City Council Staff Report
Resolution: Approving Resolution 2025-54, Authorizing the City Manager or Public Works Director to sign all documents, applications, assurances, grant agreements and statements regarding all Federal Highway Administration (FHWA) or any other federally funded or state funded projects
SUMMARY:

The City Council is being asked to authorize the City Manager or Public Works Director to sign all documents, applications, assurances, grant agreements and statements regarding all Federal Highway Administration (FHWA) or any other federally funded or state-funded projects.

ANALYSIS:

Each year the City works on capital improvement projects, many of which are funded by federal or state grant funding. One of the requirements for the use of these funds is the local legislative body must approve specific documents, applications, assurances, grant agreements and statements related to each individual project, unless signature authority is delegated to one or more city officials. Delegated signature authority allows for the expedited processing of documents at multiple phases in the project life cycle.

City staff is recommending the City Council authorize the City Manager or Public Works Director to sign all documents, applications, assurances, grant agreements and statements regarding any and all Federal Highway Administration (FHWA) or any other federally funded or state funded projects.

FISCAL IMPACT:

This action itself will have no fiscal impact.

ENVIRONMENTAL REVIEW:

The City finds and determines with certainty that this item is exempt from CEQA pursuant to CEQA Guidelines Section 15060(c)(2), as the activity is covered under the general rule that CEQA applies to only projects which have the potential for causing a significant effect on the environment. Future projects paid for by any future federal and state grants will be subject to a separate CEQA determination based on the scope of work and its impact on the environment.

ALTERNATIVES:

1. Not approve the Resolution and require one or more separate resolutions be prepared for each federal or state-funded project. Staff does not recommend this alternative due to the fact this action would delay the process of obtaining federal or state funding and could jeopardize funding allocation for some capital improvement projects.

WATERFORD CITY COUNCIL
RESOLUTION #2025-54

AUTHORIZING THE CITY MANAGER OR PUBLIC WORKS DIRECTOR TO SIGN ALL

DOCUMENTS, APPLICATIONS, ASSURANCES, GRANT AGREEMENTS AND

STATEMENTS IN REGARD TO ALL FEDERAL HIGHWAY ADMINISTRATION (FHWA) OR

ANY OTHER FEDERALLY FUNDED OR STATE FUNDED PROJECTS
WHEREAS, the City of Waterford has a desire and commitment to apply for and receive federal and state funding to construct various capital improvement projects; and WHEREAS, certain documents, applications, assurances, grant agreements and statements, are required to be approved by the local legislative body, unless approval authority is delegated to one or more City officials through an authorizing Resolution; and WHEREAS, the delegation of this signature authority will allow for the expedited processing of such documents, especially when restrictive federal or state project deadlines are imposed, allowing the City of Waterford to be better positioned to obtain or retain federal and state project funds; and WHEREAS, the specified activity is not subject to the California Environmental Quality Act (CEQA) because “the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment” [Section 15060(c)(2)] in accordance with CEQA Guidelines; and WHEREAS, all projects paid for by any future federal and state grants will be subject to a separate NEPA and/or CEQA determination based on the scope of work and its impact on the environment.

City Council Staff Report
Motion: Authorizing Staff to Prepare and Release a Request for Proposal (RFP) Soliciting Contractors for the Project No. 2025-09, “Hickman Water Consolidation Project.” SUMMARY:

Authorizing Staff to prepare and release a Request for Proposal (RFP) from contractors for the Project No. 2025-09 “Hickman Water Consolidation Project”.

ANALYSIS:

The project will take place on Hickman Road, encompassing the segment from the south side of the Tuolumne River bridge to Lake Road.

The proposed project consists of installing a new 14-inch water transmission main to establish a direct connection between the City of Waterford’s water distribution system and the Hickman Community Services District’s water system. This interconnection is intended to improve water reliability, increase system capacity, and provide redundancy for both communities in the event of an emergency or supply interruption.

The work will include trench excavation, installation of the transmission pipeline, backfilling, trench paving, and the application of new roadway striping to restore the affected areas to their original condition. All construction activities and improvements will occur entirely within Stanislaus County’s existing public right-of-way, minimizing the need for additional property acquisition. Traffic control measures will be implemented throughout the construction period to ensure public safety and maintain access for residents and businesses.

Upon completion, this project will enhance regional water infrastructure, support long-term sustainability, and strengthen the resiliency of both water systems.

FISCAL IMPACT:

The engineer’s estimate for this project came in at $1,025,000. The project will be paid for with a pending loan from Ibank. The loan will be for a maximum amount of $1,500,000 and will be repaid over 20 years at 4.52% interest. The exact amount of the loan will be based on the final bids and engineers’ final estimates of the cost. At $1.5 million the loan would cost the City $810,286 in interest over the life of the loan. Annual debt service would be $115,514. The loan would be secured by the revenues of the Water Fund. The final financing package will be brought before Council at a later date.

ENVIRONMENTAL REVIEW:

This project is categorically exempted according to Title 14, Chapter 3, Article 19 of the Guidelines for Implementation of the California Environmental Quality Act (CEQA), in accordance with Section 15301 “Existing Facilities.”
ALTERNATIVES:

1. Council can choose to authorize the release of the request for proposals for the “Hickman Water Consolidation Project” and proceed with the project as proposed.

2. Council could choose to not authorize the release of the request for proposals for the “Hickman Water Consolidation Project”. However, the loan funds, as authorized, are only for this specific project and cannot be used for alternative projects.

The people who live on the corner of Stein Way & Reid Ct. have left their travel trailer on the street since Sunday, August 24 and they are almost blocking my driveway. The car they have parked across the street from their home was tagged to be towed when it was parked where the trailer is now parked. They ripped the tags off the car, moved it across the street, and it hasn’t moved since.

Resident Abraham (209)232-0772 says he believes his meter is still leaking after City's repair. He still has high usage. I explained if leak was on City side it would not register to his meter but he says when he turns valve off at meter the dial stops spinning. I explained he may have a leak elsewhere on his property but he is convinced it is at the meter only. Can you please call him to arrange a time to possibly look at the meter with him present, please.
