City Council Staff Report
Motion: Accept Compliance with Developer Fees report in accordance with the requirements of Section 66006 of the Government Code.

SUMMARY:

Section 66006(b)(1) of the Government Code requires each local agency to make a public report on developer fees after the close of each fiscal year. The required report consists of a brief description of the fee type in the account or fund, the amount of the fee, the beginning and ending balance of the account or fund, the amount of fees collected, and the interest earned.

The City is also required by State law to spend or commit developer fees within five years of collection.

If fees remain unexpended or uncommitted five years after being collected, the City is to make a finding that there remains a reasonable relationship between the current need for the fees and the purposes for which they were originally collected.

FISCAL IMPACT:

See attached accounting by Fund of the City’s Developer Fees.

ANALYSIS:

The City is in compliance with the requirements of Government Code section 66006 governing the accounting and reporting for Developer Fees.

Motion: Awarding Bid and Approving an Agreement with WildRose Drilling (dba) Wild Heron Drilling in the Amount of $33,069.37 for Project No. 2024-05, “Wastewater Monitoring Well Replacement” and Authorizing the City Manager to Execute the Public Improvement Agreement

SUMMARY:

City Council is being asked to award a bid and approve an agreement with WildRose Drilling (dba) Wild Heron Drilling in the amount of $33,069.37 for Project No. 2024-05, “Wastewater Monitoring Well Replacement” and authorizing the City Manager to execute the Public Improvement Agreement.

ANALYSIS:

The City of Waterford operates its wastewater treatment plant (WWTP) on the north side of the Tuolumne River, west of Hickman Road, and south of Riverside Road. Two monitoring wells are present at the WWTP infiltration basins on the south side of the river. Both wells are shallow and are replacements of the previous monitoring wells on-site. One of the new wells exhibits issues similar to those of their predecessors, such as plugging, biofouling, and low water content. The existing east monitoring well (E-MW-R) has been reported as having insufficient water for sampling. The City is being required by the RWQCB to bring the monitoring well back into service, as the most recent site inspection report noted insufficient water present for sampling.

On October 9, 2024, staff received 2 bids as follows:

This project is exempt from the provisions of the California Environmental Quality Act (CEQA) in accordance with Section 15304 (Minor Alterations of Land) of the CEQA Guidelines.

ALTERNATIVES:

1. Council could choose to not award the Wastewater Monitoring Well Replacement project. This is not recommended as this inaction could lead to the State finding the city to be in violation with not meeting State monitoring well regulations.
