Motion: Accept Compliance with Developer Fees report in accordance with requirements of Section 66006 of the Government Code.

SUMMARY:

Section 66006(b)(1) of the Government Code requires each local agency to make a public report on developer fees after the close of each fiscal year. The required report consists of a brief description of the fee type in the account or fund, the amount of the fee, the beginning and ending balance of the account or fund, the amount of fees collected and the interest earned.

The City is also required by State law to spend or commit developer fees within five years of collection.

If fees remain unexpended or uncommitted five years after being collected, the City is to make a finding that there remains a reasonable relationship between the current need for the fees and the purposes for which they were originally collected.

FISCAL IMPACT:

See attached accounting by Fund of the City’s Developer Fees.

ANALYSIS:

The City is in compliance with the requirements of Government Code section 66006 governing the accounting and reporting for Developer Fees.
