City Council Staff Report
Resolution: Approve Resolution 2023-19, Authorizing the City Manager or his Designee to Submit the City’s SB 1 Project List to the California Transportation Commission.

SUMMARY:

Approve a resolution authorizing the City Manager or his designee to submit the City’s SB 1 Project List to the California Transportation Commission by the due date of July 1, 2023.

ANALYSIS:

On April 28, 2017 the Governor signed Senate Bill (SB) 1 (Beall, Chapter 5, Statutes of 2017), which is known as the Road Repair and Accountability Act of 2017. To address basic road maintenance, rehabilitation, and critical safety needs on the state highway and local streets and road system. SB 1 increases per gallon fuel excise taxes; increases diesel fuel sales taxes and vehicle registration fees and provides for inflationary adjustments to tax rates in future years.

The California Transportation Commission does not “approve” or “deny” project lists, they simply gather and compile project lists from all cities, ensure the submittals conforms with state law and approves project funding.

The funding created by SB 1 will increase the amount of Gas Tax Revenue and designates a certain portion to each City based on a set schedule of needs and projects, i.e. the “project list”. Revenue estimates received by City Finance estimates we will receive $224,929.00 in new funding in FY 2023/24. To be eligible for funding, the City has to provide a project list and maintain a Maintenance of Effort (MOE) of General Fund expenditures totaling $57,010.

Beginning November 1, 2017, the State Controller (Controller) began depositing new funding into the newly created Road Maintenance and Rehabilitation Account (RMRA). A percentage of this new RMRA funding will be apportioned by a formula to eligible cities and counties pursuant to Streets and Highways Code (SHC) Section 2032(h) for basic road maintenance, rehabilitation, and critical safety projects on the local streets and roads system. SB 1 emphasizes the importance of accountability and transparency in the delivery of California’s transportation programs. Therefore, to be eligible for RMRA funding, statute requires cities and counties to provide basic annual RMRA project reporting to the California Transportation Commission.

The City of Waterford has made a significant investment in our street infrastructure. As such, on-going maintenance is an important factor in increasing the life of our streets. The following list of projects was developed for submittal by the state deadline of July 1, 2023:
• F Street Overlay Project
Fiscal year 2023/24 funds will be used on our “F Street Overlay Project” this project will consist of a 2” rubberized overlay of F Street, ADA improvements and the replacement of damaged curbs, gutter and sidewalks. This project is located on F Street from State Hwy 132 (Yosemite) to the north city limits adjacent to the MID main canal. This project will bring back a severely dilapidated road in our community which is one of our main corridors thru the city. In its current condition you find 2-3” wide cracks, along with several potholes on this road. F Street is a heavily used road in our community which consists of not only everyday commuters but a lot of large commercial trucks as well.

FISCAL IMPACT:

Funding for this project will come from SB-1 funding in conjunction with the Community Connections and Rail Services grant from the Measure L Program. The approval of the project list and resolution will not in itself impact the city fiscally. Future expenditures will be brought forth to City Council for approval through the annual budget and award of bid for capital improvement projects.

ENVIRONMENTAL REVIEW:

N/A
ALTERNATIVES:

1. Do not approve the resolution, which will result in a loss of funding for the City.

2. Direct Staff to amend the list of projects and bring this item back for future consideration.

Resolution: Adopting Resolution 2023-20, Approving the Community Development Block Grant Subrecipient Agreement Between the County of Stanislaus and the City of Waterford and Authorize the City Manager to Execute the CDBG Subrecipient Agreement for Fiscal Year 2023-2024.

SUMMARY:

City Council is being asked to approve Resolution 2023-20 the Community Development Block Grant Subrecipient Agreement between the County of Stanislaus and the City of Waterford and authorize the City Manager to execute the CDBG Subrecipient Agreement for fiscal year 2023-2024.

ANALYSIS:

FY 2023-2024 Annual Action Plan
In 2002, Stanislaus County was designated an Urban County by the Federal Housing and Urban Development Department (HUD) and receives an annual allocation to be shared among Stanislaus County and the cities of Ceres, Hughson, Newman, Oakdale, Patterson, Riverbank and Waterford. With this designation, Stanislaus County qualifies as an “entitlement” jurisdiction which means that the County receives Community Development Block Grant (CDBG) funds from HUD without participating in the competitive application process.

During Fiscal Year 2023-2024, Stanislaus Urban County expects to receive $2,335,030 in Community Development Block Grant (CDBG) program funding and $208,3178 in ESG funding. The CDBG funds and the ESG funds are to be used on the following activities. • Infrastructure Improvements
• Economic Development Programs
• Affordable Housing
• Fair Housing Services
• Public Services
• Homeless Shelter Services
• Homeless Prevention
• Homeless Services Data Collection
Waterford estimated CDBG allocation is approximately $237,715 which includes $10,160 for administration costs. Staff recommends use of those funds for Dorsey Street, Pecan and Western Avenue Neighborhood Improvement. The work consists of installing curb, gutter, sidewalk and ADA improvements on the east side of Western Avenue from F Street 500 feet south. There will be roadway surface improvements and storm drain collection improvements done as well. The other part of the improvements will consist of installing missing curb, gutter, sidewalk and ADA improvements on Pecan and Dorsey from Western to F Street as well as roadway surface improvements. CDBG Funding shall cover environmental, design, construction and inspection of improvements.

Waterford staff will hold a “Public Hearing” at the Council meeting on April 20, 2023, to take input from the public.

FISCAL IMPACT
These funds are derived from the Community Development Block Grant (CDBG) Program and Emergency Shelter Grant (ESG), therefore, there is no impact to the City’s General Fund.

ENVIRONMENTAL REVIEW:

This project is exempt from the provisions of the California Environmental Quality Act (CEQA) in accordance with Section 15303 (New Construction or Conversion of Small Structures) of the CEQA Guidelines.

ALTERNATIVES:

1. Not to approve this resolution. Staff does not recommend this option as it is a requirement to receiving future CDBG funding and that the City relies on these funds for the projects identified in this report.
