Resolution: Resolution 2022-10, Opposing State Ballot Measure Restricting Voters’ Input and Local Taxing Authority
SUMMARY:

The Taxpayer Protection and Government Accountability Act limits voters’ authority, adopts new and stricter rules for raising taxes and fees, and makes it more difficult to hold violators of state and local laws accountable.

ANALYSIS:

In 2018, the “Tax Fairness, Transparency and Accountability Act” or (AG# 17-0050 Amdt. #1), was being circulated to qualify for the November 2018 ballot. This initiative would have drastically limited local revenue authority.

Through the successful work and advocacy of the League of California Cities and its coalition, the measure’s proponents withdrew the initiative from the ballot in June 2018.

On Jan. 4, 2022, the California Business Roundtable filed the Taxpayer Protection and Government Accountability Act or AG# 21-0042A1. This measure is far more detrimental to cities than the measure filed in 2018, because it would decimate vital local and state services to the benefit of wealthy corporations.

Cal Cities, along with a broad coalition of local governments, labor and public safety leaders, infrastructure advocates, and businesses, strongly oppose this initiative.

WHAT WOULD THIS MEASURE SPECIFICALLY DO?

1. Limit voter authority and accountability
• Limits voter input. Prohibits local voters from providing direction on how local tax dollars should be spent by prohibiting local advisory measures.
• Invalidates the Upland decision that allows a majority of local voters to pass special taxes.

Taxes proposed by the Initiative are subject to the same rules as taxes placed on the ballot by a city council. All measures passed between January 2022 and November 2022 would be invalidated unless reenacted within 12 months.

2. Restrict local fee authority to provide local services • Impacts franchise fees. Sets new standard for fees and charges paid for the use of local and state government property. The standard may significantly restrict the amount oil companies, utilities, gas companies, railroads, garbage companies, cable companies, and other corporations pay for the use of local public property. Rental and sale of local government property must be “reasonable” which must be proved by “clear and convincing evidence.” • Except for licensing and other regulatory fees, fees and charges may not exceed the “actual cost” of providing the product or service for which the fee is charged. “Actual cost” is the “minimum amount necessary.” The burden to prove the fee or charge does not exceed “actual cost” is changed to “clear and convincing” evidence.

3. Restrict authority of state and local governments to issue fines and penalties for violations of law • Requires voter approval of fines, penalties, and levies for corporations and property owners that violate state and local laws unless a new, undefined adjudicatory process is used to impose the fines and penalties.

4. Restrict local tax authority to provide local services • Requires voter approval to expand existing taxes (e.g., UUT, use tax, TOT) to new territory (e.g., annexation) or expanding the base (e.g., new utility service). • City charters may not be amended to include a tax or fee. • New taxes can be imposed only for a specific time period. • Taxes adopted after Jan. 1, 2022, that do not comply with the new rules, are void unless reenacted.
• All state taxes require majority voter approval.
• Prohibits any surcharge on property tax rate and allocation of property tax to state.

5. Other changes
• No fee or charge or exaction regulating vehicle miles traveled can be imposed as a condition of property development or occupancy.

FISCAL IMPACT:

Undetermined, could be significant.

ENVIRONMENTAL REVIEW:

The City finds and determines with certainty that this item is exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3), as the activity is covered under the general rule that CEQA applies to only projects which have the potential for causing a significant effect on the environment.

ALTERNATIVES:

1. Do not pass the resolution. Staff does not recommend this action as it could force local taxpayers and residents to pay more, undermines voter rights, transparency and accountability, as well as jeopardizes vital local and state services.

RESOLUTION 2022-10

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WATERFORD OPPOSING INITIATIVE 21-0042A1, A STATE BALLOT MEASURE
RESTRICTING VOTERS’ INPUT AND LOCAL TAXING AUTHORITY
WHEREAS an association representing California’s wealthiest corporations is behind a deceptive proposition aimed for the November 2022 statewide ballot; and WHEREAS, the measure creates new constitutional loopholes that allow corporations to pay far less than their fair share for the impacts they have on our communities, including local infrastructure, our environment, water quality, air quality, and natural resources; and WHEREAS, the measure includes undemocratic provisions that would make it more difficult for local voters to pass measures needed to fund local services and infrastructure, and would limit voter input by prohibiting local advisory measures where voters provide direction on how they want their local tax dollars spent; and
WHEREAS, the measure makes it much more difficult for state and local regulators to issue fines and levies on corporations that violate laws intended to protect our environment, public health and safety, and our neighborhoods; and
WHEREAS, the measure puts billions of dollars currently dedicated to state and local services atrisk, and could force cuts to public schools, fire and emergency response, law enforcement, public health, parks, libraries, affordable housing, services to support homeless residents, mental health services, and more; and
WHEREAS, the measure would also reduce funding for critical infrastructure like streets and roads, public transportation, drinking water, new schools, sanitation, and utilities.

NOW, THEREFORE BE IT RESOLVED, that the City of Waterford, opposes Initiative 21-0042A1.

NOW,THEREFORE, BE IT FURTHER RESOLVED, that the City of Waterford will join the NO on Initiative 21-0042A1 coalition, a growing coalition of public safety, labor, local government, infrastructure advocates, and other organizations throughout the state.

City Council Staff Report
Resolution: Resolution 2022-09, Approving Mid-Year Budget Adjustments for FY 2021- 2022
SUMMARY:

Staff is seeking City council’s approval of the proposed mid-year budget adjustments for 2021- 2022.

ANALYSIS:

The overall changes in mid-year estimates show a relatively stable environment. The largest adjustments relate to the receipt of American Rescue Plan Act Funds (ARPA) in the amount of $1,071,950. This amount is accounted for in the General Fund as reserved until such time as the funds are spent for the approved purposes. On November 4, 2021 the Council approved Resolution 2021-59 which addressed the planned uses of the funds. The total allocated to the city is $2,143,900 with the second half to be received in December of 2022. The total increase in expenses in the General Fund budget for the APRA approved expenses in 2022 is $180,761 for approved Premium Pay, Capital Items for the council chambers audio/visual improvements, and salary survey costs. Revenues in the General Fund are showing upward trends especially in the areas of Sales and Property Taxes. The development of more than 75 new homes within the City will continue to enhance property taxes. On the expenditure side, costs are going up to reflect the staffing of positions and general increases in administrative costs. The primary adjustments were in the areas of payroll, professional services, and utility costs. In addition, the City made the decision to payoff an outstanding Park Land Lease (Reinway Regional Park) with the one-time use of Capital Facility Fee Funds. This adjustment to expenses in the amount of $53,062 is a one time increase and will produce a General Fund savings in future years as the approximate $50,000 in debt service will no longer be required. The General Fund reflects a reserve balance of 85% after all the mid-year adjustments and has an additional $891,189 in reserve for the unspent ARPA Funds.

The Other Governmental Funds of the City saw changes primarily in the area of Capital Facility Fee Funds. These funds were adjusted to reflect the YTD amounts collected on the building permits related to the D.R. Horton Development of 75 homes. These one-time fees are collected and held for use as outlined in the Capital Facility Program.

The City’s Wastewater Enterprise Fund is struggling to maintain adequate reserves for capital and equipment maintenance. Rate increases took effect July 1 2019 (5-year structure) but it will take years to build back up the reserves to needed levels and invest back into the system as needed for major capital improvements. The Water Enterprise Funds are also struggling to keep up with capital demands. The City is hoping to obtain grants to complete much of the cost for system consolidation. Fiscally, the primary focus of the City should be on controlling operational costs, managing debt service on the City’s outstanding obligations, and planning for costs of new City facilities. The approval of the use of the ARPA Funds for capital improvements to the Water and Wastewater system with the initial expansion on Tim Bell will provide much needed infrastructure for future development.

FISCAL IMPACT:

General Fund: The anticipated ending General Fund Reserve with these adjusted levels of revenues and expenditures is expected to be $3,401,107. This represents an 85% reserve level.

In addition, the General Fund will have $891,189 of ARPA Funds held in reserve. The details of the changes can be found in the detailed financial information.

Other Governmental Funds: The City’s Other Governmental Funds did not include a lot of significant changes at mid-year. The primary changes were in the Capital Facility Fee funds for the impacts of the D.R. Horton Development.

CIP Funds: CIP Funds are seeing some changes for new grant sources including a $221,325 Department of Transportation Grant for the Yosemite Boulevard – SR 132 Corridor Study, and additional Active Transportation Plan and CMAQ Grants. Measure L funds continue to provide a reliable source of streets capital funds and the City has been actively spending the funds on much needed projects throughout the City.

Wastewater Treatment Funds: The Wastewater Fund is struggling to keep up with reserve accumulation and capital needs. Year end is anticipated to see negative reserve levels of ($88,318). The 2019 rate increases should slowly build back up these reserves however the system has extensive capital needs.

Water Funds: Staff is working on the System Consolidation project and other scheduled reserve projects as funds are becoming available. The River Pointe and Hickman Systems operations are stabilizing with limited losses and Hickman was able to transfer adequate amounts to CIP Reserve for its portion of the debt service payments. Grants are pending to offset some of the cost and complete the Hickman/Waterford consolidation. The current year also reflects $900,00 for our anticipated share of the cost of the County Bridge project for the pipeline installed to connect the Waterford and Hickman water systems. The City anticipates $527,293 in reserves at year end.

ENVIRONMENTAL REVIEW: N/A
ALTERNATIVES: The City Council has the option to modify or not approve the mid-year budget adjustments as proposed. This alternative is not recommended as many of the changes have either already been incurred or are unavoidable as the cost control for the function is not controlled by the City.

City Council Staff Report
Motion: Reaffirming the Declaration of Emergency made by the City Manager on January 31, 2022 and Declaring there is a Need to Continue with Project No. 2022-03, “Emergency Repair of Baker Lift Station.”
SUMMARY:

City Council is being asked to reaffirm the declaration of emergency made by the City Manager on January 31, 2022 and declaring there is a need to continue with Project No. 2022-03, “Emergency Repair of Baker Lift Station.”
ANALYSIS:

On January 31, 2022, the Baker Lift Station Pump 2 discharge pipe was shooting wastewater out in all directions at the 90-degree elbow. The Baker Lift Station was installed in 1998 and over the years the metal fittings and discharge pipes have started to deteriorate. To complete this fix, the set of discharge pipes in the lift station including the 90-degree elbow spools, the ultra-flex couplings on both discharge pipes, and the check valves in the vault next to the lift station will need to be removed and replaced.

Staff contacted Applegate Teeples Drilling Company to get the Baker Lift Station running correctly.

On January 31, 2022, the City Manager deemed the damaged set of pipes in the lift station an emergency and ordered repair to commence immediately without giving notice for bids to let contracts in accordance with Section 22050 of the Public Contract Code under the authority given to him through Council Resolution No. 2018-57 (Exhibit 1). The Emergency Declaration was due to the need to make repairs quickly as a complete failure of the lift station would leave a significant portion of Waterford including River Pointe community without sewer service. Staff will continue to update the Council at every Council meeting reaffirming the emergency exists until the emergency ceases.

FISCAL IMPACT:

Each emergency action is different and the cost will be determined following the correction of the emergency situation. However, Applegate Teeples Drilling Company has provided an initial estimate of $29,266.00 (Exhibit 2). Funding for these improvements will come from FY 20/21 Budget Line 4350- 700-7420.

ENVIRONMENTAL REVIEW:

This project is categorically exempted according to Title 14, Chapter 3, Article 19 of the Guidelines for Implementation of the California Environmental Quality Act (CEQA), in accordance with Section 15301 “Existing Facilities.”
ALTERNATIVES:

1. Reject the affirmation of the declaration of emergency declared by the City Manager. Staff does not recommend this alternative as the City Council has delegated authority to the City Manager to declare emergencies in accordance with Section 22050 of the Public Contract Code and Council Resolution No. 2018-57 and the project is needed to maintain a viable wastewater collection system.

RE: Lift Station Reconstruction – PREVAILING WAGE
LOC: 225 N Appling Rd
Waterford, CA
ESTIMATE:

A Teeples Plumbing will provide the labor and equipment necessary to supply a diesel trash pump with bypass plugs to bypass the sewer lift station in the park. We will then vac out the lift station and pressure wash the valve next to the lift station that has the shut off valves. Then we will do a confined space entry into the lift station to OSHA standards to remove the plumbing in the lift station that has a hole and is causing the main problem. We will remove the rails on both sides of the pumps to allow access to the plumbing, we will then cut the wall of the lift station to make room to remove the pipes that have mortar. This will include jack hammering and chipping them out. Then we will remove both set of pipes in the lift station including the 90- degree elbow spools and the ultra-flex couplings on both discharge pipes. We will remove the check valves in the vault next to the lift station and replace them with a different brand. After all the pipes are removed, we will then install all new piping, bolts, gaskets, spools and check valves. Then we will reinstall the railing system for the two pumps and if needed new dead head bolts, all hardware will be stainless steel. After all repairs are made and system is ready for testing, we will pull the plugs and fill the lift station. During the repair we will work with City of Waterford staff, and we will put the system back in test mode to check for leaks. If the system tests clear, we will clean out the rental bypass pump and clean up the work area and pressure wash and remove all materials off site.
