STAFF REPORT
City of Wasco

TO: Honorable Mayor and Council Members

FROM: M. Scott Hurlbert, City Manager
Alecio Mora, Chief of Police

DATE: May 19, 2026

SUBJECT: Approval of Travel and Training Exceeding $500.00 for Police Department Sergeant to attend the Critical Incident Leadership for Field Supervisors training scheduled for May 26-27, 2026, in Rialto, CA.
_____________________________________________________________________________________ Recommendation:

Staff recommends that the City Council:

1. Approve training exceeding $500.00 for one Wasco Police Department Sergeant to attend the Critical Incident Leadership for Field Supervisors training scheduled for May 26-27, 2026, in Rialto , California, including registration and lodging costs; and

2. Find that this action is not a project as defined under the California Environmental Quality Act (CEQA) State Guidelines; therefore, pursuant to Section 15378, no environmental review is required.

Environmental Review:

The proposed action consists of a governmental administrative and fiscal activity that does not result in a direct or indirect physical change in the environment. As such, it is not a “project” under Section 15378 of the State CEQA Guidelines and is not subject to CEQA.

Background:

The Critical Incident Leadership for Field Supervisors course is designed to equip law enforcement supervisors and tactical personnel with the tools and techniques to make informed, effective decisions during critical incidents.

The training focuses on identifying key characteristics in developing incidents, recognizing factors that influence events, establishing operational priorities, and implementing strategies to prevent escalation and promote de-escalation toward a safe and successful resolution.

Discussion:

A Sergeant from the Wasco Police Department will be attending this training to enhance supervisory leadership and incident management skills. Field supervisors play a critical 17 of 60
role in managing high-risk incidents, including major crimes, critical incidents, and rapidly evolving situations requiring immediate leadership and decision-making.

Attendance at this training will help strengthen the Sergeant’s ability to assess developing incidents, establish priorities, and make sound operational decisions while ensuring the safety of officers and the public.

Fiscal Impact:

The estimated cost of attendance, including registration, lodging, meals, and travel, is approximately $9 00.00 per employee. All costs will be covered by the Police Department’s allocated training budget. No additional impact on the General Fund is anticipated.

FROM: M. Scott Hurlbert, City Manager
Luis Villa, Public Works Director

DATE: May 19, 2026

SUBJECT: Adopt a Resolution Authorizing the City Manager or designee to finalize and endorse an agreement with The Wallace Group for Professional Engineering Services related to Wastewater/Stormwater System matters.

Recommendation:

Staff recommends that the City Council:
1) Adopt a resolution Authorizing the City Manager or designee to finalize and endorse an agreement with Wallace Group for Professional Engineering Services related to Wastewater System matters; and

2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.

Environmental Review:

The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act(CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

Discussion:

The city has historically used John Kular Consulting for wastewater /stormwater engineering services on an as-needed basis. With John Kular retiring, the city has sought alternate wastewater consulting services specifically for Wastewater and Stormwater related matters.

The Wallace group, which has over three decades of experience in civil engineering, specializing in water resources, specifically wastewater and stormwater, is the city staff's recommendation to enter into a professional service agreement for these services.

STAFF REPORT
City of Wasco

The group would be contracted to perform work on an as -needed basis and provide support to staff on engineering and regulatory matters. Attached are the Wallace Group Services overview and rate schedule to be used on a time-and-materials basis for services the city requests, or as a task order for a specific deliverable.

Fiscal Impact:

Engineering services will be paid on a time -and-materials basis or on a task order basis for a deliverable.

TO: Honorable Mayor and Council Members

FROM: M. Scott Hurlbert, City Manager
Luis Villa, Public Works Director

DATE: May 19, 2026

SUBJECT: Authorize the City Manager or designee to Endorse and Execute a Purchase Order with Munguia Heating & AC for the R eplacement and Installation of the AC unit at the City’s Utility Billing Office, in an amount not to exceed $15,000.00.

Recommendation:

Staff recommends that the City Council:
1) Authorize the City Manager or designee to endorse and execute a purchase order with Munguia Heating & AC for the replacement and installation of the AC unit at the City’s Utility Billing Office, in an amount not to exceed $15,000.00, and

2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.

Environmental Review:

The staff has reviewed the proposed activity for compliance with the California Environmental Quality Act ( CEQA). It has been determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA guidelines because the proposed activity consists of a governmental fiscal/administrative activity which does not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required.

Discussion:

The City’s utility billing office’s current AC Unit is 20 years old and in need of replacement.

Given the unit's constant need for repairs and the approaching hot weather, staff find it prudent to replace the entire unit to ensure continued operability.

Staff allocated funds for the unit replacement in the current fiscal year and obtained three quotes from various service providers. Munguia Heating & AC submitted an $11,100 bid for the replacement and installation of a new unit, including the best warranty, as

STAFF REPORT

specified in the attached quote. The $15,000.00 request includes contingencies to cover any unforeseen costs associated with the unit's replacement and installation.

Three Quotes

1. Air King Heating & Cooling Inc - $9,900.00

2. Munguia Heating & AC - $11,100.00

3. Balanced Air Mechanical - $14,466.25

Fiscal Impact:

The cost of the unit replacement and installation will be paid from the facility's maintenance operating budget.

FROM: M. Scott Hurlbert, City Manager
Luis Villa, Public Works Director

DATE: May 19, 2026

SUBJECT: Authorize the City Manager or Designee to Endorse and Execute a Purchase Order for Assessing Centrifuge No. 1 with GEA Mechanical Equipment US, Inc. for an amount not to exceed $20,000.00.

Recommendation:

Staff recommends the City Council:
1) Authorize the City Manager or Designee to endorse and execute a purchase order for assessing Centrifuge No. 1 with GEA Mechanical Equipment US, Inc. for an amount not to exceed $20,000.00; and

Background:

One of the critical processes in wastewater treatment is the dewatering and disposal of biosolids. Biosolids are produced when wastewater enters the sewer facility and passes through sedimentation processes that separate water from sludge. Although the sol ids are separated from the water and treated, further drying/dewatering is still required before we can dispose of them. The city currently relies on mechanical dewatering by centrifuges 1 and 2, and as a secondary option, solids are air -dried during the w arm months to save on centrifuge run time and associated costs.

STAFF REPORT
City of Wasco

40 of 60
Discussion:

As part of CIP NO. 25008, funds were allocated for repairs to centrifuge No. 1. Due to the complexity and numerous components of a centrifuge, the first step in getting it fixed is to disassemble it and perform an assessment to verify the integrity of its internal components. After this phase is complete, the extent of the repairs will be determined, and an estimate will be brought back to the council for approval of the work.

A quote was obtained from GEA for the disassembly and inspection of the unit. GEA is the original equipment manufacturer (OEM) for the city's current centrifuges and the authorized service provider for GEA Separator units, including the city's current model, as noted in the attached sole-source letter.

Staff is requesting approval for up to $20,000.00 to cover the cost of this work, including contingencies, before we can proceed to the next phase.

Fiscal Impact:

As part of Capital Improvement Project 25008, funds have been allocated for this request.

To Whom It May Concern:

This letter provides formal justification for procuring maintenance and repair services for our centrifuge systems from GEA Mechanical Equipment US, Inc. on a sole-source basis.

GEA is the original equipment manufacturer (OEM) and the authorized service provider for GEA Separator units, including UCA 501-00-32, Serial Number: 8006-630. The proprietary design of these separators requires specialized diagnostic equipment, OEM-certified technicians, and genuine GEA replacement parts, all of which are exclusively supplied by GEA. No third-party vendor has access to the necessary technical data, tooling, or firmware needed to perform qualified service on these units.

OEM-certified service is essential to ensure performance, reliability, and regulatory compliance. Using non- authorized providers would risk operational failure, safety issues, and loss of warranty protection.

SUBJECT: Adopt a Resolution Approving the Policy on Disruptions of Telephonic or Internet Services During Public Meetings in compliance with Senate Bill 707.

Recommendation:

Staff recommends the City Council:
1) Adopt a Resolution Approving the Policy on Disruptions of Telephonic or Internet Services During Public Meetings in compliance with Senate Bill 707; and

2) Find that this action is not a project as defined under the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15378, no environmental review is required.

Environmental Review:

This action is not a project within the meaning of CEQA Guidelines Section 15378 and is therefore not subject to CEQA, since it does not have the potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable ind irect physical change in the environment. The approval of this agenda item does not commit the City to a definite course of action in regard to a project since the action authorized herein is a professional service agreement. This proposed activity is therefore not subject to CEQA. Any future action connected to this approval that constitutes a project will be reviewed for CEQA compliance.

Background:

The Ralph M. Brown Act requires that, with limited exceptions, all meetings of a legislative body of a local agency be open and public and that all people be permitted to attend and participate.

In 2025, the Legislature adopted Senate Bill 707 (Durazo), which amends the Brown Act and establishes additional teleconference and public access requirements for city councils and county boards of supervisors. The bill becomes operative on July 1, 2026, and remains in effect until January 1, 2030

STAFF REPORT
City of Wasco

48 of 60
Beginning July 1, 2026, the City of Wasco will be required to:
• Teleconferencing and Remote Participation Requirements • Enhancing Public Engagement
• Teleconferencing for advisory bodies (such as the Planning Commission)

Discussion:

The purpose of this agenda item is to review Brown Act requirements under SB 707 with the Council and to advise the Council as to how the city is preparing to ensure the requirements are met in a timely manner.

A. Teleconferencing and Remote Participation Requirements

1. Mandatory Hybrid Meetings: Eligible legislative bodies, such as the Wasco City Council, must provide hybrid meetings, which means an in -person meeting plus a teleconference option for their meetings. The teleconference option must be either a two -way telephonic or audiovisual platform (e.g., Zoom ). If using audiovisual platforms, a call-in option and active captioning (if available) are required.

2. Policy Regarding Broadcast Disruption: Prior to July 1, 2026, the City Council must adopt an open session policy regarding hybrid meetings that includes procedures for restoring service in the event of broadcast disruption. The policy should include: (i) steps to be taken if audio, video, or the entire platform fails, (ii) the appropriate personnel to take corrective action to restore service, and (iii) the procedure to notify the public and resume the meeting upon restoration of service
.

In addition, the policy should also outline how the City Council will deal with a disruption or disturbance from a member of the public, either in person or via teleconference, and restore decorum to the meeting. The policy should also address procedures for accommodating disability requests from a Councilmember or a member of the public to participate in the meeting, and define “just cause” and “emergency circumstances” for purposes of a Councilmember's remote participation.

3. One-Hour Recess Requirement: Starting July 1, 2026, if a disruption prevents the public from attending the meeting remotely, the City Council must take a recess and try to restore service. If service cannot be restored within one (1) hour, the City Council must conduct a roll call vote confirming that good-faith efforts were made and make a finding that the public interest in continuing the meeting outweighs the use of remote access.

B. Enhancing Public Engagement

1. Translation of meeting agendas: The City must translate meeting agendas (but not the entire agenda packet ) into languages where 20% of the City’s population speaks an applicable foreign language and at the same time that population speaks English less than “very well.” The source of the data must come from the most recent U.S. Census Bureau’s American Community Survey.

The applicable language for the City of Wasco is Spanish. Digital translation is expressly permitted, currently with no liability for accuracy.

49 of 60

2. Translation of the City website: Similar to meeting agendas, the City’s website must also be translated if 20% of the City’s population speaks an applicable foreign language, and at the same time, that population speaks English less than “very well. “Each translation must be accessible through a prominent direct link posted on the City’s website home page.

3. Assistance in translation services : The City is required to reasonably assist members of the public who wish to translate a public meeting into any language or wish to receive interpretation provided by another member of the public. SB 707 does not require the City to provide translation services, but only to assist others who choose to engage in translation/interpretation services.

However, as you know, the City already complies with this requirement.

4. Translation near posting sites : The City must also provide a freely accessible physical location near where the agendas are posted, and allow the public to post additional translations of the agenda in that location.

5. Outreach requirements: The City must make reasonable efforts to invite groups that do not traditionally participate in public meetings to attend City Council meetings. The Council will identify those groups to invite and provide direction to Staff.

6. Teleconferencing for advisory bodies (such as the Planning Commission) : SB 707 further standardizes teleconferencing procedures for advisory bodies, such as planning commissions, and other commissions and committees of the City.

However, before an advisory body may use teleconferencing, the City Council must first formally autho rize it by resolution or policy. Commissioners or Committee members participating remotely must maintain real-time, two-way communication for the duration of the meeting, unless the member has a physical or mental condition meeting ADA disability criteria that results in a need to participate off camera. Further, the bill removes the prior requirement to publicly notice each remote location. Also, SB 707 requires each advisory body to reauthorize its use of teleconferencing every six months by majority vote, confirming that the practice continues to serve the public interest. At this time, staff is focusing on the requirements for the Council and will then address the policy for the Planning Commission and Measure X Oversight Committee.

Fiscal Impact:

SB 707 is a legislative unfunded mandate of cities , which must bear the additional costs associated with compliance. An estimate of costs to implement SB 707 requirements has not been prepared at this time. Anticipated costs include alteration and expansion of Council Chambers audiovisual equipment, costs to translate agendas, outreach and website materials, and additional personnel costs for recurring staff time necessary to ensure meetings comply with SB 707.

City of Wasco
City Council Policy on Disruptions of
Telephonic or Internet Service During
Public Meetings

Adopted: May 19, 2026

51 of 60

1. Background
Senate Bill 707 (2025) amended the Brown Act to require eligible legislative bodies to adopt, on or before July 1, 2026, a policy addressing how the agency will respond to disruptions in telephonic or internet service that prevent members of the public from attending or observing a meeting remotely. This policy is adopted to comply with that requirement and to ensure continuity of public participation during technical disruptions.

2. Purpose
This policy establishes procedures for responding to a disruption in the telephonic or internet services that provide two-way remote public access to meetings of the City of Wasco City Council, as required by the Brown Act (Gov. Code § 54953.4). The policy ensures transparency, public participation, and continuity of government during technology disruptions.

3. Definitions
For purposes of this policy:

• “Disruption” means any failure, outage, or other interruption that prevents members of the public from attending or observing the meeting via these remote access services.
• “Remote access services” means the two-way telephonic service and/or two-way audiovisual platform used to provide real- time remote public attendance and observation of meetings.

4. Applicability
This policy applies to all open and public meetings of the City Council at which remote public participation is offered or required under the Brown Act.

5. Procedures in the Event of a Service Disruption

5.1 Response to Service Disruption
If the Presiding Officer or Clerk becomes aware of a disruption to the agency’s remote access services that prevents members of the public from attending or observing the meeting remotely:

1. The Presiding Officer or Clerk shall immediately announce the disruption to the public.

2. The Presiding Officer shall recess the open session of the meeting.

Staff shall begin efforts to diagnose and restore the disrupted service.
52 of 60

3. The Council shall not reconvene the open session of the meeting until at least one hour following the disruption, or until telephonic or internet service is restored, whichever is earlier. The Council may meet in closed session during this period.

6. Reconvening the Open Session

6.1 Timing
The open session may be reconvened after at least one hour has elapsed from the time of disruption or as soon as service is restored, whichever occurs earlier.

6.2 If Service Is Restored
If the remote access service is restored before or at the time the meeting reconvenes, the meeting shall continue as normal.

6.3 If Service Is Not Restored
If service has not been restored after one hour, the City Council may reconvene and:

1. Adjourn the meeting; or

2. Continue the meeting in open session by adopting, by roll call vote, the following, or a substantially similar, finding:
“The City of Wasco has made good faith efforts to restore telephonic or internet service in accordance with its adopted policy, and the public interest in continuing the meeting outweighs the public interest in remote public access.” Upon adoption of the finding, the legislative body may continue the open session despite the fact that remote access services have not been restored.

7. Recordkeeping
The Clerk shall enter a brief statement into the meeting minutes, including the following:
• The nature and time of the disruption.
• The restoration efforts undertaken.
• The time the meeting was reconvened (if applicable).
• Any finding adopted pursuant to Section 6.3.
53 of 60

8. Review and Updates
This policy may be amended by the City Council at a noticed public meeting in open session, not on the consent calendar.

SUBJECT: Authorize the City Manager or D esignee to Endorse and Execute a Purchase Order with Siemens for Repairs to the City’s Solar Farm, in an amount not to exceed $30,000.00

Recommendation:

Staff recommends the City Council:
1) Authorize the City Manager or designee to endorse and execute a purchase order with Siemens for repairs to the City’s Solar Farm, in an amount not to exceed $30,000.00; and

Discussion:

The city’s 1.8 MW solar farm, located near the city’s sewer facility, generates and exports renewable energy to the grid. The energy from the solar array offsets some of the energy consumed by the city’s facilities, including the well sites and the sewer plant.

Due to unforeseen malfunctions in some panels and inverters, and vandalism, repairs are needed to restore the entire unit to 100% energy production capacity. Siemens, which constructed and completed the solar project, provided a quote for the repairs detailed

in the attached quote. Staff is requesting an amount not to exceed $ 30,000.00 to carry out these repairs.

Dear Mrs. Luis Villa,

As we discussed in our meeting on May 12, 2026, Siemens is amenable to complet e the second site assessment to investigate and evaluate what additional vandalism (March 7, 2026) was done to the Solar PV system located at 1000 7th St, Wasco, CA 93280, United States. The cost for the second site assessment will be carried in the final comprehensive proposal to address all maintenance issues including both routine corrective maintenance and repairs related to the vandalism as requested. A final compre hensive proposal will be submitted to capture all remaining work that needs to be completed to address all issues (corrective and vandalism) after the assessment is completed.

In the event, the City of Wasco elects to not move forward with the comprehensive proposal to address all corrective maintenance issues, including the vandalism related issues, the City shall pay Siemens separately for the second site assessment valued at $3,642. Please sign the letter on the line provided below to agree to these terms and return to Mark Castaneda.
