Resolution: Approving Resolution 2026-31, Calling and Giving Notice of the Holding of a General Municipal Election to be Held on Tuesday, November 3, 2026, for the Election of Certain Officers as Required by the Provisions of the Laws of the State of California Relating to General Law Cities
and
Resolution: Approving Resolution 2026-32, Requesting the County of Stanislaus to Consolidate a General Municipal Election to be Held on November 5, 2024, with the Statewide General Election to be Held on the Date Pursuant to Section 10403 of the Elections Code
and
Resolution: Approving Resolution 2023-33, Adopting Regulations For Candidates for Elective Office Pertaining to Candidate Statements Submitted to the Voters at an Election to be Held on Tuesday, November 3, 2026
SUMMARY:
Approve resolutions calling for a General Municipal Election to be held on November 3, 2026; requesting the Stanislaus County Elections Department to Consolidate with the General Election conducted on that date and requesting the County Registrar of Voters provide election services; and adopting regulations related to deposits required for the printing of candidate statements.
ANALYSIS:
Pursuant to WMC §1.20.010, the City of Waterford conducts its municipal election on the same day as the Statewide General Election, which is the Tuesday following the first Monday of November in each even-numbered year.
Every regular election year, Council adopts resolutions calling for the November election and requesting consolidation and election services from Stanislaus County. By consolidating the City’s General Municipal Election with the County, the cost of holding the election is much lower due to the combining of resources for certain services.
The terms of Councilmember Christine Harris and Councilmember Elizabeth Talbott will expire in December 2026, and thus two seats will be up for election. The office of two (2) City Councilmembers will be elected to full terms of four (4) years.
The timeline for potential candidates is as follows:
July 13 - Filling Period: Candidates may take out nomination papers from the City Clerk during August 7 this period, collect signatures, and file their completed papers with the City Clerk.
August 8 - Extended Filing Period: If incumbents do not file for candidacy, the deadline for August 12 NON- incumbents is extended to this date.
November 3 Election Day
In addition to the resolutions calling for an election and requesting consolidation with the County, the third resolution outlines the Council’s policy with regard to candidate statements and reimbursement to the City for the expense of printing those statements.
The County has estimated the cost for printing a candidate statement in the sample ballot to be $750.00. This is an estimate only. The City will collect the $750 as a deposit and any cost higher than that will be billed to the candidate. If the cost of printing the statements comes in lower, candidates will receive a refund of the remaining deposit funds.
FISCAL IMPACT:
The estimated cost of the November 3, 2026 General Municipal Election is $15,000.
ALTERNATIVES:

City Council Staff Report
Workshop: Fiscal Year 2026-2027 Preliminary Budget
SUMMARY:
The Fiscal Year 2026-2027 preliminary budget is being presented to the City Council and the public for consideration. If approved, it would result in a General Fund reserve balance of $3,203,849 on June 30, 2027.
ANALYSIS:
The preliminary budget is intended to provide Council an opportunity to review the budget before a final version is prepared for adoption at the June 4 meeting. On June 30, 2027, the General Fund reserve is expected to be at 58% of annual expenditures. Council policy requires the reserve balance to be at least 50%.
The 2027 General Fund revenue budget reflects a 2.7% increase in revenues over the prior year. Property taxes are projected to increase by 4.5% and sales tax 4.0%. No significant changes are expected in the revenues for the General Fund. Operating expenses are budgeted to increase 6.1% or $308,845 over the prior year. Liability and Workers Compensation insurance are expected to increase $75,489 or 20% in total. Other areas seeing increases are payroll and payroll related items and the Sheriff’s budget. The budget also includes one-time capital items for $250,000 in park improvements, $6,800 in computer upgrades, and $20,000 for a utility vehicle. After all considerations the budget presents deficit spending of ($295,677) and a 58% reserve balance of $3,203,849.
Other Governmental Funds are tied to special revenue sources and are self-sufficient. Below are some highlights of the Other Governmental Funds:
• Special Business Pilot – budgeted $80,000 to be used to pay down long-term debt • Abandoned Vehicle Abatement - $51,874 budgeted to cover costs of abatement activities • Gas Tax – includes $530,998 for Streets and Roads
• CDBG Consortium - $645,368 for N. Pasadena Improvements • Parks & Recreation Programs - $10,575 for Basketball Program • Impact Fees - $3,500 for Administration and Planning, $36,064 for City Facilities, $454,531 in Water Impact Fees for a new well in Lake Pointe, and $21,226 for the Police Building Loan • Maintenance and Lighting Districts – combined costs of $184,853 for maintenance and operations The Capital Improvement Funds reflect the activities of all streets and roads capital activity including grants and funding from Measure L and the capital activities related to parks. • Safe Routes to School Pedestrian Improvements on Tim Bell from Yosemite to Vineyard – ATP Grant • Bonnie Brae Improvements frontage infill F Street to Tim Bell – STBG funds and Measure L • Washington Road frontage infill – ATP funds
The Enterprise Funds reflect the activities of the City’s Water and Wastewater Systems.
Water Enterprise (Waterford, River Pointe, and Hickman) The City’s Water fund recently approved a 5-year rate plan that should see the fund stabilize and be able to pursue much-needed infrastructure improvements. The first increase took effect on March 1, 2026 with a 40% rate adjustment. The subsequent increases on March 1 of each year will be 25%, 8%, 5%, and 5%. Staff is budgeting funds towards a new well and various water line upgrades throughout the community for a total reserve spending of $2,010,000 for capital projects. Operationally the goal is to meet the Debt Coverage Requirement of
1.20 times Net Operating Income. The budget as presented meets the earnings requirements of our debt obligations. The system is budgeted to transfer $1,431,633 to reserves in 2026-2027. Ending capital reserves are expected to be $133,971 at year end.
Wastewater Fund
The operations budget includes costs of $1,473,313 (net of noncash items) and $733,167 being transferred to reserves. The Wastewater System budget reflects the anticipated rate increase of 3% scheduled for July 1, 2026.
This will be the third rate adjustment from the 2024 Waterford Sewer Rate and Fee Study. Two more consecutive rate adjustments of 3% will occur on July 1 through 2028. The Wastewater CIP fund reflects $685,000 in projects.
The projects include $5,000 for capital engineering, $350,000 for Biosolids Removal, $30,000 for a utility vehicle, $250,000 for Phase II Sewer Improvements, and $50,000 for unscheduled capital maintenance items.
Wastewater reserves are expected to be $322,541 at year end.
FISCAL IMPACT:
The budget sets the fiscal and spending plan for the City and the specifics for each fund are detailed in the budget document. Approval and adoption of the budget establish the spending authority for City staff to carry out the City’s functions.

City Council Staff Report
Motion: Give direction to staff as to the level of Dual Language support that Council wants to provide the community.
SUMMARY:
At the March 5, 2026 City Council meeting, a community member requested that the city try to include communications for Spanish only speakers. Staff seeks council direction on what efforts, if any, staff should make to accommodate this request.
ANALYSIS:
On October 3, 2025, California Governor Gavin Newsom signed into law Senate Bill 707 making major changes to the Brown Act. Specifically, SB 707 provides new requirements to facilitate increased public participation and access to public meetings. In addition, SB 707 also modifies remote participation rules for members of legislative bodies.
Most amendments and requirements under SB 707 took effect on January 1, 2026. Requirements applicable to “eligible legislative bodies”, as defined in the statute, begin on July 1, 2026. The requirements of SB 707 only apply to:
1. City Council of a city with a population of 30,000 or more.
2. Board of Supervisors of a county (or city and county) with a population of 30,000 or more.
3. City Council of a city located in a county with a population of 600,000 or more.
4. Board of Directors of a large special district meeting certain thresholds:
• Entirely within a county with ≥600,000 population and ≥200 FTE employees, or • ≥1,000 FTE employees, or
• Annual revenues >$400 million (adjusted annually for inflation) and ≥200 FTE employees.
Given the eligible legislative body definition above, the City of Waterford is not required to meet the more demanding SB 707 requirements.
Changes Applicable to All Local Agency Legislative Bodies SB 707 introduces several changes to the Brown Act applicable to all local agency legislative bodies as follows:
• Social Media Use: Members may communicate with constituents on social media but must not engage with fellow members about agency business on these platforms. • Closed Session Reporting: Agencies must now provide an oral summary of compensation decisions, including for unrepresented employees and department heads, before final action, including fiscal impact estimates. • Brown Act Distribution: Agencies are now required to provide a copy of the Brown Act to newly elected or appointed legislative body members. • Remote Participation: Remote attendance rules are now permanent, with limits based on meeting frequency of the legislative body. “Just Cause” exceptions have been expanded. Additionally, the new law allows remote participation as an accommodation under the Americans with Disabilities Act (ADA). Additionally, the law authorizes remote participation for “eligible subsidiary bodies” and “eligible multijurisdictional bodies” under certain circumstances.
• Public Access Enhancements: Removes outdated definitions of recording devices to include any device used to record meetings. Additionally, all agencies must maintain a public webpage.
Changes Applicable to “Eligible Legislative Bodies” for which Waterford does not meet • Remote Public Participation Technology: Provide a way for the public to attend remotely through a two-way telephonic or audiovisual platform; and • Disruption to Telephonic/Internet Service: Adopt a policy addressing the disruption to telephonic or internet service during meetings; and
• Translation Requirements: Translate agendas into applicable languages; and • Website Requirements: Maintain an agency website; and • Outreach Efforts to Underrepresented Groups: Make reasonable efforts to conduct outreach and invite underrepresented and non-English speaking groups of the public to attend meetings and access meeting materials.
At this time and given communications from the community regarding a desire to have city documentation in both English and Spanish, staff is now asking what level, if any, does City Council want to meet the bilingual request.
Options include:
1. Maintain status quo and provide all council agendas, packets, meeting notices in English only.
2. Provide agendas and meeting notices in English and Spanish. This would be simple by using Microsoft Word translation.
3. Provide entire City Council Packet in English and Spanish. This would be complicated as we work with consultants that may or may not be able to meet the requirement or will add additional costs to the city for translation services of all their work.
4. Purchase software for agenda management and on demand translative services accessed through a smartphone App.
5. Have Spanish speaking staff attend every public meeting to provide interpretive services.
Staff also looked at software packages that would allow City Council Agendas to be easily converted into Spanish and many more languages. We also found a software package that would translate meetings live using personal smart phones or tablets. The user would be able to read the English verbal discussions in their native language.
FISCAL IMPACT:
1. Status Quo – No additional cost to city.
2. Translate the agendas into Spanish using Microsoft Word and posting on website. This would be easy with little to no costs.
3. Providing the entire City Council packet on our website would be extremely difficult as we use many consultants and they would need to also modify how they submit staff reports and appendices. The cost is currently unknown as it would require the city to complete the extra work on our end and requires the city to pay additional hourly fees to our consultants for translating their documents.
4. The City could purchase Agenda Quick software package. This is an agenda management tool for building interactive agendas with hyperlinks to various staff reports and additional hyperlinks to the appendices for the community to access via our website. Staff reviewed the City of Hawthorne’s use of the software. It appears the software provides for conversion on the agenda and staff reports to Spanish and many other languages. It appears the appendices to the staff report may remain in English. However, further investigation may prove otherwise. The cost of the software would be $6,000 annually with an initial set up fee of $3,000.
5. The city could purchase Wordly.ai that would translate council meeting presentations and council discussions in real time for community members to read closed caption communications on their smartphones or tablets. The cost of the software would be $6,375 annually with an initial set up fee of $500. The annual subscription would give us 100 hours of translative services. If we exceed 100 hours, additional charges would apply.
ENVIRONMENTAL REVIEW:
The City finds and determines with certainty that the proposed Professional Services Agreement is exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3), as the activity is covered under the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment.

We greatly enjoy the trail along the Tuolumne River. However, the trash cans along the River Park Trail (bordering River Pointe) are full. Several of them have been full for over 3 to 4 weeks. We have not walked the entire trail, but others to the west of River Park toward the S. Reinway Park & Trailhead may be full as well. They should be emptied as they smell and can attract vermin. Also, while it is good that people use the trash cans, when they are full it encourages people to leave their trash along the trail. Thank you, Frank and Jeanne Kampen
