Patricia Krause, City Clerk / Administrative Services Director City Council Staff Report
Resolution: Adopting Resolution 2023-16, Initiating Proceedings for the Levy and Collection of Assessments for the Waterford Lighting Assessment District for Fiscal Year 2023 – 2024.

SUMMARY:

Authorize NBS to prepare and file with the City Clerk the Annual Report concerning the levy and collection of assessments within the Lighting Assessment District for the Fiscal Year commencing July 1, 2023 and ending June 30, 2024.

ANALYSIS:

This is the first of a three-step process to get the annual assessments on the County tax roll. With approval of this item, NBS will prepare the Annual Engineer’s Report for the Lighting Assessment District for the May 18, 2023 City Council Meeting. City Council will consider approval of the Annual Engineer’s Report and declare intention to confirm and set the Assessments for Fiscal Year 2023-2024 and set a public hearing date for June 15, 2023 to take public comment, confirm the Assessments and order the Levy.

The Waterford Lighting Assessment District was formed in accordance with and pursuant to the Landscaping and Lighting Act of 1972, Part 2, Division 15 of the California Streets and Highways Code (commencing with Section 22500).

The LAD includes those properties as shown in the Lighting Assessment District Map of the City of Waterford which is on file at City Hall and available for public inspection. The District may make changes in existing and proposed improvements pursuant to the act. The City of Waterford established an assessment for the Lighting District of $11.24 per parcel for the Fiscal Year 2022-2023 by Waterford City Council Resolution #2022-29. The Act requires that an engineer prepare a report which refers to the assessment district by its distinctive designation, specifies the fiscal year to which it applies and contains the plans and specifications for the improvements, an estimate of the costs of the improvements, a diagram for the assessment district, and an assessment of the estimated costs of the improvements.

The City of Waterford has retained NBS for the purpose of assisting with the annual levy of the Assessment District, and to prepare and file an Annual Report. There are no changes to existing improvements nor are there any items being added to the list of improvements previously approved at the formation of the Assessment District.

FISCAL IMPACT:

There are no fiscal impacts associated with the initial of proceedings. However, the initiation of proceedings is essential, as it is the first step in the process of collecting assessments that fund the Lighting Assessment District Fund.

ENVIRONMENTAL REVIEW:

There are no environmental impacts associated with this item.

ALTERNATIVES:

1. Adopt Resolution No. 2023-16, thereby initiating the proceedings for the levy and collection of assessments and ordering the preparation of the Engineer’s Reports for Fiscal Year 2023-2024.

2. Reject the initiation of proceedings, and direct Staff to review and recommend other funding sources to maintain the Lighting Assessment Districts.

Caltrans needs the City to relocate its existing water and sewer services so that there is no conflict with their upcoming surface improvement project. The proposed project will mitigate sewer and water infrastructure conflicts that have been predetermined to exist by Caltrans Engineering.

Motion: Awarding Bid and Approving an Agreement with Howk Systems, Inc, in the Amount of $45,866.42 for Project No. 2023-03, “River Pointe Well 2 Rehab Project” as a Minor Contract Project and Authorizing the City Manager to Execute the Agreement.

SUMMARY:

The City Council is being asked to award bid and approving an agreement with Howk Systems, Inc, as a minor contract project in the amount of $45,866.42 for Project No. 2023-03 “River Pointe Well 2 Rehab Project” and authorizing the City Manager to execute the agreement.

ANALYSIS:

Operations staff has recently (last 6 months) noticed a significant production loss with Well 2, from an original production amount of 900-1200 gallons per minute to a reduced production of 400 gallons per minute. The reason for this large drop in gallons per minute is due to the perforations that pull the groundwater into the well via the underground aquafer are plugging with Manganese and other particles that are picked up through the layers of the earth. This creates strain on the bowls, pump, and booster pumps. We have already repaired a booster pump last year which was an indication of impending rehab work needed.

When a well is running at half production it typically will call the well to run more than is needed too based off demand and pressures by the distribution system. This creates premature wear and tear on the pump, electrical windings in the motor, and eventually will lead to well failure. With the rehabilitation of Well 2 the residents of River Pointe and Waterford will have good water pressure and quality water to drink.

On February 2, 2023, staff brought this project to council for award to Quality Well Drillers utilizing Howk Systems as a subcontractor. Due to some business issues, Quality Well Driller was unable to execute the agreement. Therefore, Howk Systems is taking the lead on this project and will be the prime contractor utilizing Quality Well Drillers as a subcontractor.

The scope of work remains the same and includes:
• Before and After Video
• Water Jetting 150’ of Well 2
In December 2022, staff reached out to 3 companies and only one responded:
