Patricia Krause, City Clerk / Administrative Services Director City Council Staff Report
Resolution: Adopting Resolution 2025-12, Initiating Proceedings for the Levy and Collection of Assessments for the Waterford Lighting Assessment District for Fiscal Year 2025 – 2026.

SUMMARY:

Authorize NBS to prepare and file with the City Clerk the Annual Report concerning the levy and collection of assessments within the Lighting Assessment District for the Fiscal Year commencing July 1, 2025 and ending June 30, 2026.

ANALYSIS:

This is the first of a three-step process to get the annual assessments on the County tax roll. With approval of this item, NBS will prepare the Annual Engineer’s Report for the Lighting Assessment District for the May 15, 2025 City Council Meeting. City Council will consider approval of the Annual Engineer’s Report and declare intention to confirm and set the Assessments for Fiscal Year 2025-2026 and set a public hearing date for June 5, 2025 to take public comment, confirm the Assessments and order the Levy.

The Waterford Lighting Assessment District was formed in accordance with and pursuant to the Landscaping and Lighting Act of 1972, Part 2, Division 15 of the California Streets and Highways Code (commencing with Section 22500).

The LAD includes those properties as shown in the Lighting Assessment District Map of the City of Waterford which is on file at City Hall and available for public inspection. The District may make changes in existing and proposed improvements pursuant to the act. The City of Waterford established an assessment for the Lighting District of $11.24 per parcel for the Fiscal Year 2024-2025 by Waterford City Council Resolution #2024-33. The Act requires that an engineer prepare a report which refers to the assessment district by its distinctive designation, specifies the fiscal year to which it applies and contains the plans and specifications for the improvements, an estimate of the costs of the improvements, a diagram for the assessment district, and an assessment of the estimated costs of the improvements.

The City of Waterford has retained NBS for the purpose of assisting with the annual levy of the Assessment District, and to prepare and file an Annual Report. There are no changes to existing improvements nor are there any items being added to the list of improvements previously approved at the formation of the Assessment District.

FISCAL IMPACT:

There are no fiscal impacts associated with the initial proceedings. However, the initiation of proceedings is essential, as it is the first step in the process of collecting assessments that fund the Lighting Assessment District Fund.

ENVIRONMENTAL REVIEW:

There are no environmental impacts associated with this item.

ALTERNATIVES:

1. Adopt Resolution No. 2025-12, thereby initiating the proceedings for the levy and collection of assessments and ordering the preparation of the Engineer’s Reports for Fiscal Year 2024-2025.

2. Reject the initiation of proceedings, and direct Staff to review and recommend other funding sources to maintain the Lighting Assessment Districts.

Ordinance: Second Reading and Adoption of Ordinance 2025-01, Amendment of Waterford Municipal Code Title 3, Entitled “Revenue and Finance,” Chapter 3.08 Entitled “Purchasing,” by Amending Section 3.08.120.

SUMMARY:

Amending Waterford Municipal Code Ordinance Title 3 entitled “Revenue and Finance,” Chapter 3.08 entitled “Purchasing” by amending Section 3.08.120 with regards to expenditure limits as allowed for by the California State Controller and Public Contract Code 22000.

ANALYSIS:

Public Contract Code 22000 permits Cities to adopt the “Uniform Public Construction Cost Accounting Act (UPCCAA)” and the City Council adopted the UPCCAA on February 15, 2018. The primary goal of the UPCCAA is to provide cities flexibility in bidding Public Works projects by providing negotiated and informal bidding processes in addition to formal bidding processes. The California State Controller from time to time modifies the expenditure limits allowing cities to adopt the new limits if they desire.

The proposed ordinance amendment will align the city ordinance with the new limits codified in Public Contract Code 22032. The change in expenditure limits will go into effect on May 3, 2025 and are as follows:
(a) Public projects of seventy-five thousand dollars ($75,000) or less may be performed by the employees of a public agency by force account, by negotiated contract, or by purchase order. (b) Public projects of two hundred twenty thousand dollars ($220,000) or less may be let to contract by informal procedures as set forth in this article. (c) Public projects of more than two hundred twenty thousand dollars ($220,000) shall, except as otherwise provided in this article, be let to contract by formal bidding procedure.

As this is an alignment of expenditure authority to match the Public Contract Code, staff is recommending approval. If approved, staff will utilize the new expenditure limits thirty (30) days following council adoption.

FISCAL IMPACT:

The ordinance revision itself does not impact the City financially. Each capital project subject to the bid procedures will be brought to the City Council with a proposed budget for Council’s consideration and approval.

ENVIRONMENTAL REVIEW:

The City finds and determines with certainty that Code Text Amendment 2025-01 is exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3), and that the activity is covered under the general rule that CEQA applies to only projects which have the potential for causing a significant effect on the environment.

PUBLIC NOTICE:

In accordance with the City’s Municipal Code, a Public Notice was published in the Waterford News on March 8, 2025
ODINANCE REVISION PROCESS:

The Introduction and First Reading by title only for Ordinance 2025-01 was heard and approved at the March 20, 2025 Council meeting. A summary of the Ordinance was published in the Waterford News and tonight’s public hearing is for Council to consider the Second Reading by title and Adoption. After adoption, an Ordinance Summary will be published in the Waterford News and will become effective and in full force on and after thirty (30) days of its passage and adoption.

ALTERNATIVES:

1. Not approve the ordinance revision. This is not recommended as the proposed limits modification allows greater flexibility in bidding Public Works projects by providing greater expenditure authority for negotiated and informal bidding processes.

2. Defer approval of the ordinance to a future council date and provide staff direction on council desired changes.
