City Council Staff Report
Motion: Approve a Regional Solid Waste Disposal Plan Memorandum of Understanding between Stanislaus County and the City of Waterford and Authorizing the City Manager to Execute the MOU.

SUMMARY:

The City Council is being asked to enter into a Regional Solid Waste Disposal Plan Memorandum of Understanding (MOU). The MOU identifies the term and price for using the Fink Road landfill for solid waste needs.

ANALYSIS:

Pursuant to Public Resources Code section 40976 the County and the Cities of Ceres, Hughson, Newman, Oakdale, Patterson, Riverbank, Turlock and Waterford entered into a Memorandum of Understanding, dated August 26, 1994, regarding the use and distribution of AB-939 funds to achieve the waste reduction and diversion goals specified in AB- 939 (the "AB-939 MOU"). In December 1999, the County and the Cities entered into Amendment No. 1 of the AB-939 MOU to provide for payment of the Cities' proportional share of the costs for services provided by the County pursuant to AB-939. In March 2012, the City of Waterford, executed Amendment No. 2 to the AB-939 MOU, establishing Waterford’s obligation to pay their proportional share of the costs for services provided by the County pursuant to AB-939.

In Jume 2001, the County, together with the Cities of Ceres, Hughson, Newman, Oakdale, Patterson, Riverbank, Turlock and Waterford formed the Stanislaus County Regional Solid Waste Planning Agency by entering into a Joint Powers Agreement in June 2001, and the formation of the Regional Agency was approved by the California Integrated Waste Management Board in July 2002. The Regional Agency was formed to enable participating entities to share diversion credits and to prepare a single, unified planning document for the entire region. In June 2015, the Cities comprising of the Regional Agency entered into agreements establishing a Regional Solid Waste Disposal Plan, which provides for the delivery of acceptable solid waste to the Waste-to-Energy Facility and the Fink Road Landfill, and which agreements are set to expire on June 30, 2025.

In December 2024, the Waste-to-Energy Facility ceased operations, resulting in the need for the Fink Road Landfill to receive an increased portion of the countywide acceptable solid waste. The purpose of this Agreement is to enable members of the Regional Agency to implement a Regional Solid Waste Disposal Plan (the "Plan") that supports the continued operation of the Fink Road by ensuring the delivery of sufficient solid waste to the facility to maintain their economic viability, and to provide regional AB 939 and Household Hazardous Waste services. The Plan, as set forth in the Agreement includes a ten (10) year commitment from the Regional Agency Cities to guarantee the delivery of a portion of their solid waste to the Landfill and sets worth the tipping fees.

FISCAL IMPACT:
i. Tip Fee: $39.14 per ton.
ii. Household Hazardous Waste Program Fee: $2.45 per ton. iii. AB-939 Program Fees: $1.79 per ton.

ENVIRONMENTAL REVIEW:

The City finds and determines with certainty that the agreement for the distribution of Measure L funds is exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3), as the activity is covered under the general rule that CEQA applies to only projects which have the potential for causing a significant effect on the environment.

ALTERNATIVES:

1. Not approve the MOU. Staff does not recommend this as being in the Regional Agency provides not only access to the Fink Road landfill, but the County takes care of all state reporting and provides for continued local Household Hazardous Waste events.

City Council Staff Report
Motion: Approve the Purchase of 2.12 acres of vacant land at the NE corner of Tim Bell and Vineyard in the amount of $412,000 plus ½ of closing costs for a future Water System Storage Tank, Sewer Lift Station and Potable Well.

SUMMARY:

The City Council is being asked to enter into a purchase and sale agreement between Ben A. Ward and Carol S. Ward, Trustees of the B & C Ward 2004 Revocable Trust and the City of Waterford for the purchase of 2.12 acres of vacant land at the NE corner of Tim Bell and Vineyard in the amount of $412,000 plus ½ of closing costs for a future water system storage tank, sewer lift station and potable well
ANALYSIS:

Staff, in support of the development of the Lake Pointe Master Plan area, has identified the NE corner of Tim Bell and Vineyard as the most appropriate location to access existing sewer and water infrastructure. Engineering staff has identified a need for 2.12 acres of land to support a new 1.5- million-gallon water tank, new well, new sewer lift station and a point of connection to treated surface water if an agreement can be reached with the City of Modesto and Modesto Irrigation District.

Staff worked with the property owner and came to an agreed price of $200,000 per acre plus half the closing costs and a third party realtor of the city’s choice determined the price per acre was market rate for the Lake Pointe zoning.

FISCAL IMPACT:

The purchase price of $412,000 plus half of the closing costs in included in the FY 2024/25 budget under line item 5075-800-8022.

Future capital improvement projects will be required to follow CEQA guidelines.

ALTERNATIVES:

1. Not approve the purchase and sale agreement. Staff does not recommend this as the site is perfectly located to support water and sewer infrastructure point of connection to the Lake Pointe Master Plan area.
