City Council Staff Report
Ordinance: Introduction and First Reading of Ordinance 2025-01, Amending Waterford Municipal Code Title 3, Entitled “Revenue and Finance,” Chapter 3.08 Entitled “Purchasing,” by Amending Section 3.08.120.

SUMMARY:

Amending Waterford Municipal Code Ordinance Title 3 entitled “Revenue and Finance,” Chapter 3.08 entitled “Purchasing” by amending Section 3.08.120 with regards to expenditure limits as allowed for by the California State Controller and Public Contract Code 22000.

ANALYSIS:

Public Contract Code 22000 permits Cities to adopt the “Uniform Public Construction Cost Accounting Act (UPCCAA)” and the City Council adopted the UPCCAA on February 15, 2018. The primary goal of the UPCCAA is to provide cities flexibility in bidding Public Works projects by providing negotiated and informal bidding processes in addition to formal bidding processes. The California State Controller from time to time modifies the expenditure limits allowing cities to adopt the new limits if they desire.

The proposed ordinance amendment will align the city ordinance with the new limits codified in Public Contract Code 22032. The change in expenditure limits will go into effect on May 3, 2025 and are as follows:
(a) Public projects of seventy-five thousand dollars ($75,000) or less may be performed by the employees of a public agency by force account, by negotiated contract, or by purchase order. (b) Public projects of two hundred twenty thousand dollars ($220,000) or less may be let to contract by informal procedures as set forth in this article. (c) Public projects of more than two hundred twenty thousand dollars ($220,000) shall, except as otherwise provided in this article, be let to contract by formal bidding procedure.

As this is an alignment of expenditure authority to match the Public Contract Code, staff is recommending approval. If approved, staff will utilize the new expenditure limits thirty (30) days following council adoption.

FISCAL IMPACT:

The ordinance revision itself does not impact the City financially. Each capital project subject to the bid procedures will be brought to the City Council with a proposed budget for Council’s consideration and approval.

ENVIRONMENTAL REVIEW:

The City finds and determines with certainty that Code Text Amendment 2025-01 is exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3), and that the activity is covered under the general rule that CEQA applies to only projects which have the potential for causing a significant effect on the environment.

PUBLIC NOTICE:

In accordance with the City’s Municipal Code, a Public Notice was published in the Waterford News on February 25, 2025.

ODINANCE REVISION PROCESS:

Ordinance 2025-01 is before the City Council for a public hearing to consider approving the Introduction and First Reading by title only. A summary of the Ordinance will be published in the Waterford News and will come back to the City Council as a public hearing item at the next council meeting to consider the Second Reading by title and Adoption. After adoption, an Ordinance Summary will be published in the Waterford News and will become effective and in full force on and after thirty (30) days of its passage and adoption.

ALTERNATIVES:

1. Not approve the ordinance revision. This is not recommended as the proposed limits modification allows greater flexibility in bidding Public Works projects by providing greater expenditure authority for negotiated and informal bidding processes.

2. Defer approval of the ordinance to a future council date and provide staff direction on council desired changes.

City Council Staff Report
Resolution: Approving Resolution 2025-08, Authorizing a Resolution of Intention of the City Council of the City of Waterford to Establish a Community Facilities District SUMMARY:

In response to a petition submitted on behalf of FH Building Company, a California Corporation to establish a Community Facilities District within the City of Waterford. Staff is asking the Council to Authorize a Resolution of Intention of the City Council of the City of Waterford to Establish a Community Facilities District.

ANALYSIS:

The developer/owner (FH Building Company, a California Corporation) of the Waterstone A & C development wishes to form a community facilities district by creating Annexation 1 to the current Community Facilities District 2019-1, to be known as “Community Facilities District 2019-1 Annexation No. 1”. Staff is requesting the Council authorize the Resolution of Intention of the City Council to establish the district. Once authorized, the public hearing and election will be set for May 1, 2025. The services and rate structure of the district will be the same as those for Community Facilities District 2019-1. The services, rates, and methods are included in the Resolution. At the public hearing on May 1, 2025, the results of the election of the landowners will be declared and the first reading of the Ordinance levying the special tax be declared. Following the public hearing the Special Tax Lien will be recorded, and a second reading of the Ordinance Levying the Special Tax will be held. Thereafter the parcels will be subject to the Annual Levy of the special assessment.

FISCAL IMPACT:

The District’s intention is to pay in whole or in part for all direct and incidental costs related to providing for the maintenance of public infrastructure within the area of the CFD and the areas adjacent to or in the vicinity of such areas. The services shall include: the maintenance of: (i) streets and street tress; (ii) street lighting; (iii) landscaping in public areas and medians including turf, trees, shrubs and associated irrigation systems; as well as the provision of other public services authorized to be funded under Section 53313(d) or (e) of the California Government Code. The base rate per parcel on creation of the original District was $210.12 per single family detached property. That rate has an annual escalation factor of 3%.

ENVIRONMENTAL REVIEW:

N/A
ALTERNATIVES:

If the City does not wish to authorize the intention to establish the district, then the full maintenance and infrastructure costs of the area involved would be the responsibility of the City’s General Fund rather than the individual property owners.

NOW, THEREFORE BE IT RESOLVED,

1. The Waterford City Council proposes to conduct proceedings to establish a community facilities district pursuant to the Mello-Roos Act.

2. The name proposed for the community facilities district is “Community Facilities District No. 2019-1 (Maintenance Services) Annexation No. 1 (Waterstone A and C), City of Waterford, County of Stanislaus, State of California” (“CFD No. 2019-1 Annexation No. 1”).

3. The Waterford City Council hereby approves the Boundary Map and thereby establishes the proposed boundaries of CFD No. 2019-1 Annexation No. 1. The City Clerk is hereby authorized and directed to cause the respective certificates on the Boundary Map to be completed and executed and to cause the recordation of the Boundary Map in the official records of the Stanislaus County Recorder within 15 days of the date of adoption of this Resolution.

4. The type of services (the “Services”) proposed to be financed by CFD No. 2019-1 Annexation No. 1 and by proceeds of the special tax of CFD No. 2019-1 Annexation No. 1 (the “Special Tax”) are set forth in Exhibit A hereto, which is hereby incorporated herein.

The Waterford City Council hereby determines that the Services are necessary to meet increased demands for such services placed upon local agencies as the result of development occurring within the area of CFD No. 2019-1 Annexation No. 1. Page 2 ends

the date hereof and will not supplant services already available within the territory of CFD No. 2019-1 Annexation No. 1 as of the date hereof.

5. Except to the extent that funds are otherwise available to CFD No. 2019-1 Annexation No. 1 to pay for the Services, the Special Tax will be annually levied within CFD No. 2019-1 Annexation No. 1. Upon recordation of a notice of special tax lien pursuant to Section 3114.5 of the California Streets and Highways Code, a continuing lien to secure each levy of the Special Tax shall attach to all nonexempt real property within CFD No. 2019-1 Annexation No. 1, and this lien shall continue in force and effect until the Special Tax obligation is prepaid and permanently satisfied and the lien cancelled in accordance with law or until levy and collection of the Special Tax by the City ceases. All matters pertaining to the calculation, levy and collection, administration and duration of the Special Tax shall be governed by the applicable provisions of the Rate and Method of Apportionment as supplemented, if necessary, by the applicable provisions of the Mello-Roos Act.

6. It is anticipated that the Special Tax will be billed as a separate line item on the regular property tax bill of the County of Stanislaus. However, the Waterford City Council reserves the right, under Section 53340, to utilize any method of collecting the Special Tax which it shall, from time to time, determine to be in the best interests of the City, including, but not limited to, direct billing by the City to the property owners and supplemental billing.

7. Except as may otherwise be provided by law or by the rate and method of apportionment of the Special Tax for CFD No. 2019-1 Annexation No. 1, all lands owned by any public entity, including the United States, the State of California, the County, the City, or any departments or political subdivisions thereof, shall be omitted from the levy of the Special Tax.

8. It is the intention of the Waterford City Council that the electors will be the landowners within proposed CFD No. 2019-1 Annexation No. 1 in accordance with Section 53326 of the Mello-Roos Act. The proposed voting procedure shall be by mailed or hand-delivered ballot among the landowners in the proposed CFD, with each owner having one vote for each acre or portion of an acre such owner owns within the boundaries of CFD No. 2019-1 Annexation No. 1.

9. The City Manager (or deputy or designee thereof) is hereby directed to study the proposed Services and make, or cause to be made, and file with the City Clerk a report in writing (the “CFD Report”), that shall be a part of the record of the public hearing hereinafter specified and which report shall present the following:
(a) A description of the Services that will be required to adequately meet the needs of CFD No. 2019-1 Annexation No. 1.
(b) An estimate of the fair and reasonable cost of the Services and incidental expenses in connection therewith, and all other related costs.

10. The Waterford City Council hereby sets May 1, 2025, at 6:30 p.m. or as soon as possible thereafter, at the City of Waterford, City Council, 101 E. Street, Waterford, California, as the time and place to conduct a public hearing on the establishment of CFD No. 2019-1 Annexation No. 1. At the hearing, testimony of all interested persons for or against establishment of CFD No. 2019-1 Annexation No. 1, the extent of CFD No. 2019-1 Annexation No. 1, the proposed list of Services to be authorized, the proposed Rate and Method of Apportionment, or any other aspect of the proposed CFD No. 2019-1

Page 3 ends

Annexation No. 1 will be heard and protests will be considered. As provided by the MelloRoos Act, written protests by the owners of a majority in area of the land within the proposed CFD No. 2019-1 Annexation No. 1 will constitute a “majority protest” and will require the suspension of proceedings for at least one year. Written protests must be filed with the Clerk at or before the time fixed for the hearing. If such majority protests are directed only against certain elements of the proposed improvements or proposed special tax, only those elements shall be deleted from the proceedings.

11. The City Clerk is hereby directed to cause notice of the public hearing to be given by publication one time in a newspaper published in the area of CFD No. 2019-1 Annexation No. 1. *On each July 1, commencing on July 1, 2019, the Maximum Special Tax Rate for each Tax Zone shall be increased by 3%, the Tax Escalation Factor.

IV. A different Maximum Special Tax Rate may be identified in Tax Zones added to the District as a result of future annexations.

In some instances, an Assessor’s Parcel of Developed Property may contain more than one type of property. The Maximum Special Taxes levied on an Assessor’s Parcel shall be the sum of the Maximum Special Taxes for all Units located on that Assessor’s Parcel.

V. FORMULA FOR PREPAYMENT OF SPECIAL TAX OBLIGATIONS
The Special Tax may not be prepaid.

VI. EXEMPTIONS
Notwithstanding any other provision of this Rate and Method of Apportionment of Special Tax, no Special Taxes shall be levied on Public Property, except as otherwise provided in Sections 53317.3 and 53317.5 of the Act.

VII. INTERPRETATION OF RATE AND METHOD OF APPORTIONMENT The City reserves the right to make minor administrative and technical changes to this document that do not materially affect the rate and method of apportioning the Special Tax. In addition, the interpretation and application of any section of this document shall be at the City’s discretion.

Interpretations may be made by the City by ordinance or resolution for purposes of clarifying any vagueness or ambiguity in this Rate and Method of Apportionment of Special Tax.

VIII. MANNER AND DURATION OF SPECIAL TAX
The Special Tax shall be collected in the same manner and at the same time as ordinary ad valorem property taxes, provided that the City may directly bill the Special Tax, may collect the Special Tax at a different time or in a different manner if needed to meet the financial obligations of the District, and may collect delinquent Special Taxes through foreclosure or other available methods.

A Special Tax shall continue to be levied and collected within the District, as needed to fund the Annual Special Tax Requirement, in perpetuity.

IX. APPEAL OF SPECIAL TAX LEVY
Any property owner may file a written appeal of the Special Tax with the District Administrator claiming that the amount or application of the Special Tax is not correct. The appeal must be filed not later than one calendar year after having paid the Special Taxes that are disputed, and the appellant must be current in all payments of Special Taxes. In addition, during the term of the appeal process, all Special Taxes levied must be paid on or before the payment date established when the levy was made.

The appeal must specify the reasons why the appellant claims the Special Taxes are in error. The RESOLUTION 2025-08
10 District Administrator shall review the appeal, meet with the appellant if the District Administrator deems necessary, and advise the appellant of its determination.

If the property owner disagrees with the District Administrator’s decision relative to the appeal, the owner may then file a written appeal with the City Council whose subsequent decision shall be final and binding on all interested parties. If the decision of the District Administrator or subsequent decision by the City Council requires the Special Taxes to be modified or changed in favor of the property owner, no cash refund shall be made for prior years’ Special Taxes, but an adjustment shall be made to credit future Special Taxes.

This procedure shall be exclusive and its exhaustion by any property owner shall be a condition precedent to filing any legal action by such owner.

Resolution: Rescinding Resolution 2005-100 and adopting Resolution 2025-09, Approving the Fee Schedule for Waterford Baseball Field Rentals and Establishing a Fee Waiver for Waterford Youth Sports Leagues
SUMMARY:

Rescinding Resolution 2005-100 and adopting Resolution 2025-09, Approving the Fee Schedule for Waterford Baseball Field Rentals and Establishing a Fee Waiver for Waterford Youth Sports Leagues.

ANALYSIS:

On December 15, 2005, the City Council adopted Resolution 2005-100, establishing a rental fee schedule for the Waterford Baseball Field. After consideration, City Council wants to rescind Resolution 2005-100 and Adopt Resolution 2025-09, Approving the Fee Schedule for the Waterford Baseball Field Rental Fees and Establishing a Fee Waiver for Waterford Youth Sports Leagues.

FISCAL IMPACT:

The Waterford Baseball Fields are rented on an annual basis by the Waterford Youth Baseball and Softball Association and the Waterford Sabercats Youth Football League. Annually, the revenue generated from the field, snack bar and light rental is approximately $3,126.00. Approving a fee waiver will reduce the revenue generated by the field rentals to zero.

RESOLUTION: Adopting Resolution 2025-10, Giving Notice of It’s Intent to Abandon the Public Utility Easement Lying Under and across the City Owned F Street Storm Drainage Basin
SUMMARY:

Approving Resolution 2025-10, giving notice of it’s intent to abandon the public utility easement lying under, and across the city owned F Street storm drainage basin.

ANALYSIS:

The easement proposed for abandonment was originally established for telegraph lines running parallel to former railroad tracks. Over time, the land has been repurposed, and the specific lot in question now functions as a retention basin for stormwater runoff along F Street.

Since the retention basin is in place, the City has no current or foreseeable need for the public utility easement. The easement does not support any existing facilities, has not been subject to separate property tax assessments, and no recorded documents exist within the last 20 years that establish, transfer, or reserve the easement. Additionally, the City does not anticipate any future public utility use for the easement, as access is available and more viable via Western Avenue and Rose Court.

FISCAL IMPACT:

The City will incur a recording fee of approximately $50.

ENVIRONMENTAL REVIEW:

The proposed public utility abandonment is not considered a project as prescribed by the California Environmental Quality Act. No environmental review is necessary for this item.

WHEREAS, the City Council finds the proposed abandonment consistent with its General Plan.

NOW, THEREFORE, THE CITY COUNCI OF THE CITY OF WATERFORD DOES HEREBY RESOLVE AS FOLLOWS:
