Ordinance: Second Reading and Adoption of Ordinance 2024-01, Relinquishing Enforcement Responsibility for Mobile Home Parks and Installations and Special Occupancy Parks
SUMMARY:
The City Council is being asked to adopt Ordinance 2024-01, Relinquishing Enforcement Responsibility for Mobile Home Parks and Installations and Special Occupancy Parks.
ANALYSIS:
On April 19, 1976, the Waterford City Council adopted its Resolution No. 76-26 declaring its intention to enforce mobile home park provisions of the California Health and Safety Code. Due to limited financial and human resources, staff find that it is in the best interest of the City and its residents to effect the transfer of mobile home park enforcement authority back to the California Department of Community Development.
FISCAL IMPACT:
The fiscal impact to the City is minimal. Currently, the City collects $224.00 each year for the two mobile home parks under the City of Waterford Jurisdiction.

WHEREAS, on April 19, 1976, the Waterford City Council adopted its Resolution No. 76-26 declaring its intention to enforce mobilehome park provisions of the California Health and Safety Code; and

SECTION 5. To the extent the provisions of the Waterford Municipal Code are substantially the same as the provisions of this Ordinance, then those provisions shall be construed as continuations of the earlier provisions and not as new enactments.

The proposed Ordinance amends the WMC Title 17, Zoning, Chapter 17.22 entitled “RM Mobile Home Park District” Section 17.22.020 entitled “Regulations, generally” to clarify that the City has relinquished enforcement responsibility to the California Department of Housing and Community Development (HCD) for mobilehome parks, installation and special occupancy permits and that all construction and operation procedures within a mobilehome park shall be in accordance with California Health and Safety Code Section 18000 et seq. related to Mobile Homes – Manufactured Homes and California Code of Regulations related to Mobile Homes – Recreational Vehicles and Commercial Coaches.

On April 19, 1976, the Waterford City Council adopted Resolution No. 76-26 declaring its intention to enforce mobilehome park provisions of the California Health and Safety Code. Enforcing provisions of the Health and Safety Code related to mobilehome parks include but is not limited to the following:
• Inspection of new mobilehomes that are placed in a mobilehome park; • Mobilehome park maintenance, use, occupancy, and design; • Lot identification, lighting, roadway width;
• Permits, fees, application and appeal procedures, etc.; • Enforcement of California Health and Safety Code Provisions, specifically Part 2, Manufactured Housing (Section 18000 et seq.); and
• Enforcement of California Code of Regulations, specifically related to Mobile Homes – Recreational Vehicles and Commercial Coaches.
HCD has long been the enforcement agency of mobilehome park provisions of the California Health and Safety Code and the California Code of Regulations for the majority of jurisdictions in the State of California. The Health and Safety Code establish requirements for permits, fees, and responsibilities of park operators and enforcement agencies, including HCD, and requires HCD to develop and enforce both the regulations and laws.
The Code of Regulations include specific requirements for park construction, maintenance, use, occupancy, and design. Also included are requirements for items such as lot identification, lighting, roadway with, plans, permits, mobilehome installation, accessory structures and buildings, earthquake resistant bracing systems, application procedures, fees, enforcement and appeal procedures.
Currently, the City is responsible for enforcement mobilehome park provisions in the California Health and Safety Code and the California Code of Regulations, which is a financial and human resource burden. To reduce this burden, the City Council is moving forward with formally relinquishing enforcement responsibilities for mobilehome parks and installations and special occupancy parks. As noted above, the proposed Ordinance would update Chapter 17.22, entitled “RM Mobile Home Park District”, Section 17.22.020 entitled “Regulations, generally” to be consistent with City Council’s intent and to codify that enforcement responsibility for mobilehome parks, installations and special occupancy parks is the responsibility of HCD.
ANALYSIS
Proposed Amendments to the WMC include the following (removed text is represented in strikethrough and added text is represented in underline)
17.22.020 Regulations generally.
A. No building or improvement or portion thereof shall be erected, constructed, converted, altered, or enlarged, nor shall any lot or premises be used in the RM zoning district except for one or more of the purposes listed in this chapter and subject to the terms and conditions of this chapter, or applicable city of Waterford development standards, as well as all other applicable provisions of this title.
B. Mobile home parks or manufactured home developments shall be built and managed in compliance with Title 25 of California state law. (Ord. 2011-02 §1).
B. All construction and operation procedures within the property lines of the premises of a mobile home park shall be in accordance with the provisions of the most recent edition of:
1. California Health and Safety Code, Division 13 (entitled “Housing”), Part 2 (entitled “Mobile Homes – Manufactured Housing), Section 18000 et seq.
2. California Code of Regulations, Title 25, Division 1, Subchapter 2 (entitled “Mobile Homes, Recreational Vehicles and Commercial Coaches), Section 4000 et seq.
C. The City of Waterford has relinquished to the California Department of Housing and Community Development (HCD) all enforcement responsibilities for mobilehome parks, installation and special occupancy parks.
The proposed amendment would clarify that the construction and operation procedures within mobilehome park developments are in accordance with applicable California Health and Safety Code and Code of Regulations provisions. The proposed amendments also clarify that the City of Waterford has relinquished all enforcement responsibilities for mobilehome parks, installation and special occupancy parks.
