Motion: Awarding Bid and Approving an Agreement with Quality Well Drillers, Inc, in the Amount of $39,585.92 for Project No. 2023-03, “River Pointe Well 2 Rehab Project” as a Minor Contract Project and Authorizing the City Manager to Execute the Agreement.

SUMMARY:

The City Council is being asked to award bid and approving an agreement with Quality Well Drillers, Inc, as a minor contract project in the amount of $39,585.92 for Project No. 2023-01 “River Pointe Well 2 Rehab Project” and authorizing the City Manager to execute the agreement.

ANALYSIS:

Operations staff has recently (last 6 months) noticed a significant production loss with Well 2, from an original production amount of 900-1200 gallons per minute to a reduced production of 400 gallons per minute. The reason for this large drop in gallons per minute is due to the perforations that pull the groundwater into the well via the underground aquafer are plugging with Manganese and other particles that are picked up through the layers of the earth. This creates strain on the bowls, pump and booster pumps. We have already repaired a booster pump last year which was an indication of impending rehab work needed.

When a well is running at half production it typically will call the well to run more than is needed too based off of demand and pressures by the distribution system. This creates premature wear and tear on the pump, electrical windings in the motor, and eventually will lead to well failure. With the rehabilitation of Well 2 the residents of River Pointe and Waterford will have good water pressure and quality water to drink.

The scope of work includes:
• Water Jetting 150’ of Well 2
In December 2022, staff reached out to 3 companies and only one responded:

City Council Staff Report
RESOLUTION: Adopting Resolution 2023-07, Designating the Waterford Police Chief as Public Convenience and Necessity (PCN) Officer for the City of Waterford.

SUMMARY:

City Council is being asked to designate the Waterford Police Chief as the Public Convenience and Necessity (PCN) Officer for the City of Waterford. This action will maintain local control of determining if an alcohol saturated census track should be allowing another alcohol license based on PCN.

ANALYSIS:

The State of California Department of Alcoholic Beverage Control (ABC) is the body that regulates alcohol business sales statewide. ABC has set a specific number of alcohol sales licenses that should be allowed in each census track throughout California. When a business requests an alcohol sales license, ABC will issue an alcohol sales license if the census track has not exceeded its designated number. Should an application for alcohol sales come from a saturated census track, exceeding the designated number of licenses, the only way that business can get an alcohol sales license is to go through a PCN process to show why another license is warranted in a saturated census track.

The ABC has sent a letter to the city requesting we identify who will be responsible for the PCN process. Options include:

1. City Council designating an officer of the city to review all license application and if in a saturated census track, hold a PCN hearing and make final determination.

2. City Council themselves could review all license application and if in a saturated census track, hold a PCN hearing and make the final determination.

3. City Council could designate ABC as the entity to review all license application and if in a saturated census track, hold a PCN hearing and make the final determination.

It is recommended that City Council choose option 1 and to designate the Waterford Police Chief as the officer to review applications for PCN and make final determinations. While option 2 is a local control alternative, staff feels that a PCN hearing should be held at staff level with council hearing appeals should the applicant request a hearing. Staff does not recommend option 3 as it is staff’s opinion that we should maintain local control of the alcohol license PCN process as we know our city better than the state.

Should the City Council choose Option 1, the Waterford Police Chief will develop procedures to review and determine if a PCN exists and all future applications in saturated census tracks will follow the new procedures.

FISCAL IMPACT:

There is no fiscal impact associated with the adoption of these policies.

ENVIRONMENTAL REVIEW:

This ordinance is exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3) which is the” Common Sense Exemption” that CEQA applies only to projects which have the potential for causing a significant effect on the environment and CEQA does not apply where it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment.

ALTERNATIVES:

1. Council could choose not to designate the Waterford Police Chief as the Public Convenience and Necessity (PCN) Officer for the City of Waterford and choose one of the following alternatives:
a. Have all PCN hearings be held at City Council for Council consideration. b. Allow ABC to make the PCN decisions for the City of Waterford.
