that we commit $1.1 million for our portion of the Kimberlina project as part of the combined RSTP project. This is approximately four times our estimated fair share cost for our segment, which covers about 0.3 miles of roadway. Consequently, our collaboration on Kimberlina was unable to proceed due to this significant funding gap.
To prevent losing our RSTP allocation of $241,992.00, the staff revised the engineer's estimate by expanding the scope of the Griffith Avenue RSTP project. This adjustment ensures that we requested the full allocation. The updated engineer's estimate is now $1,044,844.00, which takes into account the additional scope of work, inflation, and supply chain uncertainties. The RSTP application, along with a revised draft resoluti on, was submitted to KernCOG on July 16, 2025, ahead of the deadline.
Griffith Avenue meets the minimum eligibility requirements for functional classification; it is a Major Collector Street and qualifies for the RSTP Federal funding program.
RSTP Program project applications were due by 5:00 PM on Thursday, July 17, 2025.
Fiscal Impact:
A minimum match of $119,844.00 ( 11.47%) is required and will be funded by the Transportation Development Act (TDA) Local Transportation Funds (LTF).

TO: Honorable Mayor and Council Members
FROM: M. Scott Hurlbert, City Manager
Tom Schroeter, City Attorney
DATE: July 28, 2025
SUBJECT: Adopt a Resolution Authorizing the City Manager to designate Interim Monetary Approval Limits for Staff in the Finance Department.
Recommendation:
Staff recommends that the City Council:
1) Adopt a Resolution Authorizing the City Manager to designate Interim Monetary Approval Limits for Staff in the Finance Department, and
2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.
Environmental Review:
The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA). It has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.
Background:
The purpose of this report is to formally designate monetary authority to selected staff members, allowing them to approve expenditures within specified limits , due to the resignation of the Finance Director . This step aims to streamline operations, enhance efficiency, and facilitate timely decision-making in departmental financial management during this transitional stage.
Discussion:
It has been identified that assigning defined monetary limits to trusted staff can improve expenditure accountability and operational effectiveness. In the absence of the Finance Director, current procedures create a situation where the City Manager, as Acting

Finance Director, approves certain pending expenditures (both Payroll and Accounts Payable) then immediately approves the same items again in his role as City Manager.
Although this does not exceed the monetary authority of the CM, it does diminish the intended checks and balances of the current procedures. This situation also more than doubles the number of items to be reviewed by the CM, creating resource challenges.
There are other intermediary reviews and approvals with limited dollar limits such as timecard reviews vs. accounting reports which could be delegated to responsible staff members. With approval of this item, Council would authorize the City Manager to delegate certain of these responsibilities to qualified staff members. At present, delegation is anticipated to be limited to the following positions:
- Assistant City Manager
- Accounting Supervisor
- Billing/Collections Supervisor
- Incoming Accounting Manager
Such delegation shall not exceed the current $10,000 limit placed on final approvals reserved for the City Manager and Acting City Manager. All such delegations shall be documented and preserved for audit purposes and all such delegations shall be reviewed by the new Finance Director when seated.
Fiscal Impact:
None

RESOLUTION NO. 2025 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WASCO AUTHORIZING
THE CITY MANAGER TO DESIGNATE INTERIM MONETARY APPROVAL LIMITS FOR STAFF IN THE
FINANCE DEPARTMENT
WHEREAS, In the absence of a Finance Director, there are certain review and approval processes within the Finance Department which are currently being completed by the City Manager while acting as interim Finance Director; and
WHEREAS, Staff has determined that this process is not ideal in that it may diminish certain checks and balances within the Department and, creates an unsustainable review queue for remaining staff; and
WHEREAS, Staff recommends the City Manager be authorized to delegate certain tasks and monetar y authority to qualified staff including Assistant City Manager, Accounting Supervisor, Billing/Collections Supervisor, and Incoming Accounting Manager; and WHEREAS, Such delegation shall not exceed the current $10,000.00 limit placed on final approvals reserved for the City Manager and Acting City Manager ; all such delegations shall be documented and preserved for audit purposes , and all such delegations shall be reviewed by the new Finance Director when seated.
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Wasco, as follows:
SECTION 1: The City Manager is authorized to temporarily delegate certain accounting tasks and monetary authority to the aforementioned individuals.
SECTION 2: Such delegation shall not exceed the current $10,000.00 limit placed on final approvals reserved for the City Manager and Acting City Manager.
