March 2, 2023
Tina Envia, Finance Manager
City Council Staff Report
Resolution: Adopting Resolution 2023-10, Approving Mid-Year Budget Adjustments for FY 2022-2023.

SUMMARY:

Staff is seeking City Council’s approval of the proposed mid-year budget adjustments for 2022- 2023.

ANALYSIS:

The overall changes in mid-year estimates show a relatively stable environment in the General Fund. The largest adjustments is related to the American Rescue Plan Act Funds (ARPA) in the amount of $939,297 which represents funds received in prior year. The adjustment is necessary to match the revenues from ARPA with the projected expenses. Any unspent ARPA funds will be budgeted in future fiscal years. We also adjusted property and sales tax for anticipated increases over the original budget. In the area of building fees, we reduced original estimates to reflect the completion of the D.R. Horton Development of 75 homes. Significant changes in the expenses of the General Fund were the addition of another $50,000 to the Community Center remodel in anticipation of the cost of the fire damage repairs and $17,000 for the improvements at the Beard Park Bathrooms. The other changes were for reductions in the area of building and planning for the decrease in activity due to the completion of the 75 homes and some minor increases for year to date activity in excess of anticipated costs.

The Other Governmental Funds of the City saw decreases in both the Special Business Pilot and Gas Tax estimates for 2023. The Abandoned Vehicle Abatement program has increased revenue estimates due the enhanced Code Enforcement position. The Impact Fees saw overall decreases, again, due to the completion of the 75 homes. The City’s CIP Funds have increases due to an additional STBGP Grant for the Skyline Rehabilitation project. Measure L Funds were also adjusted for completed items and matching needs for various grants.

The City’s Wastewater Enterprise Fund is struggling to maintain adequate reserves for capital and equipment maintenance. The Water Enterprise Funds are also struggling to keep up with capital demands. The City is hoping to obtain grants to complete much of the cost for system consolidation. Fiscally, the primary focus of the City should be on controlling operational costs, managing debt service on the City’s outstanding obligations, and planning for costs of new City facilities. The approval of the use of the ARPA Funds for capital improvements to the Water and Wastewater system with the initial expansion on Tim Bell will provide much needed infrastructure for future development.

FISCAL IMPACT:

General Fund: The anticipated ending General Fund Reserve with these adjusted levels of revenues and expenditures is expected to be $3,116,608. This represents an 64% reserve level which is a 4% increase from the original budget. The details of the changes can be found in the detailed financial information.

Other Governmental Funds: The City’s Other Governmental Funds did not include a lot of significant changes at mid-year.

CIP Funds: CIP Funds are seeing some changes for new grant sources including a $350,000 STBGP Grant for the Skyline Rehabilitation project. The total project is budgeted at $455,000 with $105,000 coming from Measure L.

Wastewater Treatment Funds: The Wastewater Fund is struggling to keep up with reserve accumulation and capital needs. Year end is anticipated to see reserve balances of only $59,000. The 2019 rate increases should slowly build back up these reserves however the system has extensive capital needs. The final rate adjustment of 3% will occur on July 1, 2023.

Further rate studies will be needed to assure the capital needs of the Wastewater System can be met.

Water Funds: Staff is working on the System Consolidation project and other scheduled reserve projects as funds are becoming available. Grants are pending to offset some of the cost and complete the Hickman/Waterford consolidation. The City anticipates $539,716 in reserves at year end. Depending on the availability of the Grant funds the City may have to consider other forms of financing or rate adjustments to meet the capital needs of the Water System.

ENVIRONMENTAL REVIEW: N/A
ALTERNATIVES: The City Council has the option to modify or not approve the mid-year budget adjustments as proposed. This alternative is not recommended as many of the changes have either already been incurred or are unavoidable as the cost control for the function is not controlled by the City.

City Council Staff Report
Motion: Awarding contract for Professional Auditing Services for the fiscal years ending June 30, 2023, 2024, 2025, 2026, and 2027.

SUMMARY:

Staff is seeking City council’s approval of the contract for Professional Auditing Services for the fiscal years ending June 30, 2023, 2024, 2025, 2026, and 2027.

ANALYSIS:

The City received two proposals for professional auditing services from Badawi & Associates (our current provider) and Price Paige & Company. The firms where selected based on recommendations from other Cities in our area; and all had the necessary experience and expertise in the area of local governments. After a thorough review and analysis of the proposals staff recommends entering into a 5-year contract with Badawi & Associates. Badawi & Associates has been our auditor for the past 5 years and have provided exceptional service. They have maintained professional independence but have always been a valuable resource when we were presented with new accounting pronouncements or other challenging accounting matters. Their services have been timely and they have diligently worked to meet our timelines. The other firm was equally qualified but given the cost proposals we could not justify switching firms. Badawi & Associates’ cost of the contract over the 5-year period is $169,445. The other bid came in at $390,726. The difference in price was substantial and staff could not support switching to a new auditor at an additional cost of $221,281 over the 5-year contract. Staff recommends the selection of Badawi & Associates for the 5-year period at a cost of $169,445.

FISCAL IMPACT:

The audit fee is budgeted in the General Fund and will range from $32,365 in year one to $34,395 for years 3-5. The total five year cost of the contract is $169,445.

ALTERNATIVES: The City Council has the option to select either of the two bidders or direct staff to seek additional proposals.

City Council Staff Report
Motion: Awarding a Professional Services Agreement to J.B. Anderson Land Use Planning of Ripon Ca. for the Performance of all Planning Services for the City of Waterford for a (3) Three-Year Period beginning April 1, 2023.

SUMMARY:

The City Council is being asked to award a Professional Services Agreement to J.B. Anderson Land Use Planning (Anderson) of Ripon Ca. for the performance of all planning services for the City of Waterford for a (3) three-year period beginning April 1, 2023.

ANALYSIS:

The City of Waterford maintains a small staff and uses outside consultants for various municipal activities, one of which is planning activities. The City has contracted with Anderson for many years and they have performed all required planning services with professionalism and has shown themselves to be very knowledgeable in all facets of municipal planning including land use, environmental review, short and long-range planning and many other areas. For these reasons, staff would like to extend our contractual relationship with Anderson and is proposing a new 3-year agreement. The agreement includes Planning and General Services at a monthly fee of $3,472 for 32 hours of planning support ($108.5/hour). Also included in the agreement are special City initiated projects and large-scale applicant driven projects. The special and large-scale projects will be billed in addition to the monthly fee at the rates below:

Staff recommends City Council approve the agreement to continue our contractual relationship with Anderson for 3 years beginning April 1, 2023.

FISCAL IMPACT:

The total cost of services is unknown as costs are dependent on the number and scale of planning services required. The hourly rates proposed by Anderson in the exhibits to the agreement are fair and reasonable for the services rendered.

ENVIRONMENTAL REVIEW:

The City finds and determines with certainty that the proposed Professional Services Agreement is exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3), as the activity is covered under the general rule that CEQA applies to only projects which have the potential for causing a significant effect on the environment.

ALTERNATIVES:

1. Not approve the award of a profession service agreement to Anderson. Staff does not recommend this action as Anderson has a proven history of providing outstanding planning services and staff would like to continue our contractual relationship.
